Dear Ms. Tynan,

Thank you for your brief e-mail note (final item, below) to me today, which informed me that the text of your reply message to me today (with verbatim text of your reply message today now appearing immediately below) could be reviewed by me in encrypted form.

In response to your polite question to me today, I would like to substitute the following paragraph, immediately below, for the first paragraph of my September 21, 2020, public-information request (final item, below) to your UT System General Counsel and Vice Chancellor Daniel Sharphorn.

"I am seeking a copy of any and all written communications, including any and all e-mail communications and reports and directives, referring at least once in any manner to myself, John Kevin McMillan of Austin, that at any time from 12:01 a.m. April 28, 2011, to the present, were written, generated, sent, e-mailed, forwarded, mailed, FAXed, or received by a state-certified supervisory peace officer or any other state-certified peace officer employed inside the UT System Office of the Director of Police in downtown Austin. Excluded from the scope of this request are any and all documents that I myself exclusively wrote."

Please disregard the first paragraph only from my September 21, 2020, public-information request, with all other portions of that letter to remain exactly the same as before and to be included in this revised public-information request from myself.

Thank you again for your reply note to me today. I hope to hear from you soon.

Sincerely and Best Wishes,

John Kevin McMillan, public-information requestor.

Dear John McMillan,

This correspondence relates to your below request for information, received by The University of Texas System Administration (“UT System”) on September 21, 2020.  In your request you state you seek the following:

a copy of any and all written communications, including any and all e-mail communications and reports, referring at least once in any manner to myself, John Kevin McMillan of Austin, that at any time from 12:01 a.m. April 28, 2011, to the present, were written, produced, sent, e-mailed, forwarded, mailed, or received by a certified peace officer, regardless of his or her rank or title or administrative position, who either was at that time or currently is pursuing job duties in Travis County, Texas, for the UT System Police Department.

We require additional guidance in order to process your request.

Initially, please note that in response to earlier requests, UT System has provided you with certain information pertaining to yourself (see attached emails), and sought opinions from the Attorney General regarding information we believed was excepted from disclosure. In the attached opinions, the Attorney General agreed the information at issue was excepted from disclosure. The law, facts, and circumstances on which those prior rulings were based have not changed. Accordingly, UT System will continue to rely on those rulings and withhold any information responsive to the instant request on that basis.

We understand that you are seeking email communications and reports, referencing yourself that were created, received, or sent by a certified peace officer working for University police. However, UT System does not have its own police department in the traditional sense of the term. Rather, UT System’s Office of the Director of Police (“ODOP”) oversees the departments at the UT System institutions, including The University of Texas at Austin (“UT Austin”). The reports and emails of officers at the UT System institutions police departments is separately maintained by the institution police departments and must be requested directly from those institutions.

To the extent you seek information maintained by UT Austin’s police department, you can submit requests to UT Austin via e-mail at publicinformationrequest@austin.utexas.edu or via UT Austin’s online portal available at Support Home Page. The webpage containing the online portal also contains information regarding UT Austin’s open records process and a mailing address.

To the extent your seek information maintained by UT System’s ODOP, other than the information previously released to you or excepted from disclosure under the prior Attorney General opinions, please confirm that is the information you seek. Additionally, if you seek information maintained by ODOP, do you agree to exclude any emails correspondence directly to or from yourself, such that you would already maintain the information in your personal email account?

Your response will help clarify your request so that we may promptly identify and not exclude any of the information you seek.

Please note that if you do not respond to this request for clarification in writing within 61 days from the date of this letter, your request will be considered withdrawn.  See Tex. Gov’t Code § 552.222(d)-(e).

Without additional clarification from you, we are unable to process your request further.  Upon receipt of your written clarification, we will review any responsive documents for release in light of any applicable exceptions under the Texas Public Information Act.  We will respond to your clarification within a timely manner as required by law.  See City of Dallas v. Abbott, 304 S.W.3d 380 (Tex. 2010).

Please send your clarification in writing via email to ctynan@utsystem.edu or to the address in my below signature line.  In addition, you can reach me to discuss any questions via telephone at 512-499-4505.

If you have any questions or concerns regarding this correspondence, please do not hesitate to contact me.

Regards,

Cynthia Tynan

Dear Vice Chancellor Sharphorn,

This is a Texas Open Records request in which I seek to obtain from you a copy of any and all written communications, including any and all e-mail communications and reports, referring at least once in any manner to myself, John Kevin McMillan of Austin, that at any time from 12:01 a.m.

My legal name is John Kevin McMillan. I was born in Lincoln, Nebraska, on April 27, 1957.

I was Salutatorian of the Class of 1975 at Stephen F. Austin High School of Austin Independent School District. I have a Master's Degree in Journalism and Mass Communications from the University of Minnesota in Minneapolis, and I have a Bachelor of Arts Degree from the University of Texas at Austin.

I have resided in Austin proper on a continuous and uninterrupted basis ever since mid-March 1997.

I have kept the same personal e-mail address of "mcmillanj@att.net" throughout the entire nine-year period applicable to this public-information request. I have also used the same personal phone number of (512) 342-2295 throughout the entire nine-year period for this request.

I reside alone as a rent-paying official tenant inside a solo-occupancy always-fully-bolt-locked and always-fully-locked efficiency rental-apartment unit at a large gated-community apartment complex, Pebble Creek Apartments at 8805 North Plaza Drive in north Austin.

When Austin Independent School District (AISD) classes are being held, my current apartment complex in Austin is serviced on schoolday mornings by AISD buses and AISD bus drivers.

During the nine-year period applicable to this public-information request, I have resided as a rent-paying official tenant or, for a brief multi-month period in 2016, a rent-paying approved occupant, at the following locations, listed chronologically from oldest address to most recent address:
---Wind River Crossing Apartments, 11411 Research Boulevard, Apt. 325, Austin, TX 78759.
---Crossland Economy Studios, 12621 Hymeadow Road, Apt. 133, Austin, TX 78729.
---Village Oaks Apartments, 10926 Jollyville Road, Apt. 902, Austin, TX 78759.
---Village Oaks Apartments, 10926 Jollyville Road, Apt. 1609, Austin, TX 78759.
---Austin Motor Inn, 11400 North Interstate Highway 35, a first-floor room, Austin, TX 78753.
---Pebble Creek Apartments, 8805 North Plaza Drive, Apt. 2418, Austin, TX 78753.

I am the founder and only approved current member of a new and non-Christian non-proselytizing "Honor Society" religion, the anti-marijuana, anti-medical-marijuana, anti-illicit-drugs, anti-tobacco, anti-drinking-alcohol, anti-tattoos, anti-profanity-minded, anti-facial-hair-minded  "Progressive Prohibitionist Religion", or "PPR", that has very stringent membership-eligibility requirements.

That one total religion of mine opposes home-invasion crimes, opposes personal-injury-crimes, opposes sexual assault crimes, opposes the sex crime of pederasty, opposes the infliction of profanity or obscene speech on anyone in a context that violates their own privacy rights, opposes anonymous communications that violate the privacy of the person being subjected to those communications, opposes fraudulent or knowingly dishonest communications, opposes thought-control projects, opposes so-called "deprogramming" projects, opposes kidnappings, opposes hostage-takings, opposes compelled speech that violates the privacy rights of the individual being subjected to that compelled speech against his wishes, and opposes deliberate infliction of continuous noise pollution on anyone in a context that harms their own medical health or that is aimed at punishing them for having political or religious or personal beliefs---or personal prejudices, even---that are disliked or opposed by the perpetrators of that noise pollution.

Numerous Austin-area residents have stated to me over a multi-year period that they either dislike or intensely dislike or question the authenticity of my own fully-independent "Progressive Prohibitionist Religion"---an implicitly-deistic, non-atheistic factually-minded religion on behalf of which around the turn of the century I gave several televised speeches on local Community Access Television in Austin.

One anonymous male younger person around the turn of the century left a recorded phone message on my telephone answering machine inside my ViewPoint Apartments rental-apartment unit near UT-Austin, in which he stated that he himself was "Catholic"; and he used profanity and a violent, obscene phrase in criticizing my PPR religion.

One former resident of the Austin area, Dr. Michael Kim McMillan, around the turn of the century stated to me with indignation and intense revulsion on his face in an in-person conversation I had with him outdoors near the UT-Austin campus during a visit of his to Austin, Texas, from out of state: "The 'Heaven on Earth' religion you've (John Kevin McMillan of Austin) established has inflicted Hell on our entire planet!"

I hope to hear from you soon in response to this public-information request from myself.

Sincerely and Best Wishes,

John Kevin McMillan, public-information requestor.

My solo-occupancy efficiency-apartment-unit rental-home address ever since June 21, 2019:
Pebble Creek Apartments, 8805 North Plaza Drive, Apt. 2418, Bldg. 17 (a multi-unit apartment building situated in the northeastern corner of this large and gated-community complex that reportedly receives private security-patrol services on a 24-hour-a-day and year-round basis from Statewide Patrol, Inc.), Austin, TX 78753.
Home phone: (512) 342-2295.
Cell phone: (512) 993-7305.

Dear Open Records Coordinator for the State Auditor of Texas,

This is a Texas Open Records request in which I seek to obtain from you a copy of any and all
e-mail communications, letters, memoranda, reports, or other written communications referring at least once in any manner to myself, John Kevin McMillan of Austin, that were written or sent at any time during the multi-year period from 12:01 a.m. April 28, 2011, until 2:05 p.m. October 2, 2020, by any of the certified peace officers, regardless of their rank, who were at that time, or are each currently, employed here in Travis County in an office or division of the Texas State Auditor's Office.

One female investigator for the Texas Department of Family and Protective Services, Diana McGeehan, on November 14, 2019, made a 40-total-minute on-duty professional visit to my current Pebble Creek Apartments rental-efficiency unit in Austin in which she interviewed me for DFPS Case Number 7292-2668. During that on-duty visit to my solo-occupancy apartment unit, Investigator McGeehan stated to me that I should purchase a second infrared motion-sensitive camera and use it inside my bedroom in order to obtain additional factual evidence of alleged home-invasion-crimes perpetrators and alleged trespassing crimes perpetrators and alleged personal-injury-crimes perpetrators allegedly physically present inside my current bedroom during my sleeping hours as I lie alone on my own bed, asleep and unconscious and probably snoring, inside my always-locked efficiency apartment unit.

My legal name is John Kevin McMillan. I was born in Lincoln, Nebraska, on April 27, 1957. I am a single adult permanently-drinking-alcohol-free white non-Hispanic gentleman of English, Scottish, and German ancestry.

I have resided in Austin proper ever since mid-March 1997, during which time I have been employed by a variety of reputable employers, including the Texas Department of Public Safety state law-enforcement agency. I was employed full-time in the DPS Motor Carrier Bureau along Guadalupe Street for one year in the late 1990s.

This public-information request was prompted in part by having read recently that infliction of continuous and toxic noise pollution on targeted human rights victims has frequently occurred in cases of religious or political persecution of those individuals.

I am the founder and only approved member of a new and non-Christian, non-proselytizing religion, the anti-drinking-alcohol Progressive Prohibitionist Religion ("PPR"), that many Texans have indicated to me that they either dislike or do not regard as being a religion. My religion was incorporated by me with the Secretary of State of Texas state agency in 1996.  However, I decided not to renew my incorporation of my PPR religion with the Secretary of State in Austin until I myself agree to personally approve an application for membership in my religion that I directly receive from at least one prospective new member.

This public-information request was also prompted by concerns of mine in regard to whether any individuals employed by a State of Texas-owned agency or institution have allegedly had any role of any type in alleged continuous-and-still-continuing-daily-and-year-round obscene anonymous communications, verbalized anonymous death threats, home-invasion-crimes, trespassing-crimes, anal-rape-crimes and personal-injury-crimes inflicted on me during my sleep; or in alleged continuous-and-still-continuing-daily-and-year-round sleep-harassment crimes and accompanying verbal harassment of me that have repeatedly robbed me of sleep and of revitalizing deep sleep, in particular, on a daily and year-round and multi-year basis as I lay alone or lie alone on my own bed, asleep and unconscious and probably also snoring, inside each of my locked apartment units, and inside each of the locked hotel rooms I had rented for myself only, in this state-capital city for Texas.

I myself am a lifelong non-Christian gentleman. I take pride in being law-abiding, conscientious, very civil, and honest. I am very opposed to the deliberate infliction of continuous noise pollution on anyone in a context that violates his own privacy rights. I also oppose the infliction of continuous anonymous obscene communications on anyone in a context that violates his own privacy rights. I also oppose infliction of thought-control projects on anyone.

In August of 2001 one Travis County Government official, David Ferris, Civil Probate Division Director for the Travis County Clerk's Office in Austin, volunteered an oral statement to me on the telephone during a polite local phone call I had made to his government office from inside an apartment I had just moved into in northwest Austin (this after having myself been informed in writing by most recent previous apartment manager in Austin that my UT campus-area rental-efficiency-apartment at ViewPoint Apartments along Leon Street was no longer being rented to any non-student, with the ViewPoint management team also having informed me in writing in 2001 that for that one total reason --- my not being a registered college student or graduate student--- I myself did not have the option of renewing my lease for my efficiency apartment at that ViewPoint Apartments complex):

"There appears to be an attempt by numerous persons to drive you (John Kevin McMillan of northwest Austin) out of the Austin area," Travis County official David Ferris stated to me on his own volition.

A few years ago, as I walked near one Austin gentleman at a public place in northwest Austin, I overheard him stating to a friend of this: "That guy is in Auschwitz (sic), but no one else is."

My primary personal e-mail address of "mcmillanj@att.net" and my primary personal phone number of "512-342-2295" have remained the same throughout the nine-and-one-half-year period applicable to this public-information request.

I am a former Salutatorian of Stephen F. Austin High School of Austin Independent School District in Austin, Texas. I am an alumnus of The University of Texas at Austin and The University of Minnesota Graduate School of Journalism and Mass Communications in Minneapolis, respectively.

During the nine-and-one-half-year period applicable to this public-information request, I have resided as a rent-paying official tenant or, for a brief multi-month period in 2016, a rent-paying apartment-management-team-approved occupant, at the following locations, listed chronologically from oldest address for me to most recent address:
---Wind River Crossing Apartments, 11411 Research Boulevard, Apt. 325, Austin, TX 78759;
---Crossland Economy Studios, 12621 Hymeadow Road, Apt. 133, Austin, TX 78729;
---Village Oaks Apartments, 10926 Jollyville Road, Apt. 902, Austin, TX 78759;
---Village Oaks Apartments, 10926 Jollyville Road, Apt. 1609, Austin, TX 78759;
---Austin Motor Inn, 11400 North Interstate Highway 35, a first-floor room, Austin, TX 78753; and
---Pebble Creek Apartments, 8805 North Plaza Drive, Apt. 2418, Bldg. 17, Austin, TX 78753.

The "Honor Society" Progressive Prohibitionist Religion that I founded in 1996 while residing in Denver City, Texas, is anti-marijuana, anti-medical-marijuana, anti-illicit-drugs, anti-tobacco, anti-drinking-alcohol, anti-tattoos, anti-profanity-minded, anti-facial-hair-minded, and has very stringent membership-eligibility requirements.

That one total religion of mine opposes home-invasion crimes, opposes personal-injury-crimes, opposes sexual assault crimes, opposes the sex crime of pederasty, opposes the infliction of profanity or obscene speech on anyone in a context that violates their own privacy rights, opposes anonymous communications that violate the privacy of the person being subjected to those communications, opposes fraudulent or knowingly dishonest communications, opposes thought-control projects, opposes so-called "deprogramming" projects, opposes kidnappings, opposes hostage-takings, opposes compelled speech that violates the privacy rights of the individual being subjected to that compelled speech against his wishes, and opposes deliberate infliction of continuous noise pollution on anyone in a context that harms that individual's own medical health or that is aimed at punishing him or her for having political or religious or personal beliefs---or personal prejudices, even---that are disliked or opposed by the perpetrators or sponsors of that noise pollution.

Around the turn of the century I gave several televised speeches on behalf of that religion of mine on local Community Access Television here in Austin. One younger Central Texan man even left a violent-sounding and obscene anonymous recorded phone message on my telephone-answering machine inside my apartment near UT-Austin---a recorded phone message in which he volunteered that he himself is "Catholic". In his recorded message to me, he stated that he was reacting to one or more locally televised speeches of mine that I had given on behalf of my PPR religion.

Around the turn of the century, one former Austin-area resident, Dr. Michael Kim McMillan, declared to me in person with indignation and revulsion in his tone of voice and facial expression in a conversation I had with him outdoors near UT-Austin's campus that occurred during a brief visit of his to the Austin area from out of state: "The 'Heaven on Earth' religion you've (John Kevin McMillan of Austin) established has inflicted Hell on this entire planet!"

Thank you in advance for your reply letter to me in response to this public-information request from myself. I hope to hear from you soon.

Sincerely and Best Wishes,
John Kevin McMillan, public-information requestor.

IMAGINARY 'OVERHEARD MOMENTS' IN NEW YORK THIS MONTH: WHAT THEY MIGHT HAVE SAID TO EACH OTHER HAD I BEEN THERE AT THE TIME TO DISCREETLY EAVESDROP

---"I'm so glad I don't work for a dating service during this pandemic. Most single persons won't be happy with virtual dates, but that's all I could ethically offer them if I worked for a dating service here in Manhattan. They could look at images of each other on their cell phones while having a friendly conversation."

--"As a therapist, a lot of my virtual-clients here tell me they fell in love with their doctor or nurse during their stay in the hospital. They fell in love because they got out of the hospital alive, so they figure their doctor or nurse was a good luck charm for them for the rest of their lives. I have to explain to my clients that it was a professional relationship with that doctor or nurse, NOT a personal relationship. The chances of their crossing the altar with their doctor or nurse are one in a million, I would say. And besides, many of those doctors and nurses they saw in the hospital are already married to someone. This is the kind of reality my clients are often wildly out of touch with."

--"This pandemic has completely changed my outlook toward human saliva. I wish I could find a book that offers nothing but good things to say about human saliva, this might cheer me up a bit. What role does saliva play, other than to spread fatal diseases? This is what I seem to forget these days. I would prefer a photo-illustrated book that conveys and promotes each of the healthy roles that human saliva can offer us."

--"I try to stay away from all of my most neurotic friends these days. I would find it unbearably stressful to hear them tell me on the telephone that they had a possibly fatal moment on the subway when a guy near them suddenly sneezed so dramatically that his face mask fell off in the middle of it. New Yorkers tend to be very dramatic in their sneezing practices, from what I've seen---probably the southern Italian influence here. I have never heard of a southern Italian who can sneeze with subtlety."

---"At least no one is accusing me of being inhospitable these days. I was somewhat notorious before COVID 19 because I hosted only one social party per year. Everyone said I was very stingy that way. Now I host zero parties per year, and everyone is happy with me."

--"I need to talk with friends of mine who hosted a virtual party and had a lot of fun with it. I like the idea of offering virtual hors d'oeuvres, since I don't have to spend as much time in the kitchen when I prepare a virtual hors d'oeuvre for my virtual party guests. They all tell me they had a virtually good time, and after the party there is no mess to clean up."

---"What I need is a poster I can display in my living room that ranks each of the vegetables and fruits for their health benefit levels. Broccoli is right up there; I just need a power-ranking of each of the other lifesaver vegetables and lifesaver fruits, as I call them. My thinking is that if I can survive this pandemic with help from that poster on my wall, I will also have 10 additional years of longevity I can devote to being a paid consultant to businesses. I haven't figured out yet what they'd consult me about, so I need to identify my expertise area and market myself ferociously as an expert in that field."

---"I was invited to a virtual funeral the other day, and I attended but with reservations. I felt awkward sitting in my living room while crying for the honored corpse I saw on my computer screen. There was no sense of true commiseration, since I was crying all alone in my apartment."

---"Maybe I should pay a consultant to help me identify the one place in the entire world that statistically is least likely to be struck by a pandemic. I will then make a point of buying a second home there, so I can evacuate to my second home far away whenever New York has its next pandemic."

---"I have spent much of this pandemic trying to talk my relatives into quitting smoking, with zero success at it. Everyone resents it when I bring the subject up, they say it just increases their stress level so they respond by lighting up a cigarette."

--"I need to get a statistic on the percentage of those who died from COVID-19 who are smokers. That statistic would be great publicity for the American Cancer Society and our annual fund drives. That may sound callous of me to say, but I recognize the strategic benefit to the American Cancer Society from publicizing that type of statistic."

---"I get very tired of telling everyone that I am grateful to be alive. I hope I can do better than to offer that as my daily declaration. It sounds brain-dead to say that over and over again. What about this: 'I am grateful to have invented a labor-saving device that I hope to get patented soon so I can retire to Tahiti'. Wouldn't that be a more interesting thing to say than 'I'm grateful to be alive'?

---"I'm probably the only person I know of who has never been asked for an interview by either The Times, The Post, OR the Daily News. My consolation is that I've succeeded so well at what I'm doing that there's no need for a headline to announce that success of mine to the entire world. True, I probably would get some phone call invitations to meet someone for lunch if they read about me in one of our three major papers. But it's probably just as well that my face is not plastered all over our newspapers. It might be a security risk for me if there were photos of mine in the media. Some reader with a criminal record might envy my success and try to kidnap me and demand a ransom."

--"I wish there were a medical clinic that offers to clear my lungs for a reasonable fee. Since I'm a smoker, I need to get my lungs cleared once per week to increase my chances of surviving the pandemic. I'm willing to pay $2,000 per lung-clearing session."

---"Everything is different now. When you hear the honking sounds below, you think to yourself, 'My god, what if this is my last day on this planet for pretending that the honking sounds were a musical performance delight for my eardrums?'"

---"Whenever I call a prospective employer about a a job vacancy listing I found in The Times, I always ask that employer to tell me whether the last person who held that position is still alive. This may sound morbid, but I'm very superstitious about not wanting to accept a job offer for a position last held by someone who died while still employed there. I would find that very eerie, a situation in which a job opportunity had developed for me because the last guy turned into a corpse. I would need to study his obituary to make sure he died completely of natural causes not involving COVID-19 and no foul play was involved, before I could even consider saying 'yes' to that job offer."

--"Look at it this way. If you believed in vampires, this could be a golden era for you here in New York. You could try to get suggestions from a vampire-prevention service on how to keep vampires away from any portion of the interior of your bolt-locked condo unit at all times. I am assuming that the current medical crisis is spawning a wide variety of forms of hysteria, fear of vampires among them. One thought on vampires, by the way, is that if they suck your blood, you can always go to the hospital and ask for a blood transfusion. Come to think of it, though, that might not be an option for you if blood bank reserves are very low these days because of COVID-19."

---"I am so literary myself that I probably won't believe this is real until I read my first published fictional short story that features a character here in Manhattan who makes a reference to COVID-19. Until I see it in print in an actual published short story, this COVID crisis is very esoteric and very abstract to me. I see all of life as primarily a literary event, with the real-life 'news' being mere background to that great fictional literary adventure."
