Subject: 10-3-20 urgent question for Candidate Joe Biden
October 3, 2020
Dear Democratic Party Presidential Candidate Joe Biden,
Do you and your Vice Presidential running mate Kamala Harris both support my own legal right to myself permanently exclude from any portion of the interior of my current solo-occupancy (myself, only) always-fully-locked rental-efficiency-apartment unit in northeast Austin any and all persons during my sleeping hours at nighttime?
I am the ONLY cited tenant and ONLY cited occupant on the current signed one-year lease for my current second-floor apartment unit in Building 17 at Pebble Creek Apartments, 8805 North Plaza Drive, in northeast Austin.
Thank you in advance for your helpful reply letter to me on this.
Best Wishes,
John Kevin McMillan, a single-by-choice, longtime-celibate (including ever since the day I moved to the northern section of Austin in August 2001), permanently drinking-alcohol-free (ever since 1990) and never-previously-addicted, lifelong illicit-drug-free in regard to any and all illicit drugs other than tobacco, lifelong tobacco-free and anti-tobacco-minded, anti-sadomasochistic, lifelong-tattoo-less and anti-tattoos-minded, permanently jewelry-less, facially-cleanshaven, platonicly polite, consistently clean-talking (no profanity by me in my everyday conversations with others), privacy-minded, anti-thought-control-projects-minded, anti-rape-minded longstanding criminal-law complainant with the Austin Police Department in APD Case 16-1340923 and numerous other crime cases. I am referring to crime cases in which I am the cited victim of alleged home-invasion-crimes and alleged personal-injury-crimes and alleged sex-crimes allegedly perpetrated against me during my sleeping hours as I lie (or lay) alone, asleep and unconscious and probably snoring, on my own bed inside my locked apartment unit in Austin, Texas---the state capital city for Texas.

Dear Open Records Coordinator for the State Auditor of Texas,
This is a Texas Open Records request in which I seek to obtain from you a copy of any and all
e-mail communications, letters, memoranda, reports, or other written communications referring at least once in any manner to myself, John Kevin McMillan of Austin, that were written or sent at any time during the multi-year period from 12:01 a.m. April 28, 2011, until 2:05 p.m. October 2, 2020, by any of the certified peace officers, regardless of their rank, who were at that time, or are each currently, employed here in Travis County in an office or division of the Texas State Auditor's Office.
One female investigator for the Texas Department of Family and Protective Services, Diana McGeehan, on November 14, 2019, made a 40-total-minute on-duty professional visit to my current Pebble Creek Apartments rental-efficiency unit in Austin in which she interviewed me for DFPS Case Number 7292-2668. During that on-duty visit to my solo-occupancy apartment unit, Investigator McGeehan stated to me that I should purchase a second infrared motion-sensitive camera and use it inside my bedroom in order to obtain additional factual evidence of alleged home-invasion-crimes perpetrators and alleged trespassing crimes perpetrators and alleged personal-injury-crimes perpetrators allegedly physically present inside my current bedroom during my sleeping hours as I lie alone on my own bed, asleep and unconscious and probably snoring, inside my always-locked efficiency apartment unit.
My legal name is John Kevin McMillan. I was born in Lincoln, Nebraska, on April 27, 1957. I am a single adult permanently-drinking-alcohol-free white non-Hispanic gentleman of English, Scottish, and German ancestry.
I have resided in Austin proper ever since mid-March 1997, during which time I have been employed by a variety of reputable employers, including the Texas Department of Public Safety state law-enforcement agency. I was employed full-time in the DPS Motor Carrier Bureau along Guadalupe Street for one year in the late 1990s.
This public-information request was prompted in part by having read recently that infliction of continuous and toxic noise pollution on targeted human rights victims has frequently occurred in cases of religious or political persecution of those individuals.
I am the founder and only approved member of a new and non-Christian, non-proselytizing religion, the anti-drinking-alcohol Progressive Prohibitionist Religion ("PPR"), that many Texans have indicated to me that they either dislike or do not regard as being a religion. My religion was incorporated by me with the Secretary of State of Texas state agency in 1996. However, I decided not to renew my incorporation of my PPR religion with the Secretary of State in Austin until I myself agree to personally approve an application for membership in my religion that I directly receive from at least one prospective new member.
This public-information request was also prompted by concerns of mine in regard to whether any individuals employed by a State of Texas-owned agency or institution have allegedly had any role of any type in alleged continuous-and-still-continuing-daily-and-year-round obscene anonymous communications, verbalized anonymous death threats, home-invasion-crimes, trespassing-crimes, anal-rape-crimes and personal-injury-crimes inflicted on me during my sleep; or in alleged continuous-and-still-continuing-daily-and-year-round sleep-harassment crimes and accompanying verbal harassment of me that have repeatedly robbed me of sleep and of revitalizing deep sleep, in particular, on a daily and year-round and multi-year basis as I lay alone or lie alone on my own bed, asleep and unconscious and probably also snoring, inside each of my locked apartment units, and inside each of the locked hotel rooms I had rented for myself only, in this state-capital city for Texas.
I myself am a lifelong non-Christian gentleman. I take pride in being law-abiding, conscientious, very civil, and honest. I am very opposed to the deliberate infliction of continuous noise pollution on anyone in a context that violates his own privacy rights. I also oppose the infliction of continuous anonymous obscene communications on anyone in a context that violates his own privacy rights. I also oppose infliction of thought-control projects on anyone.
In August of 2001 one Travis County Government official, David Ferris, Civil Probate Division Director for the Travis County Clerk's Office in Austin, volunteered an oral statement to me on the telephone during a polite local phone call I had made to his government office from inside an apartment I had just moved into in northwest Austin (this after having myself been informed in writing by most recent previous apartment manager in Austin that my UT campus-area rental-efficiency-apartment at ViewPoint Apartments along Leon Street was no longer being rented to any non-student, with the ViewPoint management team also having informed me in writing in 2001 that for that one total reason --- my not being a registered college student or graduate student--- I myself did not have the option of renewing my lease for my efficiency apartment at that ViewPoint Apartments complex):
"There appears to be an attempt by numerous persons to drive you (John Kevin McMillan of northwest Austin) out of the Austin area," Travis County official David Ferris stated to me on his own volition.
A few years ago, as I walked near one Austin gentleman at a public place in northwest Austin, I overheard him stating to a friend of this: "That guy is in Auschwitz (sic), but no one else is."
My primary personal e-mail address of "mcmillanj@att.net" and my primary personal phone number of "512-342-2295" have remained the same throughout the nine-and-one-half-year period applicable to this public-information request.
I am a former Salutatorian of Stephen F. Austin High School of Austin Independent School District in Austin, Texas. I am an alumnus of The University of Texas at Austin and The University of Minnesota Graduate School of Journalism and Mass Communications in Minneapolis, respectively.
During the nine-and-one-half-year period applicable to this public-information request, I have resided as a rent-paying official tenant or, for a brief multi-month period in 2016, a rent-paying apartment-management-team-approved occupant, at the following locations, listed chronologically from oldest address for me to most recent address:
---Wind River Crossing Apartments, 11411 Research Boulevard, Apt. 325, Austin, TX 78759;
---Crossland Economy Studios, 12621 Hymeadow Road, Apt. 133, Austin, TX 78729;
---Village Oaks Apartments, 10926 Jollyville Road, Apt. 902, Austin, TX 78759;
---Village Oaks Apartments, 10926 Jollyville Road, Apt. 1609, Austin, TX 78759;
---Austin Motor Inn, 11400 North Interstate Highway 35, a first-floor room, Austin, TX 78753; and
---Pebble Creek Apartments, 8805 North Plaza Drive, Apt. 2418, Bldg. 17, Austin, TX 78753.
The "Honor Society" Progressive Prohibitionist Religion that I founded in 1996 while residing in Denver City, Texas, is anti-marijuana, anti-medical-marijuana, anti-illicit-drugs, anti-tobacco, anti-drinking-alcohol, anti-tattoos, anti-profanity-minded, anti-facial-hair-minded, and has very stringent membership-eligibility requirements.
That one total religion of mine opposes home-invasion crimes, opposes personal-injury-crimes, opposes sexual assault crimes, opposes the sex crime of pederasty, opposes the infliction of profanity or obscene speech on anyone in a context that violates their own privacy rights, opposes anonymous communications that violate the privacy of the person being subjected to those communications, opposes fraudulent or knowingly dishonest communications, opposes thought-control projects, opposes so-called "deprogramming" projects, opposes kidnappings, opposes hostage-takings, opposes compelled speech that violates the privacy rights of the individual being subjected to that compelled speech against his wishes, and opposes deliberate infliction of continuous noise pollution on anyone in a context that harms that individual's own medical health or that is aimed at punishing him or her for having political or religious or personal beliefs---or personal prejudices, even---that are disliked or opposed by the perpetrators or sponsors of that noise pollution.
Around the turn of the century I gave several televised speeches on behalf of that religion of mine on local Community Access Television here in Austin. One younger Central Texan man even left a violent-sounding and obscene anonymous recorded phone message on my telephone-answering machine inside my apartment near UT-Austin---a recorded phone message in which he volunteered that he himself is "Catholic". In his recorded message to me, he stated that he was reacting to one or more locally televised speeches of mine that I had given on behalf of my PPR religion.
Around the turn of the century, one former Austin-area resident, Dr. Michael Kim McMillan, declared to me in person with indignation and revulsion in his tone of voice and facial expression in a conversation I had with him outdoors near UT-Austin's campus that occurred during a brief visit of his to the Austin area from out of state: "The 'Heaven on Earth' religion you've (John Kevin McMillan of Austin) established has inflicted Hell on this entire planet!"
Thank you in advance for your reply letter to me in response to this public-information request from myself. I hope to hear from you soon.
Sincerely and Best Wishes,
John Kevin McMillan, public-information requestor.

My primary personal e-mail address of "mcmillanj@att.net" and my primary personal phone number of "512-342-2295" have remained the same throughout the five-and-three-fourths-year period applicable to this public-information request.
I am a former Salutatorian of Stephen F. Austin High School of Austin Independent School District in Austin, Texas. I am an alumnus of The University of Texas at Austin and The University of Minnesota Graduate School of Journalism and Mass Communications in Minneapolis, respectively.
During the five-and-three-fourths-year period applicable to this public-information request, I have resided as a rent-paying official tenant or, for a brief multi-month period in 2016, a rent-paying apartment-management-team-approved occupant, at the following locations, listed chronologically from oldest address for me to most recent address:
---Wind River Crossing Apartments, 11411 Research Boulevard, Apt. 325, Austin, TX 78759;
---Crossland Economy Studios, 12621 Hymeadow Road, Apt. 133, Austin, TX 78729;
---Village Oaks Apartments, 10926 Jollyville Road, Apt. 902, Austin, TX 78759;
---Village Oaks Apartments, 10926 Jollyville Road, Apt. 1609, Austin, TX 78759;

Dear Open Records Coordinator for the Governor of Texas,
This is a Texas Open Records request in which I seek to obtain from you a copy of any and all
e-mail communications, reports, directives, memoranda, or other written communications referring at least once in any manner to myself, John Kevin McMillan of Austin, that any of the certified peace officers employed in Travis County by any division or unit of your state agency, either wrote or sent to anyone, or received from Texas Governor Greg Abbott or any other person, at any time during the multi-year period from noon January 20, 2015, through 8 a.m. Friday, October 2, 2020.
This public-information request was prompted in part by the following statement I read today at your state agency's official website:
"The Governor’s Public Safety Office is composed of the Criminal Justice Division, Homeland Security Grants Division(,) and Child Sex Trafficking Team(.) (Those three units) administer more than $375 million in federal and state grant funding to promote strategies that improve public safety, support victims of crime, prevent terrorism, and prepare communities for the threats and hazards that pose the greatest risk to Texans."
My primary personal e-mail address of "mcmillanj@att.net" and my primary personal phone number of "512-342-2295" have remained the same throughout the five-and-two-third-year period applicable to this public-information request.
During the five-and-two-third-year period applicable to this public-information request, I have resided as a rent-paying official tenant or, for a brief multi-month period in 2016, a rent-paying apartment-management-team-approved occupant, at the following locations, listed chronologically from oldest address for me to most recent address:
---Wind River Crossing Apartments, 11411 Research Boulevard, Apt. 325, Austin, TX 78759;
---Crossland Economy Studios, 12621 Hymeadow Road, Apt. 133, Austin, TX 78729;

Numerous current or former Central Texas residents have stated to me over a multi-year period that they either dislike or intensely dislike or question the authenticity of my own fully-independent "Progressive Prohibitionist Religion" (PPR). Around the turn of the century I gave several televised speeches on behalf of that religion of mine on local Community Access Television in Austin. Subject: Re: OAG Complaint Form Confirmation
October 1, 2020
Dear Office of the Attorney General of Texas state agency Open Records Division Officials in
Austin,
Austin,
Thank you for your confirmation message (final item, below) to me late this Wednesday night, September 30, that your State of Texas agency has received my online public-information-request complaint against the Office of General Counsel of the Texas Department of Public Safety state law-enforcement agency state headquarters offices in north Austin.
Below, please find the text of my politely-worded written appeal to Texas DPS Director Steven McCraw. My appeal relates to the alleged failure of the DPS Office of General Counsel to send me a reply letter of any type in response to my August 13, 2020, public-information request (below) to the DPS.
DPS Director McCraw chose not to send me any written response to my appeal through his state agency.
Incidentally, I am e-mailing you the full exact text of my August 13 public-information request because I had difficulty attempting to download my public-information request and accompanying appeal to DPS Director McCraw.
Please let me know if this e-mailed documentation from me is not adequate on behalf of finalizing and making complete my official online complaint I had submitted to your state agency at about 11:53 p.m. this Wednesday night, September 30, 2020.
Best Wishes,
PIR complainant John Kevin McMillan.

Dear Texas DPS Director and Colonel McCraw,
Congratulations on your 11-year tenure thus far as statewide Director of the Texas Department of Public Safety, and on your prior very impressive law-enforcement career as a special agent for the Federal Bureau of Investigation.
I would be very grateful to you if you would please ask your state agency's Open Records Coordinator in the DPS Office of General Counsel to promptly send me a written response to my August 13, 2020, public-information request (below)----a request that I had e-mailed that same day to your correct official DPS Open Records e-mail address of "ogc.webmaster@dps.texas.gov".
So far, I apparently have not received any reply note of any type in response to my August 13, 2020, public-information request to your state agency headquarters here in north Austin.
Thank you in advance, DPS Director and Colonel McCraw, for your invaluable assistance on this.
Best Wishes,
John Kevin McMillan, a former full-time staff member for the Texas DPS Motor Carrier Bureau along Guadalupe Street here in north Austin.
My solo-occupancy efficiency-rental-apartment home address ever since June 21, 2019, a matter of blocks northeast of your DPS headquarters compound:

Dear Open Records Coordinator for the Texas Department of Public Safety,
This is a Texas Open Records request in which I seek to obtain from your state-government law-enforcement agency in Austin a copy of any and all e-mail communications or reports referring to myself, John Kevin McMillan of Austin, at least once in any manner, and that were written, e-mailed, sent, mailed, received, or FAXed at any time since 12:01 a.m. April 28, 2011, by any certified peace officer or law-enforcement officer or administrator based at the Texas DPS Capitol Complex, Capitol Region Headquarters, with your Regional Director who directly supervises your Capitol Region Headquarters being one such applicable DPS administrative official.
INCLUDED in the scope of this request are any and all e-mail communications or reports that your Capitol Region Headquarters Regional Director wrote, sent, or received during the applicable multi-year time period to his immediate supervisor, the Deputy Director of Law Enforcement Operations for the Department of Public Safety.
My legal name is John Kevin McMillan. I was born on April 27, 1957.
I have resided in Austin proper ever since mid-March 1997, during which time I have been employed by a variety of reputable employers, including the Texas Department of Public Safety state law-enforcement agency. I was employed full-time in your DPS Motor Carrier Bureau along Guadalupe Street for one year in the late 1990s.
My primary personal e-mail address of "mcmillanj@att.net" and my primary personal phone number of "512-342-2295" have remained the same throughout the entire nine-year period applicable to this public-information request.
I am a former Salutatorian of Stephen F. Austin High School of Austin Independent School District in Austin, Texas. I am an alumnus of The University of Texas at Austin and The University of Minnesota Graduate School of Journalism and Mass Communications in Minneapolis, respectively.
During the nine-and-one-third-year period applicable to this public-information request, I have resided at the following locations, listed chronologically from oldest address for me to most recent address:
---Wind River Crossing Apartments, 11411 Research Boulevard, Apt. 325, Austin, TX 78759;
---Crossland Economy Studios, 12621 Hymeadow Road, Apt. 133, Austin, TX 78729;
---Village Oaks Apartments, 10926 Jollyville Road, Apt. 902, Austin, TX 78759;
---Village Oaks Apartments, 10926 Jollyville Road, Apt. 1609, Austin, TX 78759;
---Austin Motor Inn, 11400 North Interstate Highway 35, a first-floor room, Austin, TX 78753; and
---Pebble Creek Apartments, 8805 North Plaza Drive, Apt. 2418, Bldg. 17, Austin, TX 78753.
I am the founder and only approved current member of a new and non-Christian non-proselytizing "Honor Society" religion, the anti-marijuana, anti-medical-marijuana, anti-illicit-drugs, anti-tobacco, anti-drinking-alcohol, anti-tattoos, anti-profanity-minded, anti-facial-hair-minded "Progressive Prohibitionist Religion", that has very stringent membership-eligibility requirements.
One younger Central Texan man left a violent-sounding and obscene anonymous recorded phone message on my telephone-answering machine inside my apartment near UT-Austin---a recorded phone message in which he volunteered that he himself is "Catholic". In his recorded message to me, he stated that he was reacting to one or more locally televised speeches of mine that I gave on behalf of my PPR religion.
