Dear Open Records Coordinator for the Travis County Attorney's Office here in Austin,
I am seeking a copy of letters to the Attorney General of Texas that your County Attorney's Office in Austin has written and submitted anytime since 9 a.m. January 1, 2003, on behalf of County Commissioner Gerald Daugherty.
The scope of this request is exclusively limited to any and all letters fitting the above description that specifically requested permission to withhold one or more documents from a member of the general public which referred to Commissioner Daugherty having consulted an attorney.
Gerald Daugherty, a distinguished member of the Republican Party, has served as Travis County Precinct 3 County Commissioner, an elective office, for a total of nearly 12 years: from January 2003 until January 2009, and, more recently, from January 2013 through the present.
Mr. Daugherty is the only current member of the
Travis County Commissioners Court who is a Republican.
My legal name is John Kevin McMillan, and I reside in Commissioner Daugherty's district---District 3.
I myself am classified as a private citizen, according to what State Bar of Texas member private attorneys I've consulted have very helpfully informed me in recent decades.
I myself do not have any criminal-conviction record, and I am gainfully employed and permanently drinking-alcohol-free.
Included in the scope of this public-information request is a September 14, 2018, signed legal letter from Travis County Assistant County Attorney Ann-Marie Sheely that referred to Commissioner Daugherty and myself.
That letter requested formal permission from the Attorney General of Texas for Commissioner Daugherty to withhold from myself, John Kevin McMillan of Austin, several or more documents that referred to Commissioner Daugherty having repeatedly sought legal advice from an attorney in regard to myself.
I have maintained the same e-mail address ("mcmillanj@att.net") and personal phone number ("512-342-2295") for many years, including at present.
During the multi-year time period applicable to this public information request, I myself resided as an official rent-paying tenant or official rent-paying occupant at each of the following respective apartment units or hotel rooms:
---Wind River Crossing Apartments, 11411 Research Boulevard, Building 3, Apt. 325, Austin, Texas, 78759. I resided in that particular apartment unit from January 2002 until July 29, 2015, when my lease to reside there as an official rent-paying tenant expired. The Wind River Crossing apartment management team had given prior notice earlier in 2015 that it had chosen not to renew that lease for me and my one total official roommate at that time.
---Crossland Economy Studios, 12621 Hymeadow, Apt. 133, Austin, Texas, 78729. I officially resided as a rent-paying tenant at this particular Extended Stay America hotel and efficiency apartments facility in Williamson County, Texas (a facility situated in far northwest Austin, with the Austin Police Department having law-enforcement jurisdiction at that location), from July 29, 2015, until late September 2015.
---Village Oaks Apartments, 10926 Jollyville Road, Building 9, Apt. 902, Austin, Texas, 78759, from late September 2015 until early September 2017.
---Village Oaks Apartments, 10926 Jollyville Road, Building 16, Apartment 1609, Austin, Texas, 78759, ever since early September 2017, including at present.
Thank you in advance for your prompt and authoritative reply letter providing me with any and all responsive legal documents.
Sincerely and Best Wishes,
John Kevin McMillan.
