MY FOLLOW-UP LETTER OF APPEAL THROUGH THE AUSTIN POLICE DEPARTMENT CHAIN OF COMMAND THAT I WROTE AND SENT TODAY TO APD LT. PATRICIA CRUZ

 I am very hopeful that this politely-worded letter of appeal I wrote and e-mailed today to Lt. Patricia Cruz of the Austin Police Department will help me to get a forensic DNA-traces anal-rape-evidence medical exam on myself that I have been unsuccessfully requesting ever since early 2012 on more than 20 separate occasions from APD, local hospital emergency room physicians, and the Austin Safe Alliance that staffs and dispatches forensic sexual-assault-evidence medical nurses, respectively:

Patricia Cruz, Thank you for taking the time to diligently review my letter of appeal to you on the apparent decision by a high-ranking APD officer whom you directly supervise, head supervisor Sgt. Christopher Keen of the APD Sex Crimes Unit, and an APD officer whom Sgt. Keen supervises, Detective William Costello of that same APD unit, not to authorize any DNA-trace swabs forensic sexual-assault-evidence medical exam on myself at any time so far in 2021. As you know, I have requested an anal-rape-evidence exam on myself on about 20 separate occasions since early 2012, and each of my requests have been either directly denied by the APD Sex Crimes Unit or denied by an APD-assigned "liaison officer" for myself who indicated to me that he spoke for the APD Sex Crimes Unit in that specific context. Lt. Cruz, I am also requesting at this time that you please re-classify APD Case 21-083533, an alleged home-invasion-crimes and alleged-sex-crimes case that APD generated for me on March 24, 2021 (this when I was a patient seeking a rape-evidence medical exam on me inside the St. David's Medical Center hospital ER and was interviewed in my patient room by APD Officer Mark Bozyk), as a CONTINUOUS CRIMES case. I maintain that the alleged home-invasion-crimes and sex crimes victimizing me during my sleeping hours as I lie alone, unconscious and possibly snoring, on my own bed, are allegedly continuing to occur on a daily and year-round basis, including during my sleeping hours early this morning inside my current second-floor solo-occupancy efficiency-apartment unit on the second floor of the multi-unit Building 17 at Pebble Creek Apartments, 8805 North Plaza Drive, in northeast Austin. I have lived alone inside my current unit on a continuous basis ever since the early afternoon of June 21, 2019. There is a massive attic situated above the ceiling of all or nearly all of the second-floor units in Building 17 here at Pebble Creek, and a ceiling door in my own walk-in closet abutting my bedroom opens to that attic, according to an in-person statement to me inside my unit by on-duty home-security-services professional Andrew Tijerina. Andrew Tijerina is the first-rate and very helpful Service Manager for Fortress Lock, Safe, & Security, a private business that is A-plus-rated by the Better Business Bureau and is fully accredited with the Better Business Bureau. Mr. Tijerina's office phone number is: 512-800-3030. Mr. Tijerina stated to me that he is willing to be interviewed by APD about his findings from his thorough home-security-related inspection of my unit that occurred at my prior request on the morning of October 1, 2020. Attached, please find several infrared motion-sensitive-surveillance-camera-generated crime-evidence photos obtained for me this morning or late last night during my sleeping hours at nighttime. I maintain that each of the photos show someone other than me. I am six-feet tall and of medium build. My thighs and arms and upper chest and abdomen and legs, respectively, are neither massive in size nor significantly muscular. I am not morbidly obese. I am relatively slender in much of my body, and I weighed 206.6 pounds this morning on my recently-purchased new bathroom scale. I do NOT have any tattoo on any of my hands or anywhere else on my body I do NOT wear any glove on any of my hands while I am sleeping. My fingers are not thin and very long. My eyes are not narrow in shape. I am age 64. I am a lifelong abstainer from tobacco products and a complete abstainer from drinking alcohol ever since 1990, with those two abstention practices of mine have a bearing on the complexion and appearance of my face. I do NOT have any mustache on my face. My nostrils do not flare. I do not have a pug nose, and my nose is not bulbous in shape. My own nose does not protrude outward horizontally and is not tubular in shape. My ears are not giant and floppy. My own facial expressions do not appear to snarl with malice toward others. My own current facial hair color is dark brown throughout: I had my hair permanently dyed dark brown for my entire head in the last few weeks by a female Vietnamese-born hair stylist inside a Super Cuts chain hairstyling salon location along Burnet Road at Allendale shopping center in north Austin. My own head is not flattened or narrow in shape or width. I myself am of exclusively English, Scottish, and German ancestry. I am Anglo-Saxon. I am not Hispanic or Jewish or American Indian in ancestry. I am not of Central Asian or Far East Asian or Asian ancestry. I am a lifelong American citizen. I always sleep alone on my own bed, and I have been completely celibate throughout any and all of my own conscious or waking hours ever since and including the day I moved to north Austin in August 2001. Ever since I moved into my current apartment unit at Pebble Creek Apartments on June 21, 2019, I have never had ANY invited overnight guest or ANY invited late-night guest anywhere inside this efficiency rental-housing unit. The ONLY persons I have ever permitted to enter my current apartment unit after 8 p.m. at nighttime or before 8 a.m. in the daytime have been a variety of on-duty APD officers over a multi-month period who accepted crime evidence flashdrives from me or a lost-and-found item from me that I had discovered outdoors on public property in Austin; and, in one total other case that occurred at any time since I moved into my current unit, on-duty Austin-Travis County EMS staff members responding to a 911 phone call in which I had requested that an ambulance transport me to the emergency room of a local hospital after I had vomited repeatedly inside my unit with other alarming medical symptoms as well. I have undergone doctor-ordered medical surgeries on myself in local hospitals (St. David's North Austin Medical Center, Heart Hospital of Austin along West 38th Street, and Seton Medical Center in central Austin) for potentially life-threatening medical problems I incurred in north Austin on three separate total occasions during the two-year period ever since I moved into my current unit. My very first-rate officially "Super Doctor"-designated medical surgeons in those three separate surgeries were Dr. Mark Lindsey, Dr. Scott Seidel, and Dr. John Politz, respectively. Lt. Cruz, I remain very hopeful that you will send me a reply letter in response to the multi-document written appeal, including this letter to you, that I have respectfully submitted to yourself by e-mail. I am courtesy-carbon-copying this e-mail letter to the three total public officials I can currently recall--- including my polite Travis County Democratic Party Precinct 139 Chair, Saundra Ragona, who lives in my district of Austin---who each very courageously sent me a reply e-mail letter in 2020 which stated that they support safe housing conditions for me inside my current apartment unit at Pebble Creek Apartments, Apartment 2418, in northeast Austin. The other two of those three public officials offering me that type of courageous support for safe housing conditions for me in which NO ONE but me is present inside my bolt-locked apartment unit during my sleeping hours at nighttime, are then-State Senator Kirk Watson, during the period of 2020 when he represented my senatorial district in the Texas Senate of the Texas Legislature governing body; and then-Travis County Judge Sarah Eckhardt, as well as current State Senator Sarah Eckhardt, through a female intern for Senator Eckhardt, Ashley. Ashley stated to me at about 4 p.m. June 14, 2021, during a phone call I made to Sen. Eckhardt's district office in Austin on my cell phone, that Sarah Eckhardt in her current capacity as my duly-elected State Senator continues to support safe housing conditions for me inside my current apartment unit. I have always lived alone inside my current apartment unit at Pebble Creek Apartments ever since I moved into this unit on June 21, 2019. My official new lease for my current unit, which this time is for a six-month period at my request, begins one minute before 12:01 a.m. on July 1, 2021. I am also the only tenant and only occupant cited in that official management-team-approved signed new lease agreement. Ashley offered me her much-appreciated "safe-housing-support" assurance on the telephone in the same phone conversation in which Ashley stated to me that my Constituent Services Director for Senator Eckhardt, Keysha Walcott, will determine whether she will be willing to contact the APD Sex Crimes Unit on my behalf and request that that APD unit authorize a new rape-evidence exam on me and also obtain full 190-day retroactive DNA-traces processing of the two rape-evidence kits from me that APD already has, and has in fact had in its possession over an approximately 10-year period. Those two separate rape-evidence kits from 2011 were for APD Case 11-1180447 and APD Case 11-3550615, respectively. I have not yet heard from Constituent Services Director Walcott on whether she is willing to call the APD Sex Crimes Unit for me and make those requests on my behalf. In the entire time I have resided in my current rental-housing unit, I have NEVER permitted any current or former neighbor of mine or any other tenant or occupant anywhere at Pebble Creek Apartments or any current or former friend or current or former social acquaintance or any former classmate of mine or former teacher of mine or any representative for a religious group or political group or media company or any current or former relative of mine or any former roommate of mine or any former housemate of mine or any current or former coworker of mine to enter my current unit at any time of the day or night on any occasion after I got moved into my current unit in the afternoon of June 21, 2019. I am a permanently-drinking-alcohol-free (ever since the late summer of 1990) and never-previously-addicted to alcohol, gainfully employed (I work in three different corporate-owned chain restaurants in Austin, two of which are owned by two separate restaurant-industry corporations that are each headquartered in the great state of Florida), longtime celibate-by-choice, single-by-choice, dependably civil and law-abiding and polite, white Anglo-Saxon gentleman of English, Scottish, and German ancestry. I have not consumed any marijuana on any occasion since the late fall of 1984. I am neither a current nor a former marijuana addict, and I have NEVER at any time consumed any illicit drug other than marijuana on any occasion in my entire life. Lt.
