My Gratitude Today to the Attorney General of Texas:

I am very grateful to the Attorney General of Texas for having very helpfully confirmed for me today that their state agency has directly contacted Travis County Assistant County Attorney Entsminger in Austin and informed him in writing that Travis County Government is legally required to release to me recent legal documents authored by a source other than me that refer to me as being a victim of a felony crime.

My still-unanswered November 30, 2023, e-mail Open Records Request to the Travis County District Attorney's Office in Austin had sought "a copy of any and all documents on file with each applicable division or unit of your DA's Office that were each authored by someone other than me at any time since 9 a.m. January 1, 2021, and which each stated that I myself was or am victimized by a felony crime."

Dear Very Honorable Government Officials, Law-Enforcement Officers, Criminologists, and Civic Leaders,

I was informed in writing yesterday about yet another legal ruling from the Attorney General of Texas

that relates to my still-unanswered November 30, 2023, public information request to the Austin-based Travis County District Attorney's Office.

That November 30 request from me had sought "'a copy of any and all documents on file with each applicable division or unit of your DA's Office that were each authored by someone other than me at any time since 9 a.m. January 1, 2021, and which each stated that I myself was or am victimized by a felony crime."

Texas Assistant Attorney General James Graham also this month issued a ruling legal letter I received which stated that the Travis County District Attorney's Office is legally required to release to me, John Kevin McMillan of Salt Lake City, Utah, several or numerous legal documents that are responsive to my November 30, 2023, Open Records Request to that DA's Office in Austin.

As of...April 29, 2024, neither the Travis County District Attorney's Office nor any official of the Travis County Attorney's Office in Austin has sent or mailed to me any legal document directly and specifically responsive to my November 30, 2023, Open Records Request to the Travis County DA.

The legal ruling letter from the Texas Attorney General's Office that I received yesterday was sent to me as an attachment to the following cover e-mail letter to me from Texas Assistant Attorney General June Harden:

Dear Ms. Harden:

You ask whether certain information is subject to required public disclosure under the Public Information Act, chapter 552 of the Government Code. Your request was originally received by the Open Records Division of this office and assigned ID# OR-24-009013-RR (OAG PIR No. R021160).

Preparation of this ruling has been assigned to the General Counsel Division of this office. The Office of the Attorney General (the “OAG”) received a request for information relating to a complaint filed with the OAG’s Open Records Division.

You state the OAG will release some of the requested information with redactions allowed by law. You claim the submitted information is excepted from disclosure under section 552.111 of the Government Code. We have considered the exception you claim and reviewed the submitted information. Section 552.111 of the Government Code excepts from disclosure “[a]n interagency or intra(-)agency memorandum or letter that would not be available by law to a party in litigation with the agency[.]” Gov’t Code § 552.111. This exception encompasses the deliberative process privilege. See Open Records Decision No. 615 at 2 (1993). The purpose of section 552.111 is to protect advice, opinion, and recommendation in the decisional process and to encourage open and frank discussion in the deliberative process. See Austin v. City of San Antonio, 630 S.W.2d 391, 394 (Tex. App.—San Antonio 1982, writ ref’d n.r.e.); Open Records Decision No. 538 at 1-2 (1990). In Open Records Decision No. 615, this office re-examined the statutory predecessor to section 552.111 in light of the decision in Texas Department of Public Safety v. Gilbreath, 842 S.W.2d 408 (Tex. App.—Austin 1992, no writ).

We determined section 552.111 excepts from disclosure only those internal communications that consist of advice, recommendations, opinions, and other material reflecting the policymaking processes of the governmental body. See ORD 615 at 5. A governmental body’s policymaking functions do not encompass routine internal administrative or personnel matters, and disclosure of information about such matters will not inhibit free discussion of policy issues among agency personnel. Id.; see also City of Garland v. Dallas Morning News, 22 S.W.3d 351 (Tex. 2000) (section 552.111 not applicable to personnel-related communications that did not involve policymaking). A governmental body’s policymaking functions do include administrative and personnel matters of broad scope that affect the governmental body’s policy mission. See Open Records Decision No. 631 at 3 (1995). Further, section 552.111 does not protect facts and written observations of facts and events that are severable from advice, opinions, and recommendations. Arlington Indep. Sch. Dist. v. Tex. Attorney Gen., 37 S.W.3d 152 (Tex. App.—Austin 2001, no pet.); see ORD 615 at 5. But if factual information is so inextricably intertwined with material involving advice, opinion, or recommendation as to make severance of the factual data impractical, the factual information also may be withheld under section 552.111. See Open Records Decision No. 313 at 3 (1982).

This office has also concluded a preliminary draft of a document that is intended for public release in its final form necessarily represents the drafter’s advice, opinion, and recommendation with regard to the form and content of the final document, so as to be excepted from disclosure under section 552.111. See Open Records Decision No. 559 at 2 (1990) (applying statutory predecessor). Section 552.111 protects factual information in the draft that also will be included in the final version of the document. See id. at 2-3. Thus, section 552.111 encompasses the entire contents, including comments, underlining, deletions, and proofreading marks, of a preliminary draft of a policymaking document that will be released to the public in its final form. See id. at 2.

You state the submitted information consists of “a draft enforcement letter that has been released to the public in final form.” You also explain that the draft was made “in furtherance of the OAG’s policy of maintaining uniformity in application, operation, and interpretation of the PIA.”

Based on your representations and our review, we find the OAG may withhold the submitted information under section 552.111 of the Government Code.

This letter ruling is limited to the particular information at issue in this request and limited to the facts as presented to us; therefore, this ruling must not be relied upon as a previous determination regarding any other information or any other circumstances.

This ruling triggers important deadlines regarding the rights and responsibilities of the governmental body and of the requestor.

I apologize for having forgotten to send you a copy of this peace-officer-safety-related public-policy letter (below) about a very crucial theme for Utah that I wrote and sent out yesterday.

The greater the number of certified peace officers in Utah whose bulletproof vests are fully effective and meet all State of Utah standards, the lower the injury rate and fatal-injury rate to on-duty government law- enforcement officers throughout our state.

Below is an online link to a related 2014-dated news story from KSL.com.

I have not been able to find an online update news report in regard to the current percentage of all bulletproof vests being worn in 2024 by on-duty peace officers that are damaged or substandard or being used by on-duty officers beyond those vests' expiration date.

Do you know which State of Utah agency maintains records on applications for federal funding that have been submitted on behalf of respective police departments, sheriff's offices, or state agencies in Utah when they seek to purchase new bulletproof vests for their respective local or state law-enforcement officers?

Is that state agency your Utah Department of Public Safety, the Attorney General of Utah, the Governor of Utah, the Utah Labor Commission, the Utah Legislature, the State Comptroller of Utah, or some other state agency of Utah?

Also, has the applicable State of Utah coordinating agency this year contacted each of the applicable local and state-government agencies of Utah and informed them in writing that the U.S. Government in April 2024 began accepting applications (see further below for more details) for new grants toward purchase of new bulletproof vests for peace officers here in Utah?

Sgt. Roden, I am also attempting to verify that each of the local or state law-enforcement agencies of Utah that in 2024 or 2023 identified a need for one or more new bulletproof vests for their own law-enforcement agency's officers did apply to the U.S. Justice Department for defrayment of up to one-half of the vest-purchase expense incurred by the applicable city or county or state agency.

I am concerned about the possibility that some city governments or county governments or state agencies of Utah in calendar year 2023 or 2024 may have failed to get official approval from the U.S. Justice Department for federal funding to defray up to one-half of the financial expenses incurred by that local or state government agency on purchase of new bulletproof vests for their certified peace officers.

Subject: Help Make UT Attractive for Law-Abiding Non-Addicts

Dear Very Influential State Government Officials of Utah,

This is a very tentative Brainstorming Letter that I would like to offer to each of you government officials in our state. I officially became a permanent new resident of Utah on January 1, 2023, and my own factual knowledge of our often-great state is limited by time comstraints during my leisuretime. I work six days per week in first-rate restaurants.

I'm sure many of you are painfully aware of possible attempts by financial investors in U.S states such as Nevada to turn Utah into a Southwestern Hub for Hedonism and Depravity.

This suggests to me the urgent need for a State of Utah-funded new study that explores whether Utah is currently at risk of being "Nevadified". Nevada, as you know, in the past was regarded as being "the opposite of what Utah is all about".

Among the apparent "activities" and "goals" of those possible Nevada-based investors and their associates that threaten to "Nevadify" Utah are:

----Lobbying for a dangerous revision of Utah state Constitution that would permit establishment of one or more Gambling Casinos in Utah. This would dramatically increase the percentage and number of all Utahns and tourists in Utah who develop an addiction to gambling. The scenario of Gambling Casinos in Utah might also bring an influx of organized-crime members and organized-crime activities into our traditionally low-crime-rate state.

----Lobbying for legalization of the sale of liquor and wine in for-profit supermarkets and convenience stores in Utah. This would significantly increase the incidence of binge drinking, underage drinking, motorists driving under the influence of alcohol, traffic accidents on roadways, and the number of Utahns and visitors to Utah who develop an addiction to alcohol.

--Promotion of a rapid expansion of beer breweries in Utah that waste a significant amount of water---water being a scarce resource in our state----also increases the risk of Utahns developing a beer addiction while attempting to "show pride in locally produced beer from Utah ".

----Lobbying for legalization of marijuana for any and all adult Utahns. This would be very disastrous for our entire state, triggering an increase in drug addiction and in lung cancer and an increase motor-vehicle collisions rate from motorists driving under the influence of marijuana.

---Promotion of increased tobacco sales and vaping product sales and an increase in the number of vaping parlors throughout Utah. This causes widespread medical crises, including increased cancer rates, throughout our state.

----Establishment in Utah of one or more "gay bathhouse" commercially operated "Sex Parlors" comparable to business establishments catering to homosexual and bisexual male clientele that are reportedly numerous in Las Vegas, Nevada, according to what I read online today during factual research I pursued.

Any such "gay bathhouse" in Utah would be very disastrous for our entire Beehive State. Not only would the indiscriminate and promiscuous sexual activity in each such "bathhouse" spread sexually transmitted diseases--- including the often-fatal HIV Virus ---- at an alarming rate. The proposed new "gay bathhouse" in Utah would also spawn addiction to a very superficial and genitalia-fixated or buttocks-fixated "evaluation" of other human beings, accompanied by a sexaholic or sexually obsessed contempt for mutual-consent platonic personal relationships. And the establishment of one or more "gay bathhouses" in Utah would also cause consumption and wasteage of an unconscionable amount of water from the frequent showers and baths being pursued incessantly on a 24-hour-a-day year-round basis inside those "gay bathhouses." Utah is reportedly the second-driest or third-driest state in the entire nation.

----Destruction of wholesome Mormon values such as abstinence from alcohol, tobacco products, illicit drugs, tattoos, and gambling. The massive expansion of the tattoo-parlor industry in Utah is highlighted by numerous "tattoo festivals" that are currently being advertised perversely as "major cultural events" here in Salt Lake City, Utah.

The incidence of tattoo-addiction in Utah has apparently increased dramatically in recent years, so much so that we are now at risk of "following the lead of Tattoo-Addicted Nevada" for the percentage of residents in our state who are obsessed with covering their entire body with tattoos and who risk going bankrupt because of their tattoo addiction.

Tattoos can also be very harmful to the dermatological health of Utahns, and our state is already among the U.S. states with the highest per-capita incidence of skin cancer.

----The false equation of increased racial and ethnic diversity in Utah with societal "progress", with the traditionally wholesome clean-talking non-profane Anglo-Saxon Northern European heritage and culture of Utah being harmed significantly by the shocking anti-white bias evidenced by repressively black-dominated poorly vocalized background "music systems" and loud, crude, vulgar, black-music-dominated "cultural events" featuring very weak lyrics and trashy vocalization here in Salt Lake City. The accompanying contempt toward elegance in vocalization and contempt toward the sublimely idealistic wholesome popular songs that are sung by well-educated white professional singers conveys a very alarming allegedly illegal employment discrimination against honorable law-abiding Anglo Saxons----a societal discrimination that has made a mockery of our entire state.

----The alarming absence of any strong MONORACIAL DATING rights movement in Salt Lake City that protects the legal right and human right of white non-Hispanic single adult Utahns such as myself to exclusively limit their own (or my own, in the case of my own personal social life dating partner options might ever agree to ) dating partner options to other white non-Hispanic adult persons their own age or younger.

In my own life, I have a lot more in common with and feel much calmer and enjoy interacting (with) other honest and law-abiding Anglo-Saxons, as distinct from... any other ethnic or racial group.

Many of the inter-racial "romantic" relationships or "inter-racial marriages" here in Utah raise the question of whether the white non-Hispanic "partner" in that so-called "relationship" was allegedly stalked, allegedly sexually harassed, allegedly sexually assaulted, allegedly kidnapped, allegedly held hostage, or allegedly significantly abused by the black "partner" in that very injurious inter-racial involvement.

I especially appreciated this April 18 written statement of yours to me:

Your April 18 legal letter to me was in regard to my December 2023 Open Records Complaint to the Attorney General of Texas.

My legal complaint alleged that the Open Records Coordinator for the Travis County District Attorney's Office in Austin allegedly failed to provide me with any written document responsive to my narrowly focused November 30, 2023, Open Records Request to that DA's Office.

(On December 28, 2023, your Attorney General of Texas Open Records Division assigned to that Open Records complaint from me the official identification number of OR-23-103287-IC.)

My November 30, 2023, public information request to the DA's Office in Austin had sought "'a copy of any and all documents on file with each applicable division or unit of your DA's Office that were each authored by someone other than me at any time since 9 a.m. January 1, 2021, and which each stated that I myself was or am victimized by a felony crime."

As of 9:55 p.m. Mountain Time tonight, Tuesday, April 23, 2024, I myself still have not received any legal document from the Travis County DA's Office Open Records Coordinator -----or from the Travis County Attorney's Office acting on behalf of Travis County DA Jose Garza's Open Records Coordinator ---that was directly and specifically responsive to my November 30, 2023, Open Records Request to their county government agency in Austin.

Texas Assistant Attorney General Graham, I would appreciate receiving a follow-up letter from you in regard to whether your Open Records Division in Austin is able to obtain for me and directly send to me---- or have sent to me by the DA's Office or County Attorney's Office in Austin--- a copy of each of the specific legal documents responsive to my November 30, 2023, request that you have specifically ordered the Travis County DA's Office to release to me.

The legal letter was in regard to my recent Open Records Complaint to the Attorney General of Texas that the Open Records Coordinator for the Travis County District Attorney's Office, Susie Duttinger, has allegedly failed to provide me with any written document directly responsive to my November 30, 2023, Open Records Request to the DA's Office in Austin.

Dear Utah Department of Child Protective Services state agency Officials, Utah State Board of Education Substance Use Prevention Officials, University of Utah Health Medical Services Provider Adult Alcohol- Addiction Treatment Specialists, Utah Adult Protective Services state agency Officials, Utah Consumer Protection Division state agency officials, and Utah Attorney General Sean Reyes,

The wide variety of new "non-alcoholic" and "low in alcohol content" beverages (see online link above) apparently being marketed in retail stores in Utah these days are causing lots of anxiety and confusion for children and other minors under age 21, Mormons and other non-drinking religious groups, pregnant women, and current or former or recovering alcoholics here in the Beehive State, respectively.

At present, Utah State Law specifically permits supermarkets and convenience stores in our state to sell bottled or canned beer that is 5 percent alcohol by volume (ABV) or less.

I am writing to each of you Very Honorable Government Officials today to ask whether any of you believe it would be much simpler and safer for the above-cited Utahns if any and all supermarkets and convenience stores here in Utah were legally prohibited by the Utah Legislature from selling inside their store ANY canned beverage or ANY bottled beverage---regardless of whether the canned or bottled beverage is labeled as a "seltzer"----that contains any quantity of alcohol.

Under this proposed revision of state law, the only retail or wholesale stores in Utah that could sell bottled or canned beverages containing any quantity of alcohol would be the State of Utah-owned State Liquor stores.

I would also like to raise the question of whether the current sale of "non-alcoholic beer" inside retail or wholesale stores in Utah could possibly increase the risk of minors and adult recovering alcoholics in our state developing an intense curiosity to try drinking or a craving for, respectively ---- or an incipient or relapse psychological addiction to ---- "real beer" that contains actual alcohol.

I hope this brainstorming letter is helpful to each of you State Government of Utah officials.

I would welcome a reply letter from any of you on any aspect of this letter.

The annual Red Bull Rampage Mountain Biking Event in Virgin, Utah, is a source of considerable infamy for our entire state.

That ultra-competitive event features a repeatedly suicidal flirtation with death by each of the competing bikers from around the world and promulgates the message to the entire world that Utah is Very Proud to be the Official Host State for Numerous Near-Death or Possibly Fatal Experiences for Bikers.

"Men's Health" magazine in January 2022 featured a copyrighted story by Scarlett Wrench that bore the title: "Welcome to the World's Most Dangerous Mountain Biking Competition".

Some key statements in that report:

----"Riders are judged on a number of criteria, including airtime and tricks, as well as more virtuoso factors such as fluidity and style. To put it bluntly, they are rewarded for taking risks: riders score points for their willingness to tread the narrow line between victory and injury."

----"...Californian rider Cam McCaul explains a 'blind take-off': ....(T)he first time the rider catches sight of the landing, it's too late to adjust speed or trajectory.

'Two miles per hour too fast and the rider will land halfway down and explode upon impact,' says McCaul, matter of factly. '[Going] two miles per hour too slow will put the rider before the landing – and cause them to get catapulted off the bike.'”

----"In 2015, a rider named Paul Basagoitia from Nevada crashed on a step-down and shattered his vertebrae. He was evacuated by helicopter and required nine hours of surgery. The same year, Boston slopestyler Nicholi Rogatkin tumbled off a cliff in his qualifying run, enduring a 12m beating on the way down."

One copyrighted online "Outside Magazine" report about the same annual biking competition was most recently updated on May 12, 2022, and was entitled "Inside the Most Dangerous Bike Comp on Earth". That report, written by Peter Vigneron, began with the following statement:

"Of the dozens of crashes at last fall’s Red Bull Rampage, the one that rattled me most was Kelly McGarry’s. During practice a few days before the competition, McGarry, a 32-year-old from New Zealand, misjudged a 70-foot gap jump over a canyon and overshot his landing. At six feet four inches, McGarry is the largest guy on the Freeride Mountain Bike World Tour, and both of his wheels imploded on impact. (In the vernacular, he 'tacoed' them.) McGarry went over the handlebars and landed face first in the sandstone, eventually ragdolling to rest in a sitting position while his bike bounced down a ten-foot cliff."

State House Majority Leader Schultz, you have the legal authority to help save the lives of thousands of young men of the present and future. You can go that by asking your colleagues in the Utah House to refuse to let Utah turn into a Death Trap for young men.

Possibly the State of Utah under your kind leadership could require that each competitor at the Red Bull Rampage Mountain Biking Competition in Virgin, Utah, must be at least 21 years old, must pass a drug and alcohol test, must be certified by their physician as being mentally and physically healthy, and must wear specified State of Utah-required full safety gear while competing in that event.

One biker wrote a recent safety-minded copyrighted online report (see online link below) that was most recently updated on December 7, 2023, and offered the following advice for safety gear:

"Wearing a mountain bike helmet is a no brainer (ha!), and it may even be required by law. Protective gear won’t prevent all injuries, but in most cases it can significantly reduce the severity.

"Beyond helmets, consider knee and elbow pads, chest and back protection, and even a neck brace. Manufacturers are starting to build protective features into everyday wear items like hydration packs and even jerseys. Consider adding one or more of these pieces and you just might be surprised how little they interfere with your riding comfort."
