Dear Open Records Coordinator for the Travis County District Attorney's Office in Austin, Texas,

This is a courtesy reminder to you that I have not yet received a reply letter from you that provides me with any and all legal documents responsive to my October 24, 2019-dated public-information request (below) to your DA's Office in Austin.

As you of course know, state law in Texas allows a government agency no more than 10 business days to provide a written response to any public-information request. That 10-day deadline for you appears to possibly be at 9 a.m. tomorrow.

Please note that my most recent PIR to you is focused exclusively on your Travis County District Attorney's Office Sex Crimes unit and myself, John Kevin McMillan of Austin.

Specifically, my PIR to you seeks a copy of "e-mail communications that were written or received or forwarded by any investigator or other staff member or official of the Travis County DA's Office Sex Crimes Unit at any time since 8 a.m. January 3, 2017, that, in each and every such case, refer at least once in any manner to myself, John Kevin McMillan of Austin, Texas, or to APD Sex Crimes Case Number 16-1340923 in which I am the longtime-celibate-by-choice, permanently-alcohol-free, single-by-choice, adult Anglo male complainant."

I hope to hear from you soon.

Open Records Division,
P.O. Box 1748,

October 24, 2019

Dear Open Records Coordinator for the Travis County DA's Office,

This is a Texas Open Records request in which I seek to obtain from you a copy of any and all e-mail communications that were written or received or forwarded by any investigator or other staff member or official of the Travis County DA's Office Sex Crimes Unit at any time since 8 a.m. January 3, 2017, that, in each and every such case, refer at least once in any manner to myself, John Kevin McMillan of Austin, Texas, or to APD Sex Crimes Case Number 16-1340923 in which I am the longtime-celibate-by-choice, permanently-alcohol-free, single-by-choice, adult Anglo male complainant.

My legal name is John Kevin McMillan. My date of birth is April 27, 1957. I am a native of Lincoln, Nebraska.

I have most recently resided here in Austin, Texas, on a continuous and uninterrupted basis ever since mid-March 1997.

My three respective mailing addresses as an official rent-paying apartment tenant or management-approved rent-paying occupant on a multi-month basis in the period ever since January 3, 2017, have been:
---Village Oaks Apartments, 10926 Jollyville Road, Apt. 902, Austin, TX 78759;
---Village Oaks Apartments, 10926 Jollyville Road, Apt. 1609, Austin, TX 78759;
and, ever since June 21, 2019, Pebble Creek Apartments, 8805 North Plaza Drive, Apt. 2418 (a second-floor, eastward-facing unit in Building 17), Austin, Texas, 78753.

I have maintained the same personal e-mail address of "mcmillanj@att.net" throughout the entire period ever since January 3, 2017.

On October 17, 2019, I also obtained a new personal e-mail address for myself of "goody2shoes2019@gmail.com", which now gives me the opportunity to also receive and send e-mails through my first-ever cell phone that I purchased through AT&T in August 2019.

My landline home phone number of (512) 342-2295 remained the same throughout my entire multi-year period as an official rent-paying tenant or rent-paying approved occupant at each of my two respective rental units at Village Oaks Apartments and, more recently, has also continued for me as a rent-paying official tenant living alone at Pebble Creek Apartments in Austin District 4.

My first-ever and new cell phone, which I have been using ever since August 15, 2019, has a phone number through AT&T, my cell-phone service provider, of (512) 993-7305.

I myself do not have any criminal-conviction record.

Among the insights I hope to glean from this public-information request are:

---Has there been any investigator or official of the Travis County DA's Office Sex Crimes Unit who believes or suspects that I myself have been and continue to be a victim of alleged continuous, daily-and-year-round sex crimes and other personal-injury-crimes allegedly being perpetrated on me during my sleeping hours on a nightly basis as I lie or lay alone, asleep and unconscious, on my own bed inside my bolt-locked rental apartment unit in Austin?

--Has Investigator Dave Mahoney of the Travis County District Attorney's Office Child Abuse Unit ever written or sent or received any e-mail letter to (or from) the Travis County DA's Office Sex Crimes Unit that refers at least once to myself, John Kevin McMillan of Austin?

---Has there been any investigator or official of the Travis County DA's Office Sex Crimes Unit who suspects or believes that I myself have been subjected against my wishes to unauthorized and injurious "medical-services" that have included unwanted nasal inhalants and unwanted oral inhalants and unwanted liquids injected into my nostrils or mouth, all during my sleeping hours, as I lie alone, asleep and unconscious and probably also snoring, on my own bed inside my bolt-locked apartment in Austin?

---Has there been any dialogue within the Travis County DA's Office Sex Crimes Unit in regard to whether the alleged nasal inhalants to which I have been subjected against my wishes during my sleeping hours inside my bolt-locked apartment unit have allegedly played a role in myself being held unconscious while being subjected to alleged sex crimes and alleged personal-injury crimes during my bedtime hours inside my bolt-locked apartment unit?

--Has Travis County District Attorney Margaret Moore sent any e-mail note to the Travis County District Attorney's Office Sex Crimes Unit in which she has stated in writing whether she is willing to prosecute in a court of law in Austin, Texas, at least one of the individuals who have allegedly illegally entered and allegedly trespassed inside my bolt-locked apartment unit and have allegedly subjected me to alleged sex crimes and other personal injury crimes during my sleeping hours inside my bolt-locked rental-apartment unit in Austin, Texas?

--Has Travis County District Attorney Margaret Moore ever written and sent any e-mail note to the Travis County DA's Office Sex Crimes Unit in which she expressed considerable concern that alleged home-invasion crimes and alleged personal-injury crimes and alleged hate crimes allegedly victimizing me during my sleep inside my bolt-locked apartment unit, as I lay ALONE on my own bed, have allegedly played a role in my having received five separate respective doctor-ordered surgeries for life-threatening medical problems inside local hospitals in the period ever since February 2016?

---Has Travis County District Attorney Margaret Moore stated in any e-mail to the Travis County DA's Office Sex Crimes Unit that she believes or suspects that I myself have been victimized by one or more forms of elder abuse --- I myself being a 62-year-old gentleman at present --- that are also in flagrant alleged violation of the law?

--Has Travis County District Attorney Margaret Moore stated in any email she sent to anyone employed in the Travis County DA's Office Sex Crimes Unit that she believes or suspects that my own status as a biological male, as a law-abiding opponent or critic of sex-change operations, as a citedly "prejudiced" person, as a citedly "homophobic" or "anti-gay" or "racist" person, or as the founder and sole current member of a new and non-Christian "Honor Society" religion with very stringent membership-eligibility requirements that favor law-abiding heterosexual men and law-abiding heterosexual women as prospective future new members, may have allegedly played a role in APD's apparent unwillingness to arrest any suspect in the continuous sex-crimes case from 2016 in which I myself am the cited single adult Anglo male victim?

---Has there been any dialogue among investigators and officials of the Travis County DA's Office Sex Crimes Unit in regard to what the time-deadline-related requirements and other legal requirements are, if any, for prosecuting a rape case in Austin that has been determined to be a continuous-and-still-continuing sexual-assault case?

---Has there been any dialogue between the Travis County District Attorney's Office Sex Crimes Unit and the Federal Bureau of Investigation in regard to what prompted the Federal Bureau of Investigation of the United States Government to provide me with an "intake" interview on the telephone with a female FBI staff member on Monday, September 23, 2019, in regard to APD Case 16-1340923, with that telephone interview having concluded politely at 10:30 a.m. September 23?

---Has there been any dialogue among staff members of the Travis County DA's Office Sex Crimes Unit in regard to whether at least one additional DNA-trace forensic rape-evidence medical exam on myself should or could be ordered by some official of Travis County Government in the very near future?

---Has there been any dialogue within the Travis County DA's Office Sex Crimes Unit in regard to whether there is a need for full 180-day or 190-day retroactive DNA-trace processing on each of the two total existing DNA-trace rape-evidence kits that were obtained from me by APD on April 28, 2011, and December 22, 2011, respectively, for APD Cases 11-1180447 and 11-3550615?

---Has there been any dialogue within the Travis County Sex Crimes Unit in regard to whether it would be legal and justifiable for either Travis County Government or the Federal Bureau of Investigation or a State Government of Texas agency to provide temporary 24-hour-a-day, seven-days-per-week electronic surveillance of the entire interior of my current rental-apartment unit --- an efficiency rental unit in which I myself am the ONLY current official tenant and the ONLY current official occupant?

---Has there been any dialogue within the Travis County DA's Office Sex Crimes Unit in regard to what the possible point or points of entry by a law-breaking trespasser into my current double-bolt-locked and fully-secured rental apartment unit might be or is or are at present, and whether there is some way for county government investigators to use technology available to the District Attorney's Office or the Sheriff's Office here in Austin to clearly identify the alleged points of entry being used by alleged trespassers allegedly breaking into my own current always-bolt-locked rental unit?

---Is there any evidence that any person employed in the Travis County DA's Office Sex Crimes Unit has indicated or stated that he or she does not believe my own repeated factual statements to APD and to the DA's office over a multi-year period about my being a longtime celibate, permanently-drinking-alcohol-free, permanently marijuana-free and permanently-illicit-drug-free, dependably civil and law-abiding and honest single adult gentleman who ALWAYS sleeps alone on my own bed inside my bolt-locked apartment unit in Austin?

---Is there any evidence that any person currently employed by the Travis County DA's Office Sex Crimes Unit has indicated or stated that he or she senses or has concluded that my own credibility as a criminal-law complainant and self-identified crime victim here in Austin has somehow been undermined or harmed, or, to the contrary, that my credibility as a criminal-law complainant has actually been strengthened significantly?

Thank you in advance for your very diligent and helpful reply letter providing me with any and all responsive legal documents.

Sincerely and Best Wishes,

John Kevin McMillan, a former full-time employee in Austin of the Texas Department of Public Safety state agency.

Subject: 10-24-19 PIR re: TCDA Sex Crimes Unit and me

To: Open Records Coordinator,
Travis County District Attorney's Office,
Open Records Division,
P.O. Box 1748,
Austin, TX 78767

---Village Oaks Apartments, 10926 Jollyville Road, Apt. 902, Austin, TX 78759;

---Village Oaks Apartments, 10926 Jollyville Road, Apt. 1609, Austin, TX 78759;

and, ever since June 21, 2019, Pebble Creek Apartments, 8805 North Plaza Drive, Apt.

--Has Investigator Dave Mahoney of the Travis County District Attorney's Office Child Abuse Unit ever written or sent or received any e-mail letter to the Travis County DA's Office Sex Crimes Unit that refers at least once to myself, John Kevin McMillan of Austin?

Dear Texas Workforce Commission Civil Rights Director Gomez,
Thank you for the very kind recent E-mail reply letter you sent me in regard to stated concerns of mine I've shared with you about alleged unwanted sex-theme and sexuality-theme and gay-theme verbalized communications to which I have been subjected against my wishes at various workplaces of mine in the Austin area of Texas in recent years.
I wish to emphasize that company policies at each of the respective workplaces where those unwanted communications have occurred have each prohibited sex-theme, sexuality-theme, and gay-theme verbalized communications being inflicted on employees at the workplace in any context sponsored by that employer.
I hope that the following letter of mine to a State of Montana official, a letter from myself that also refers to working conditions I have endured in Texas over a multi-decade period, will also prove to be of interest to your State of Texas agency in Austin.
Sincerely and Best Wishes,

Dear Montana Department of Commerce Public Relations Officer Sexton in Helena,

Thank you for the lovely color photograph you have sent me, highlighting Montana scenery and an athletically talented and impressive young gentleman bicyclist in Helena. I received that very nice free photograph from you today in the mail at my apartment complex in northwest Austin.

That photograph from your people-friendly state government in Montana will serve as a very fine inspiration to me as I strive to lose lots of weight and pursue athletics more often on a year-round basis.

As I indicated to you on the telephone when I recently made a long-distance phone call to your State of Montana government office in Helena, in the period since mid-1987 I have repeatedly gained lots of weight at various times and suffered numerous medical problems in Austin, Texas, and elsewhere in Texas as well, that derived in large part from unwanted and apparently illegal noise pollution in Texas that has inflicted lots of needless stress and anxiety on myself in each and every Texan city or Texan town where I have resided during the entire period since mid-1987.

I have complained about that offensive noise pollution inflicted on me in Texas to dozens of attorney members of the State Bar of Texas over a multi-decade period, without any of those highly-esteemed attorneys stating to me at any time that he or she was willing to file any lawsuit on my own behalf in that regard, or that any legal recourse was available to me.

In fact, a first-rate ear, nose, and throat specialist in northwest Austin, Dr. David Tobey, has very helpfully confirmed for me inside his medical clinic over a multi-year period, including this year, that noise pollution in Austin, Texas, including at some or several of my respective workplaces, has caused significant damage to my own hearing capacity in Austin, Texas, Dr. Tobey has helpfully informed me after examining my hearing capacity on several separate occasions using very sophisticated medical technology inside his medical clinic.

I wish very much that Texas Governor Rick Perry and State Comptroller Susan Combs and officials of the Texas Department of State Health Services in Austin, Texas, as well as each of my duly elected state and federal lawmakers, State Rep. Donna Howard, State Senator Kirk Watson, and Congressman Michael McCaul, would each publicly express concern about public-policy implications for the State Government of Texas and the U.S. Government relating to noise pollution injurious to myself in Austin, Texas. In that regard, I should also mention that I have complained about noise pollution to the Austin Police Department (APD), but that municipal law-enforcement agency has indicated to me that I must provide it with a cited suspect and documented legal evidence before I can actually file a criminal-law charge of that type with APD.

Thank you again for writing to me about one humane and attractive U.S. state, Montana, where serene and quiet living and full privacy rights, are, in fact, possible to experience and enjoy on a year-round basis.

Sincerely and Best Wishes,

with numerous carbon-copies, including a courtesy carbon-copy to Dr. David Tobey, who thus far has not stated to me inside his medical clinic that Dr. Tobey recommends that I move to another U.S. state in order to myself achieve a significant reduction in environmental noise pollution injurious to myself. I am also carbon-copying this reply letter to officials of Noise Free America, a very influential non-profit organization based in Madison, Wisconsin, that has informed me in writing that it disapproves of any and all noise pollution injurious to myself or inflicted on myself against my wishes in Austin, Texas.

Dear Mr. Howard,
Thank you again for your polite and helpful style toward me during a late-morning phone conversation we had on Tuesday, October 29, 2019. In that phone conversation, you volunteered that you believe my annual employment-derived financial earnings and Social Security income may exceed federal eligibility guidelines for qualifying for a rental housing unit through the Travis County Housing Authority.

Mr. Howard, I appreciated the fact that you had initially scheduled a Tuesday, October 29, 2019, 2:30 p.m. to 3 p.m. one-to-one meeting with me in your county government office through your polite executive assistant, Ms. Shenika Howard, who pre-scheduled that meeting for me on the telephone on October 22, 2019.

My planned October 29 meeting with you would have been in regard to my search for a possible future housing unit for me that would offer me safe sleeping conditions inside a bolt-locked rental-housing unit that's administered or supervised by your public housing authority in Austin.

When I then called your office and spoke with you beginning at about 11:45 a.m. on the planned meeting day for me, October 29, to politely preview with you the types of issues that would be appropriate for our meeting that afternoon, you pointed out to me on the phone that "We don't necessarily provide that type (safe-living-conditions housing)." You then added in that October 29 phone conversation, as noted above, that "You (John Kevin McMillan) may  be over our (financial-income-eligibility) threshold for public housing."

Mr. Howard, I would like to pose one follow-up question to you relating to your kind additional statement to me during our October 29 phone conversation that you would be willing to yourself do some research for me to identify a possible federal program that might help protect my own safety during my sleeping periods as I lie alone, asleep and unconscious, on my own bed inside my current solo-occupancy bolt-locked apartment unit in north Austin. I am the only official tenant inside my current unit, and no one but me is ever authorized to be anywhere inside my bolt-locked rental unit during my sleeping hours. And as you may recall, you helpfully volunteered to me in our October 29 phone conversation that "There may be some program out there which addresses that (unsafe sleeping conditions inside a bolt-locked solo-occupancy rental-housing unit)," you kindly stated.

My respectful follow-up question to you today is:

Have you been able to identify any program through the U.S. Government (or any other government agency or entity) that will help me to lawfully and in a civil manner keep any and all persons other than myself---regardless of who they are---AWAY FROM AND OUTSIDE OF ANY AND ALL PORTIONS OF THE INTERIOR OF my current bolt-locked efficiency apartment unit throughout the entirety of my sleeping hours (which generally occur for me inside my rental unit during the periods from roughly midnight to 9 a.m. each and every day of the week)?

Thank you again, Mr. Howard, for your friendly style toward me on the phone on October 29 in our first-ever telephone conversation. I hope to hear from you soon.

With Friendly Best Wishes,
from longtime criminal-law complainant and self-identified continuous and continuing home-invasion-crimes victim and personal-injury-crimes victim John Kevin McMillan of Austin District 4.

Dear Travis County Housing Authority Executive Director Howard,

Thank you for taking the time to talk with me on the telephone from your county government office for about 15 minutes today, beginning at 11:45 a.m.

I appreciate your kind statement to me on the phone today that you will pursue some factual research on my behalf to attempt to identify any governmental program that can help me to keep any and all alleged home-invasion-crimes perpetrators, any and all alleged  trespassers, any and all unwanted-nasal-inhalant-spray "medical services" providers, any and all alleged personal-injury-crimes perpetrators, and any and all alleged rapists AWAY from any portion of the interior of my current bolt-locked apartment unit.

I value benefiting from full privacy rights for me during any and all of my sleeping hours as I lie alone on my own bed inside my bolt-locked apartment unit. I am the only official rent-paying tenant, and only approved occupant, residing in my current efficiency apartment at Pebble Creek Apartments, 8805 North Plaza Drive, in north Austin.

My current rental unit is located in Travis County Precinct 1, and City of Austin Austin District 4. My current duly-elected County Commissioner is Jeff Travillion; my current duly-elected City Council Member is Greg Casar.

As I mentioned to you on the phone, Mr. Howard, my current solo-occupancy (myself, only) efficiency apartment unit at Pebble Creek Apartments is very comfortable and pleasant during my waking or conscious hours. It is only during my bedtime hours, as I lie alone asleep, unconscious, and probably also snoring, on my own bed inside my bedroom, when the cited problems have been occurring for me.

Please do not hesitate to call me or write to me if you need any additional factual information from me.

Sincerely and Best Wishes,

John Kevin McMillan, a former full-time employee in Austin of the Texas Department of Public Safety state agency.
