The Civil Rights Division of the Arizona Attorney General's office is empowered by the Arizona Civil Rights Act to investigate complaints regarding alleged unlawful discrimination in the areas of employment, housing, public accommodations and voting. In order for the Division to have jurisdiction over a complaint, it must contain an allegation that a person was subjected to discriminatory treatment because of the person's race, color, national origin, religion, sex (including pregnancy) or disability. Under the Arizona Fair Housing Act, a person's familial status is also a protected characteristic.
Based on the information that you have provided to the Division, it appears that this agency does not have jurisdiction to investigate your complaint. You may wish to consult with a private attorney regarding the matter. the following E-mail correspondence of mine about medically injurious noise
pollution inflicted on myself against my wishes in Austin, Texas (in Travis as
well as Williamson counties), for which no alleged source of that continuous and
year-round noise pollution has ever been identified to me at any time by ANY
City of Austin official, ANY Travis County Government official, ANY Williamson
County Government official, ANY State Government of Texas official, or ANY U.S.
Government official. Nor has any media company or religious group or political

One private attorney member of the State Bar of Texas, himself a very
distinguished alumnus of the University of South Texas Law School in Houston,
did helpfully inform me in a recent prior week that he believes I have myself
been victimized by illegal noise pollution in Austin, Texas, that comprises a
violation of the state penal code of Texas, that courageously insightful private
attorney helpfully informed myself. I am very grateful to that first-rate
attorney for also emphasizing to me that in addition to my filing criminal
charges in this matter, I have the legal right to myself also file a lawsuit in
a court of law in Texas (and elsewhere, I would assume) against the alleged
source of that unwanted noise pollution victimizing myself.
I would appreciate any reply letter from any of you in which you provide me with
any information or impressions you are willing to share with me in regard to
this very important legal and human-rights matter for myself. For instance:
WHICH MEDIA COMPANY or other media organization, such as a non-profit group of
any type, do YOU yourself suspect is the most likely to have subjected me in my
own life to continuous and year-round and medically injurious noise pollution
that I definitely DO NOT want in my own life.

health, and that puts me at risk of "going deaf" in Austin, Texas, in the
foreseeable future.
I should emphasize to you, Senator Watson, that I myself did NOT authorize the
cited noise pollution, nor did I generate it, nor am I the source of the cited
noise pollution that has significantly injured myself in Austin, Texas, over a
multi-year period, including this year. I definitely do NOT want the cited noise
pollution in my own life, as you are no doubt very aware.

I would appreciate any reply letter from any of you officials about this very
important human-rights issue relating to permanent and significant hearing loss
inflicted on me by year-round, continuous noise pollution occurring against my
wishes and without my consent over a multi-decade period, including at present,
in Austin, Texas.
Just this morning, for instance, I suffered a ringing sound in my left ear when
I awoke from my sleep inside my very nice apartment unit in northwest Austin.
Please note the cited medical findings (see below) from Dr. David Tobey, a
nationally renowned ear, nose, and throat medical specialist in Austin, about
the noise pollution-inflicted damage to my medical health in Austin, Texas, that
he has statistically documented in the period since 2005. I should mention that
2005 was the very first year in which Dr. Tobey examined me inside his ENT
medical clinic in northwest Austin.
Prior to that, a Dr. Mueller (ENT medical specialist based at Medical Arts
Square near the UT-Austin Law School) statistically documented my hearing
capacity in the late 1990s and removed massive quantities of wax from each of my
ears during that medical appointment I had scheduled in advance with himself.
Dr. Mueller has since retired, from what I understand.
Dr. Tobey has helpfully emphasized to me inside his medical clinic in northwest
Austin that I myself am definitely NOT the source of the injurious noise
pollution, nor did I cause it or request it or generate it, Dr. Tobey has
helpfully pointed out.
I have provided written authorization to Dr. Tobey to discuss his medical
findings about me with any person or organization or government official or
attorney who might ever contact Dr. Tobey at any time.

like me, strongly believe that no media company and no corporation---no matter
how powerful or financially successful it may be---should have the legal right
to inflict significant permanent hearing loss, and the additional risk of
deafness as well, on an American citizen (myself, for instance) in a context
violating that American citizen's privacy rights.
Thank you in advance for your very kind interest in this public-policy issue and
legal issue in American society of today.
I should mention, incidentally, that one private attorney in Austin, Texas, whom
I've recently consulted about this did state to me last month inside his law
office that he is very sure that I've been victimized by noise pollution
violating my privacy rights----noise pollution, he emphasized, that comprises
illegal and criminal activity on the part of the individual or individuals
perpetrating that noise pollution on myself, he stated.
The same litigation-minded private attorney emphasized to me during the
one-to-one legal consultation I had with him inside his law office near downtown
Austin, that a civil-law lawsuit on my behalf can also be filed in a court of
law in Austin, Texas, against the alleged source of that noise pollution,
provided that a cited culprit or "respondent" could be cited by name in that

Just this morning, for instance, I suffered a ringing sound in my left ear when I awoke from my sleep inside my very nice apartment unit in northwest Austin.
Please note the cited medical findings (see below) from Dr. David Tobey, a nationally renowned ear, nose, and throat medical specialist in Austin, about the noise pollution-inflicted damage to my medical health in Austin, Texas, that he has statistically documented in the period since 2005. I should mention that 2005 was the very first year in which Dr. Tobey examined me inside his ENT medical clinic in northwest Austin.
Prior to that, a Dr. Mueller (ENT medical specialist based at Medical Arts Square near the UT-Austin Law School) statistically documented my hearing capacity in the late 1990s and removed massive quantities of wax from each of my ears during that medical appointment I had scheduled in advance with himself. Dr. Mueller has since retired, from what I understand.
Dr. Tobey has helpfully emphasized to me inside his medical clinic in northwest Austin that I myself am definitely NOT the source of the injurious noise pollution, nor did I cause it or request it or generate it, Dr. Tobey has helpfully pointed out.
I have provided written authorization to Dr. Tobey to discuss his medical findings about me with any person or organization or government official or attorney who might ever contact Dr. Tobey at any time.

I would appreciate any reply letter from any of you officials about this very important human-rights issue relating to permanent and significant hearing loss inflicted on me by year-round, continuous noise pollution occurring against my wishes and without my consent over a multi-decade period, including at present, in Austin, Texas.
Just this morning, for instance, I suffered a ringing sound in my left ear when I awoke from my sleep inside my very nice apartment unit in northwest Austin.
Please note the cited medical findings (see below) from Dr. David Tobey, a nationally renowned ear, nose, and throat medical specialist in Austin, about the noise pollution-inflicted damage to my medical health in Austin, Texas, that he has statistically documented in the period since 2005. I should mention that 2005 was the very first year in which Dr. Tobey examined me inside his ENT medical clinic in northwest Austin.
Prior to that, a Dr. Mueller (ENT medical specialist based at Medical Arts Square near the UT-Austin Law School) statistically documented my hearing capacity in the late 1990s and removed massive quantities of wax from each of my ears during that medical appointment I had scheduled in advance with himself. Dr. Mueller has since retired, from what I understand.
Dr. Tobey has helpfully emphasized to me inside his medical clinic in northwest Austin that I myself am definitely NOT the source of the injurious noise pollution, nor did I cause it or request it or generate it, Dr. Tobey has helpfully pointed out.
I have provided written authorization to Dr. Tobey to discuss his medical findings about me with any person or organization or government official or attorney who might ever contact Dr. Tobey at any time.

I should mention, incidentally, that one private attorney in Austin, Texas, whom I've recently consulted about this did state to me last month inside his law office that he is very sure that I've been victimized by noise pollution violating my privacy rights----noise pollution, he emphasized, that comprises illegal and criminal activity on the part of the individual or individuals perpetrating that noise pollution on myself, he stated.
The same litigation-minded private attorney emphasized to me during the one-to-one legal consultation I had with him inside his law office near downtown Austin, that a civil-law lawsuit on my behalf can also be filed in a court of law in Austin, Texas, against the alleged source of that noise pollution, provided that a cited culprit or "respondent" could be cited by name in that lawsuit, that private attorney informed me.
I would appreciate any information that any of you are willing to share with me about the alleged source of the flagrantly illegal noise pollution victimizing myself in Austin, Texas, on a continuous and year-round basis ever since I moved back to Austin in mid-March of 1997, most recently.

Your reply E-mail letter was apparently in response to E-mail correspondence from me I recently shared with you relating to medically injurious and unwanted noise pollution to which I have been subjected in Austin, Texas, on a continuous and year-round basis.
So far, the Attorney General of Texas has not expressed any concern to me in writing about the significant permanent and irreversible medical damage to my hearing capacity resulting from that continuous background noise pollution over a multi-decade period in Austin, Texas, including at each and every one of my workplaces in Austin and Cedar Park during that period, that I myself DID NOT and DO NOT generate or request or authorize or want in my own life. I lead a very quiet life in Austin, and I NEVER attend rock-music or punk-rock music concerts, for instance. In fact, I only rarely listen to music of any type during my leisuretime.
No state agency or State of Texas-owned institution, and no other government-owned or government-affiliated institution or organization of any type, has ever acknowledged to me at any time that it had any role of any type in sponsoring or permitting or authorizing or causing or inflicting or perpetrating the injurious noise pollution in Austin that has been very harmful to myself and my medical health over a multi-decade period.
However, I remain very hopeful that the Consumer Protection Division or Victim Services Division of the Office of the Attorney General of Texas state agency in Austin, Texas, will in the near future send me a reply letter providing me with helpful factual information and expressing an interest in this legal-liability matter facing the State Government of Texas, the City Government of Austin, Travis County Government, Williamson County Government, the City Government of Cedar Park, and the U.S. Government as well.

The National Institutes of Health conducts and supports biomedical research into diseases, disorders, and infectious illnesses, and we have no authority over the noise levels created by private businesses, commercial practices, air or land traffic, construction, or any other producer of noise in any area. We are strictly relegated to the biomedical field.
If you feel there is a level of noise that constitutes pollution, we would encourage you to have it measured with a meter and have that figure compared against commonly agreed-to standards for noise in residential and commercial spaces; however, that is not work that we perform. We encourage you to work with local resources that would have more familiarity with your area.

Senator Watson, are you aware at this time of any bill or resolution or legislation of any type that you yourself have authored or sponsored this session that is specifically designed to address concerns and legal complaints of mine about my own living conditions in Texas that I myself have shared with you and your staff in Austin?
Among the many types of concerns I have shared with you and your staff, as you may recall, are:
---alleged criminal intent by one or more persons in a context victimizing myself, a scenario that Travis County District Attorney Ronald Earle directly acknowledged as having occurred in 2006, for instance, when he authorized Ms. Norma Hilbig, a paralegal under his supervision, to herself establish a "John McMillan" file in the DA's office in downtown Austin that exclusively contains criminal-law pre-prosecution legal evidence about various persons allegedly attempting to harm myself.

--alleged illegal or unjustifiable actions by some person or entity that deprived me myself of full and immediate access to all of my own cumulative or current financial wealth and all of my own cumulative or current property wealth as well, with my oldest brother, Kent Neal McMillan of Austin (now a resident of Westlake Hills) having himself acknowledged to me in 1994 on the telephone (during a long-distance phone call I made to him that day from my "Snyder Daily News" newspaper office workplace in Snyder, Texas) that I had myself accumulated as of that time a very sizable cumulative lifelong financial wealth and property wealth, Kent McMillan helpfully informed me on that one total occasion;
----alleged pervasive and comrpehensive violations of my privacy rights in Texas, so much so that I myself cannot conceive of any Texan resident in the entire history of Texas whose privacy rights were violated as extensively and as comprehensively as my own privacy rights have been violated by persons and entities unbeknownst to myself;
---the alleged infliction of an illegal thought-control project on myself in Austin, Texas, and elsewhere that I definitely do not want and I definitely did NOT authorize;
---alleged infliction of slanderous and libelous communications on myself and about myself in Texas that I strongly oppose;
---alleged infliction of continuous, year-round and medically injurious noise pollution on myself, John Kevin McMillan, that I myself did not authorize and do not want, and that puts me at risk of "going deaf" as a law-abiding resident of Austin who myself does NOT listen to any loud music or generate loud noise during my leisuretime, with Dr. David Tobey, a nationally renowned ENT medical speicalist, having examined my hearing capacity on numerous occasions and having documented statistically the significant permanent damage to my own hearing capacity resulting from media communications, including at my workplace, that I myself did NOT cause or authorize or generate or request, he helpfully assured me.
----alleged infliction of fraudulent or deliberately dishonest or fictitious communications and related "educational services" or "communications services" on myself that I definitely do NOT want and I definitely DID NOT authorize;
----the alleged attempt by numerous Central Texans (this according to Civil Probate Division Director of the Travis County Courthouse, Mr. David Ferris) to "drive you (John Kevin McMillan) out of the Austin area," as Mr. Ferris volunteered to me on the telephone in 2001 during a local phone call I made to his Travis County Government office from my rental apartment unit in northwest Austin.
---the alleged failure by numerous Texans to acknowledge my legal right to set my own priorities and to myself lead a lawfully heterophiliacal platonic life in which I'm more receptive toward and more inclusive as a human being toward a higher percentage of all masculine heterosexual adult men and all heterosexual adult women than of all homosexual male adult persons, all "gay" adult male persons, all effeminate heterosexual adult male persons, all bisexual male adult persons, all lesbian adult persons, all transsexual adult persons, and all transvestite adult persons, respectively.
