On July 11, 2012, Austin Police Monitor Margo L. Frasier, herself a former Travis County Sheriff, e-mailed to me (as an attachment to an e-mail that day from a staff member of hers, Sacheen Yates) a signed one-page July 10, 2012-dated, and signed legal letter demanding that I cease and desist from directly contacting Ms. Frasier's office ever again in regard to my allegations about being a victim of alleged sexual assault in Austin, Texas, or in regard to any complaint of mine about alleged failure by any cited Austin Police Department officer or cited APD officers to adequately investigate my sexual-assault allegations to APD about my being a self-identified single-by-choice, longtime-celibate-by-choice, permanently drinking-alcohol-free, adult Anglo male victim of alleged personal-injury-crimes and alleged anal-rape crimes allegedly being inflicted on me on a repeated basis during my sleeping hours as I lay alone on my own bed inside my locked apartment unit in Austin, Texas.

Dear Mr. McMillan,

The Office of the Police Monitor is in receipt of numerous e-mails, telephone calls and voice mail messages sent by you since July 1, 2011. Most recently, between the dates of July 5, 2012 and July 8, 2012, you sent nineteen (19) e-mails messages to our office and called on four (4) separate occasions. Moreover, on Monday, June 25, 2012, our office received a total of fifteen (15) e-mails and one (1) facsimile, you sent over the weekend.

This letter is a formal request for you to cease and desist contact with our office related to the matter you identified with Austin Police Department Detective, David Silva. It is our understanding that the Austin Police Department (APD) has repeatedly reviewed your claims of sexual assault and has made the determination, based on the information you have provided, not to pursue an investigation. In communications with the Austin Police Department, we have also learned that police officers from the Crisis Intervention Team spoke with you on May 24, 2012 at your apartment, through your closed door. The officers explained to you their belief that the events you allege are a product of your delusional thinking. The officers offered to assist you in securing mental health services; you declined. Prior to leaving your apartment on May 24, 2012, the officers instructed you to stop contacting City officials and to not send any more photographs of yourself to City officials. You were told that your failure to comply could result in criminal charges being filed against you.

In light of the forgoing, the Office of Police Monitor has provided all of the assistance that is appropriate in this matter and considers this matter to be closed. The Office of Police Monitor will not assist you in filing an administrative complaint against Det. Silva or the APD related to your assertion that the APD will not conduct an investigation into your alleged sexual assault.

Your July 19 e-mail reply letter sought clarification from me in regard to which specific staff members of President Rhodes should be included in the scope of my request.

Is it fair to ask you if you can tell me which, if any, staff member for ACC President Rhodes, is the primary individual who initially reviews and responds in writing to E-mail correspondence for President Rhodes on behalf of that ACC President, such as by writing a brief note in forwarding that E-mail letter to another ACC staff member or by providing a brief written reply to the person who initially wrote and sent that e-mail to ACC's President?

I might add that if President Rhodes himself is the individual who initially reads and initially reviews and responds in writing to all or most of the E-mail correspondence sent to him at the E-mail address I myself have been using of "rrhodes@austincc.edu", I would for that reason seek to limit the scope of my search to documents written by President Rhodes himself during the cited time period that refer to myself, John Kevin McMillan of Austin, in any way.

As you will recall, my July 18, 2016-dated public-information request addressed to you contained the following exact verbatim opening paragraph that I wrote:

Dear Investigator Carter,

Please note the text of the following November 15, 2012-dated claims letter I wrote and signed and submitted that same day to the City of Austin Law Department in Austin, Texas.

This request of mine for financial compensation from the City of Austin was promptly and flatly rejected by the City.

 That adverse action by the City occurred without the City of Austin ever at any time providing me with any explanation for the City's refusal to financially compensate me in any way for the allegedly unjustifiable 48-hour-peace-officers'-emergency-commitment that had been arbitrarily imposed on myself by an APD officer in October 2012.

I alleged in writing to the City of Austin Law Department that the cited APD-ordered "commitment" had been imposed on me in an allegedly punitive and allegedly injurious manner that deprived me of the opportunity to myself earn much-needed tip-income income from my restaurant jobs throughout the multi-day period of that APD-ordered "commitment".

It was a "commitment," I might add with emphasis, that occurred without ANY court hearing having ever been held for me at any time. 

I of course did not consume any psychiatric medication at any time during the cited multi-day "commitment," since the psychiatric facility acknowledged that it lacked the legal authority to force me to consume any psychiatric medication in that context. 

I might add that even though I was a model patient in that psychiatric unit, the staff in that psychiatric hospital repeatedly stated to me that they wanted me to consume psychiatric medications throughout my entire period of confinement there. I repeatedly and politely and consistently declined to consume any psychiatric medication at any time during that multi-day involuntary confinement for me; and I was released within a few days without any psychiatric medication having ever been forced upon me at any time.

Investigator Carter, I hope that this additional factual information is helpful to yourself and Prosecuting Attorney Rob Drummond as you continue your very diligent and thorough review of crime evidence relating to alleged possible violations of the law by one or more employees of the City Government of Austin in their own conduct toward myself, John Kevin McMillan, in my capacity as a self-identified victim of anal-rape crimes during my sleep as I lie alone on my bed, and of personal-injury crimes inside my bolt-locked apartment unit in Austin.

Dear City of Austin Law Department Officials,

A kindly private attorney member of the State Bar of Texas has helpfully advised me this month to submit to your municipal law-department in Austin, Texas, a written claim requesting full compensation to myself for the foregone financial earnings that I incurred as a result of unjustifiable 48-hour peace officers’ involuntary commitment of myself at Seton Northwest Hospital Emergency Room and Shoal Creek psychiatric hospital for two and one-half days in mid-October 2012.

I would like to respectfully point out that:

---the male psychiatrist to whom I was referred as the psychiatrist in charge of my cited case at Shoal Creek Hospital, Dr. Garcia, stated to me in person in Shoal Creek Hospital on October 16, 2012, that he strongly disagreed with the decision by the Austin Police Department to place under 48-hour involuntary peace officers’ commitment on Sunday, October 14, 2012. Dr. Garcia indicated to me in person that he definitely did NOT regard me as being a threat to myself, or to anyone else, for that matter. In fact, I was so consistently civil and polite and considerate and honest and alert and law-abiding as an involuntary patient at Shoal Creek Hospital near UT-Austin that I was never at any time required by anyone to consume any psychiatric medication of any type. Nor did I consume any psychiatric medication at any time during the entire “48-hour” peace officers’ commitment imposed on myself against my wishes in mid-October 2012.

---The APD officer, Officer Robert Broomhall, who put me in handcuffs on his own initiative, despite my being consistently polite and civil toward himself, and who then drove me to Seton Northwest Hospital Emergency Room for overnight “observation”, did not cite any reason for placing me under involuntary confinement against my wishes, aside from “deterioration” (exact wording), as Officer Broomhall put it to me in person inside my apartment unit. I had, in fact, very diligently filed a very honest and very accurate crime report with APD, APD report number 12-2880495, by calling 311 (not 911) and politely providing APD with a factual report on the morning of October 14, 2012, about the most recent factual evidence I had observed of an alleged illegal intruder allegedly having illegal and citedly injurious physical contact with me during my sleep inside my bolt-locked one-bedroom apartment at Wind River Crossing—a top-floor, vaulted-ceiling apartment unit where I live alone, I ALWAYS sleep alone, and I am the only approved occupant of my apartment unit.

---APD Officer Broomhall during his visit inside my bolt-locked apartment unit on the morning of Sunday, October 14, 2012, made no attempt to investigate whether I myself had been subjected to any personal-injury crimes or any gastrointestinal-rape crimes or any anal-rape of any type during my sleep that morning, even though I had complained to an APD 311 phone-line staff member that morning about my having been awakened abruptly on my bed at about 4:15 a.m. that morning with very surprising pain in my anus.

---I found it significantly degrading to myself be placed in handcuffs Sunday morning, October 14, 2012, by APD Officer Broomhall in the parking lot of Wind River Crossing Apartments, where his patrol car was situated, before Officer Broomhall then drove me to Seton Northwest Hospital Emergency Room for involuntary confinement there. It was very apparent to me at the time that other tenants at Wind River Crossing might have observed me being handcuffed by Officer Broomhall, and might have very incorrectly assumed that I was myself allegedly dishonorable or allegedly a criminal person. In fact, as your municipal law department well knows, I myself have no criminal-conviction record and am very honest and law-abiding.

---APD Officer Broomhall placed me in handcuffs against my wishes DESPITE the fact that he had stated to me earlier that morning (Oct. 14, 2012) inside my apartment unit that I myself was NOT under arrest, he stated to me inside my apartment unit. He also stated, though, that I was somehow required at that time by the Austin Police Department to undergo a 48-hour peace officers’ involuntary commitment at a psychiatric institution.

--APD Officer Broomhall did not present me with any paperwork on behalf of the cited “48-hour peace officers’ emergency commitment” imposed on myself. Also, he repeatedly declined to show me any paperwork on behalf of that commitment, even though I politely and at least twice asked him to show me any and all legal documents that would have “authorized” any such 48-hour peace officers’ commitment of myself against my wishes.

---Sunday, the first day when I was held against my wishes in a hospital in Austin , is generally the one day of the entire week when I have made the most money as a restaurant employee in Austin . I was scheduled to work a double shift that Sunday—first at Denny’s Lakeline restaurant in Austin , and later at Luby’s Lakeline restaurant in Austin . I have often earned about $100 in tips alone from my double workshifts on Sundays. As a waiter on Sundays in those two restaurants, I have also been paid $2.13 per hour in wages in each of those respective chain restaurants.

---I generally earn $15 or so in tipout income from my Monday workshifts at Outback Arboretum, in addition to my being paid a wage of $3.25 per hour as a busboy at Outback Arboretum chain restaurant.  Because of my involuntary confinement at Shoal Creek Hospital on Monday, October 15, 2012, I was unable to work my scheduled shift as a busboy at Outback Arboretum that day.

---I allege that the multi-day involuntary commitment imposed on myself needlessly jeopardized my own standing and employment status with each of my three respective people-friendly restaurant-industry employers---Luby’s Lakeline, Denny’s Lakeline, and, on Monday, Outback Arboretum chain steakhouse in northwest Austin.

---I have been informed that I am myself being billed for all of the thousands of dollars of hospitalization expenses incurred by me at Seton Northwest Hospital and Shoal Creek Hospital in mid-October 2012, and neither the City of Austin nor Travis County Government is apparently paying for any portion of those expenses relating to the 48-hour peace officers’ involuntary commitment imposed on myself.
I would like to respectfully point out that when the City of Austin in February 2012 placed me in a previous “48-hour” peace officers’ involuntary commitment imposed on myself, I was specifically informed by a staff member at Lakes psychiatric hospital at that time that all of the expenses I incurred as a psychiatric patient at Lakes hospital
during that involuntary confinement for me there would, in fact, be paid in full by the City of Austin and Travis County Government.

Dear Texas Association of Licensed Investigators President Edmond Martin,

I was hoping that you as the very honorable President of your highly-regarded professional organization might be kind enough to refer me to a first-rate member of your association who resides in Central Texas.

I am referring to a private investigator who handles still-unsolved continuous personal-injury-crimes cases in which the victim (myself, in this case) is repeatedly subjected to those crimes on a daily and year-round basis during periods in which he himself is sleeping ALONE and probably also snoring on his own bed in a partitioned section of the living room inside the bolt-locked apartment unit where he resides as a rent-paying official tenant.

One angle to this very baffling and mysterious personal-injury-crimes and harassment-crimes case is the simple fact that on the majority of occasions when I am awakened abruptly at nighttime while lying alone on my own bed---and this occurs an average of about five times per early-morning period between 12:01 a.m. and 8 a.m.----I immediately experience an unpleasant nasal-inhalant sensation. I myself HAVE NOT used or consumed and DO NOT use or consume any nasal inhalants at all.

I might add that I myself have not consumed any illicit drug of any type (in my entire life, it was marijuana only, I might add, and only a very minimal consumption of it by myself) on any occasion since the late fall of 1984; and I am NOT a "former drug addict". I might add that I myself have not consumed any quantity of any drinking alcohol at any time since the late summer of 1990. Also, in my entire life, I have NEVER consumed any tobacco product on any occasion. I might add that I myself DO NOT have any tattoos anywhere on my own body.

Upon being awakened abruptly in the middle of a nocturnal dream I was having while sleeping alone on my bed---an experience that robs me of two or more total combined hours of sleep every night---I often experience extreme dryness in my mouth, or an unpleasant aftertaste in my mouth. I also often experience an unpleasant vibrating sensation in my anus shortly after I'm awakened abruptly at nighttime. I often also experience wobbliness in my legs as I attempt to get out of bed in order to in a sanitary manner make use of a medical urine-collection bottle I keep near my bed at nighttime. I keep that urine-collection bottle near my bed in order to refrain from ever having to go to the one total bathroom in my apartment unit at any time during the entire multi-hour time period each morning from 12:01 a.m. until about 7:45 a.m. (or later, such as 9 a.m. or so) that morning.

Incidentally, even though no law-enforcement agency in Austin, Texas, has ever at any time arrested any suspect in connection with this alleged continuous-crimes case, I myself am a VERY strong criminal-law complainant.


I do NOT have any criminal-conviction record; I am a former full-time employee of the Texas Department of Public Safety here in Austin; I am gainfully employed full-time; I have a fine reputation for being very honest and conscientious; and I have professional newspaper reporting training that helps me to keep focused on FACTUAL alleged-crime evidence that I obtain. Another point that enhances my credibility as a criminal-law complainant: I have been completely celibate throughout any and all of my own conscious or waking hours on a continuous and uninterrupted basis, regardless of where I visited or was situated or resided, ever since the day I moved to northwest Austin in August 2001.

One high-ranking Travis County Government official in the summer of 2001, within days after I moved to an apartment unit in northwest Austin, did volunteer to me on the telephone from his office for the Travis County Clerk's Office Civil Probate Division that "There appears to be an attempt by numerous persons to drive you (John Kevin McMillan) out of the Austin area" (approximate quote). That comment to me was volunteered by David Ferris (sp?), then the Civil Probate Division Director for the Travis County Clerk's Office here in Austin.


Mr. Martin, I believe that I would need a private detective who is willing to either photograph possible alleged-home-invasion crimes perpetrators outdoors near my apartment building, or help me electronically surveillance my own partitioned bed area of the living room on a 24-hour-a-day and daily basis until at least one total suspected intruder or suspected perpetrator is finally identified.

That crime evidence implicating an alleged perpetrator could then be immediately or promptly turned over to either the Austin Police Department Sex Crimes Unit or the Travis County District Attorney's Office or the Travis County Sheriff's Office or the Federal Bureau of Investigation or the Texas Rangers Division of the Texas Department of Public Safety state law-enforcement agency.

I would have to pay my first-rate private detective in this case on a contingency fee basis, since my own finances are tight at present.

There is no current criminal investigation involving you as a victim currently being investigated by the Austin Police Department. As we have discussed in the past I still would hope you could consider looking into other possibilities as a resolution to your current 
on going situation. I again offer what I have offered in the past, I can have Austin Travis County Integral Care Mobile Crisis Outreach Team meet with you to discuss your current situation. Mr. McMillan at least tell them your story. What is the worst that can happen you talk to a member of the ATCIC MCOT team. John it is not some kind of trick the police department will not be there just MCOT. Please just give it a try. Regardless of if you meet with ATCIC MCOT the email and contact with the
police department need to be limited to myself and Officer Turner unless it is an emergency and then of course call 911. John you are going over the same issues you have covered in the past that have already been handled. The police department has closed the case from 2011, there is no further investigation. You are also more than welcome to meet with Officer Turner and I in person to discuss any issues after an 
appointment can be made to accommodate everyone’s schedule.

I am a former full-time clerical employee in Austin for the Texas Department of Public Safety state law-enforcement agency. I strongly support crime-deterrence and law-enforcement. I myself do not have any criminal-conviction record, and I take pride in being honorably vigilant as a private citizen in Austin.

I am the founder and only approved current member of a new and non-Christian "Honor Society" religion, the "Progressive Prohibitionist Religion", that has very stringent membership-eligibility requirements. My religion opposes thought-control projects, opposes the infliction of anonymous communications
on a person against his wishes that violate his own privacy rights, opposes personal-injury-crimes, opposes sexual assault, opposes home-invasion crimes, opposes stalking, opposes fraudulent or injurious "medical services", opposes fraudulent or deliberately false communications, and opposes medically injurious noise pollution.

I have not consumed any drinking alcohol anywhere in the world on any occasion since the late summer of 1990, and I am NOT a "recovering alcoholic" or "former alcoholic". I have not consumed any marijuana on any occasion since the late fall of 1984, and in my entire life I have never consumed any illicit drug other than marijuana. I am NOT a former drug addict, nor am I a current drug addict. 


I am a lifelong abstainer from any and all tobacco products, and I lead an anti-tobacco lifestyle and religious life. I might add that I myself have never been tattooed on any portion of my own body on any occasion in my entire life. I am personally and religiously opposed to the emblazoning of tattoos on human bodies.

FYI: Beginning Monday, June 6, 2016, Austin ISD will operate on a summer efficiency schedule. District offices will be open for business from 7:00 a.m. to 6:00 p.m., Monday through Thursday, with all facilities closed on Fridays. The District will be closed the week of July 4-July 8, 2016. The summer efficiency schedule resumes on July 11 and continues through August 12, 2016. AISD returns to its normal schedule on Monday, August 15, 2016.

The following (bottom item, below) is an e-mailed attachment sent to me by Austin Community College on July 20, 2016, that provides me with an estimated cost of $846.20 on providing me with all written documents referring to myself (John Kevin McMillan of Austin) in any way, and that were each written by either President Rhodes or Ms. Pam Sutton of ACC's Office of the President, at any time since the morning of Sept. 1, 2011.

I hope this additional documentation is helpful on behalf of my civilly worded legal complaint today through your state agency against Austin Community College in Austin, Texas.

Ms. Smith, I am also providing you, immediately below this follow-up note to yourself, with a copy of a July 21, 2016, E-mail reply letter to me from ACC Public Information Coordinator Dahlia Anzaldua-Torres that very clearly states that the previously cited $846.20 estimated charge to me she had informed me about in writing is for documents about me that were written by either of two total ACC employees or officials: ACC President Rhodes or his assistant Ms. Pam Sutton, for the specified time period ever since the morning of September 1, 2011 (Rhodes's very first day as ACC President).

Also included, below, is the July 20-dated cover e-mail letter to me from Ms. Anzaldua-Torres in which she initially responds in writing to my July 18, 2016, e-mail public-information request by sending me an accompanying attachment (bottom item, below) that cites $846.20 as the estimated fee I'd be charged on that.

I would like to respectfully call your attention to a November 8, 2018-dated, three-page signed legal letter providing a noteworthy official Open Records ruling from the Attorney General of Texas in regard to myself, John Kevin McMillan of northwest Austin.

I received an official copy of that legal letter on November 9, 2018, through U.S. Postal Service delivery that day to my apartment complex-provided mailbox for my current rental apartment unit at Village Oaks Apartments, 10926 Jollyville Road, in Austin.

If any of you would like me to FAX that signed legal reply letter provided to me by the Attorney General of Texas, I will be happy to do that for you. I will also be happy to provide any of you with a copy of the full three-page October 19, 2018, written request for an Open Records ruling that was submitted to the Attorney General by the Travis County Attorney's Office on behalf of County Judge Sarah Eckhardt.

I received the November 8, 2018-dated copy of the official ruling from the Attorney General in my own capacity as the cited public-information "Requestor", with the envelope mailed to me by that state agency having directly and correctly cited my own first name, middle initial, and last name as the recipient of that letter. However, nowhere in the three-page November 8 legal letter itself from the Attorney General did it ever state my own first name, middle name, or last name.

The full exact text of the applicable October 11, 2018, e-mail public-information request from myself to Travis County Judge Sarah Eckhardt in Austin, Texas, is provided below (last item). My request sought a copy of documents on file with County Judge Eckhardt that each referred in any manner to myself, and that were not written exclusively by myself.

The cited "Open Records" ruling case (public-information-request-related case), as noted on the first page of the legal letter, is OR2018-28201. The cited reference number, according to an explanatory note provided below an Assistant Attorney General's signature on page 3 of the legal letter, is: ID number 743814.

That November 8 Open Records ruling letter on official Attorney General of Texas stationery was written and signed by Assistant Attorney General of Texas Britni Ramirez of the Open Records Division of the Office of the Attorney General of Texas in Austin.


The reply letter was addressed to Ms. Ann-Marie Sheely, Assistant Travis County Attorney in Austin, Texas, with a carbon-copy of that letter having been designated in writing for the "Requestor".

The ruling from the Attorney General's Office as delineated by Ms. Ramirez stated, and I quote verbatim the entire verbatim text of the last paragraph of page 2 of that legal letter (a long paragraph that I have chosen here to transcribe as four separate shorter paragraphs, in order to highlight key points from the text of the cited paragraph):

"The county judge's office states the responsive information consists of communications between attorneys and employees of the county judge's office.

"Additionally, the county judge's office states these communications were made for the purpose of facilitating the rendition of professional legal services, the confidentiality of the communications has been maintained, and the communications were not intended to be shared with any third parties.

"Based on these representations and our review, we find the county judge's office has demonstrated the applicability of the attorney-client privilege to the responsive information.

"Thus, the county judge's office may withhold the responsive information under section 552.107(1) of the Government Code."

The Open Records ruling from the Attorney General was in direct response to an October 19, 2018-dated, three-page signed written request for a ruling that was submitted by Travis County Assistant County Attorney Ann-Marie Sheely on behalf of Travis County Judge Sarah Eckhardt.

Ms. Sheely's October 19 legal letter contained the following exact verbatim statement:


"For reference, the responsive documents constitute emails between or among lawyers and staff of the Travis County Attorney's Office and its clients, the Travis County Judge and TNR, an executive department of Travis County, made for the purpose of facilitating the rendition of professional legal services and were intended to be confidential."

Also included, below, is the July 20-dated cover e-mail letter to me from Ms. Anzaldua-Torres in which she initially responds in writing to my July 18, 2016, e-mail public-information request by sending me an accompanying attachment (bottom item, below) that cites $846.20 as the estimated fee I'd be charged on that.

(3) state in writing that City of Austin Senior Police Officer James Turner, a cited "mental health officer" employed in APD's "Crisis Intervention Team" unit, is the only employee or officer of APD who is legally permitted to receive initial or follow-up crime reports from John Kevin McMillan in which that complainant directly and specifically refers to himself, Mr. McMillan, as being a victim of crime in Austin.

(4) state in writing that the City of Austin or Austin City Council or City of Austin Law Department or any City of Austin department officially forbids or prohibits criminal-law complainant John Kevin McMillan from ever at any time writing to or directly contacting an APD officer or an APD employee other than APD Officer James Turner or his reported immediate supervisor, Sergeant Michael King, also reportedly a member of APD's "Crisis Intervention Team" in Austin.

(For the record, APD Senior Police Officer James Turner emphatically cited that "APD policy" or "APD requirement" to criminal-law complainant John Kevin McMillan during a Tuesday morning, January 19, 2016, unannounced roughly 30-minute (9:35 a.m. to 10:09 a.m.) visit which Officer Turner made to the second-floor rental apartment unit, including inside the private bedroom, of Mr. McMillan, in Apt. 902 of Building 9, at Village Oaks Apartments, 10926 Jollyville Road, in northwest Austin.

Mr. McMillan has resided with a strictly-platonic-by-mutual-consent-in-advance and official apartment-management-team-approved male roommate in Apt. 902, a two-bedroom, two-bathroom, unit at Village Oaks Apartments in northwest Austin ever since late September 2015.

Also during that January 19, 2016, visit by Officer Turner and his Crisis Intervention Team coworker APD Officer Burnett, Officer Turner emphatically warned Mr. McMillan that if he ever at any time contacts any APD employee or any APD officer other than Officer James Turner or Sergeant Michael King, the Austin Police Department might arrest Mr. McMillan and charge him with the crime of allegedly "harassing" cited APD employees or APD officers who are not themselves employed in APD's "Crisis Intervention Unit", Officer Turner stated to Mr. McMillan during that January 19, 2016, visit to the complainant's apartment unit.)

(5) cite any "legal conflict" or "legal dispute" or "legal issue" or "legal barrier" or "legal restriction" involving John Kevin McMillan and any employee or officer or official of the Austin Police Department or, for that matter, any department or institution or governing body or council of the City Government of Austin.

(Earlier this week, Ms. Alta Ochiltree of the City Manager's Office in downtown Austin advised criminal-law complainant John Kevin McMillan of northwest Austin on the telephone from her City Hall office that complainant McMillan "may have some issues with the Police Department that you need to work out," or words to that effect. She did not elaborate in any way as to what those "issues" might be. However, Ms. Ochiltree politely indicated to Mr. McMillan in that phone conversation that he might obtain more information on that through a request for information he could personally address to the City of Austin Law Department in downtown Austin.)

(6) cite any current or previous or ongoing criminal investigation into conduct by John Kevin McMillan of Austin by the Austin Police Department or any other law-enforcement agency.

(7) cite any current criminal-law charge or any pending criminal-law charge or any expected future criminal-law charge against any individual with the cited legal name of "John Kevin McMillan" and a cited date of birth of April 27, 1957.

(8) cite any criminal allegation or criminal conviction ever at any time filed against or imposed on any individual with the cited legal name of "John Kevin McMillan" and a cited date of birth of April 27, 1957.


(9) explain in writing why employees or officials of seven different departments of the City Government of Austin in the most recent approximately four-year period have each reportedly on dozens of total occasions either consulted the City Attorney's Office here in Austin or consulted coworkers within the very same City Attorney's Office where they themselves were employed, in a context that directly and specifically referred to the cited John Kevin McMillan of Austin.

(Those seven departments, which the City of Austin is very aware were directly cited in more than 10 separate signed legal letters that two respective assistant city attorneys of your City Law Department, Cary Grace and Elaine Nicholson, submitted to the Attorney General of Texas in the last approximately five-year period that sought official permission to withhold the cited legal documents from public-information requestor John Kevin McMillan of Austin, are: Office of the Police Monitor, the City of Austin Human Resources Office, the City Manager's Office, the City Attorney's Office, the City of Austin Public Information Office, the Austin Police Department, and the City Clerk's Office here in Austin.)

(10) state whether any official of the City Attorney's Office in Austin has ever at any time informed any other City of Austin official that it might comprise or does comprise a legal liability to the City of Austin if the Austin Police Department continues its longstanding policy of APD refusing over a multi-year period to pursue any laboratory DNA-trace testing on the doctor-ordered DNA-swabs anal-rape-evidence kit that was obtained by a female forensic nurse from the body of criminal-law complainant and self-identified anal-rape-crimes victim John Kevin McMillan inside St. David's Medical Center Emergency Room, situated a few blocks from the UT-Austin Law School, in the early morning hours of Dec. 22, 2011.

(That rape-evidence kit was obtained for APD crime report number 11-3550615, which was officially filed with APD by self-identified crime victim John Kevin McMillan on Dec. 21, 2011, with APD Officer Guzman (sp?) having visited McMillan's Wind River Crossing Apartments rental-apartment unit on Dec. 21, 2011, in response to that crime report.

John Kevin McMillan's residential address from January 2002 through July 29, 2015, was: Wind River Crossing Apartments, 11411 Research Boulevard, Building 3, Apt. 325, Austin, Texas, 78759.

The Attorney General of Texas has provided formal legal documentation to complainant John Kevin McMillan that Austin City Manager Marc Ott on January 31, 2012, co-signed for a $2,302.08 check from the City of Austin to St. David's as financial compensation to that medical services provider for the cited Dec. 22, 2011, rape-evidence exam on John Kevin McMillan Dec. 22, 2011.

The Attorney General of Texas has also confirmed in writing to complainant McMillan that an Austin Police Department representative, Katrina E. Pruitt, on January 18, 2012, signed an official completed application form seeking financial compensation from the Attorney General of Texas for the financial expenses that the City of Austin and Austin Police Department incurred from that particular Dec. 22, 2011, rape-evidence exam. The cited APD contact person on that multi-section application was Ms. Melissa Maldonado, with her cited APD office phone number of (512) 974-5068.

The Attorney General of Texas has also provided official documentation to John Kevin McMillan of Austin that the Attorney General's Office in Austin officially approved that APD application for financial compensation from that state agency, with a $250 reimbursement check to the City of Austin having been issued by that state agency, according to a legal document released to Mr. McMillan by that state agency and which Mr. McMillan has retained for his own legal records.

Also, on September 23, 2014, Travis County Assistant District Attorney Rob Drummond signed an official certified-delivery legal letter addressed and mailed to criminal-law complainant John Kevin McMillan, which stated that the DA's Office in Austin has asked APD to continue maintaining the cited rape-evidence kit from Dec. 22, 2011.

That rape-evidence kit is reportedly being stored at an APD substation in Austin, according to a female official of APD's Public Information Office, Ms. Renee Moore.)

(11) refer to any information the City of Austin Law Department at any time since April 1, 2011, has obtained or received or cited, which notes or cites a recent or expected future medical injury to, or a recent or expected future medical disability of any type inflicted on or sustained by, or a wound inflicted on or expected to be inflicted on, or a life-threatening medical disease or other medical disease inflicted on or contracted by or expected to be contracted by or sustained by, or expected to be reported as having been sustained by or inflicted on, criminal-law complainant John Kevin McMillan.

Excluded from the scope of this public-information request are any and all letters or e-mail letters that were exclusively written by John Kevin McMillan of Austin.

This public-information request was prompted by an oral in-person statement made on Friday, April 8, 2016, to criminal-law complainant John Kevin McMillan by Shanna, a polite female temporary employee serving as a receptionist inside the City of Austin Law Department offices on the fourth floor of City Hall in downtown Austin.

Sitting at her receptionist desk, Shanna stated to criminal-law complainant John Kevin McMillan shortly before 5 p.m. on Friday, April 8, 2016, that she had just spoken seconds before on the telephone with an attorney employed in the City Law Department, and that the attorney advised her to recommend to complainant McMillan that he present his questions for their municipal department in the form of a public-information request, Shanna said.

Shanna also stated to McMillan during his April 8, 2016, visit to the City Law Department office that the attorney for that department with whom she had just spoken stated that the City Law Department does not offer legal advice to private citizens such as Mr. McMillan, she said.

Shanna also quoted the attorney for the City Law Department as having stated to her on the telephone shortly before 5 p.m. Friday, April 8, 2016, that Mr. McMillan might consider hiring a private attorney to help Mr. McMillan address the cited questions or issues that Mr. McMillan mentioned in person that day which refer to or relate to the City of Austin Law Department.

Earlier this week, Ms. Alta Ochiltree of the City Manager's Office in City Hall advised complainant John Kevin McMillan on the telephone that he could directly consult the City Attorney's Office here to find out whether there is, in fact, any legal requirement imposed by the City of Austin that somehow orders McMillan to file exclusively with APD Officer James Turner of the APD CIT unit any and all of McMillan's reports to APD about himself being a victim of alleged continuous-and-continuing, daily-and-year-round, personal-injury-crimes-and-anal-rape-crimes in Austin, with the anal-rape-crimes allegedly having been inflicted on Mr. McMillan solely and exclusively during his sleep as he lay alone, unconscious and probably also snoring, on his own designated bed inside his locked private bedroom inside his bolt-locked apartment unit in Austin.

I reported that online item to APD several months ago, and I received a reply E-mail note from an APD detective which stated that the cited item did not at that time reach the level of actual "harassment" of myself, he stated. I would like to respectfully raise the question at this time of whether the point of alleged harassment of me by that alleged group of individuals----whose online photos indicate that several of them are possibly of Asian Indian or Pakistani ancestry----has, in fact, been reached at this time.

If so, as I indicated to APD several months ago about that very same group, I insist on myself filing harassment charges, at the very least, against all members of the cited group.

Thank you again for your very thorough crime investigation of APD Sex Crimes Case 15-1540423, in which I am the victim and complainant. I hope this follow-up report is helpful to you in your investigation.

That factual information is contained in a signed April 30, 2014-dated legal letter from Assistant City Attorney Elaine Nicholson in which she is asking Texas Attorney General Gregory Abbott --- the cited recipient of that letter from herself --- to grant exemption to the City of Austin from the state law that requires release to myself of any and all of the cited legal documents on file with the City of Austin Law Department.

The cited documents reportedly contain factual information about the nature of the legal consultations specifically referring to myself by employees or officials of the five cited City Government of Austin departments or offices during the period since April 1, 2011.

Those five City of Austin departments or offices are:

----the City's Public Infomation Office;
----the City's Human Resources Department; and

I appreciate your having politely confirmed for me in writing that you and Prosecuting Attorney Rob Drummond received the FAX I had sent you both that contained a copy of the three-page, signed, April 30, 2014, legal letter from an official of the City of Austin Law Department that was addressed to Texas Attorney General Gregory Abbott in Austin.

Sergeant Investigator Carter, I would also like to take this opportunity to offer a few corrections and clarifications to some hastily-written statements I made in an E-mail letter that I sent you on May 8, 2014.

Two of the paragraphs toward the end of my May 8, 2014, follow-up letter to you should have stated the following:

Dear Sergeant Investigator Carter,

Thank you again for your very diligent and very polite style as the investigator for the criminal-law complaint that I have filed through your nobly vigilant Public Integrity Unit in which I am alleging that one or more employees or officers or officials of the Austin Police Department (APD) may have allegedly violated the law and may have allegedly committed a possible felony crime in conduct of theirs toward myself.

I am also alleging that one or more employees or officers or officials of APD may have violated the law and committted a possible felony crime as well as through their conduct in "response" to crime reports I have filed with APD and in response to tangible crime evidence I have provided to APD.

I am referring to the numerous crime reports and extensive very tangible crime evidence provided by myself to APD about my being a self-identified victim of alleged anal-rape-crimes and alleged personal-injury crimes on a daily and year-round and still-to-this-day-(May 8, 2014)-continuing basis as I lie ALONE on a bed I own inside my bolt-locked private bedroom of my bolt-locked rental apartment unit at the Westdale-managed Wind River Crossing Apartments in Austin.

The only two total exceptions to that from the entire period ever since and including the early morning hours of April 17, 2011, were the early-morning hours of Saturday, Sept. 3, 2011, and Saturday, Sept. 10, 2011. On each of those two total mornings, I woke up to the sound of my alarm clock at 9 a.m., and I felt fully refreshed and delighted from having enjoyed a full night's healthful rest and a full night's uninterrupted sleep without ANY indication from either of those two total early-morning periods that I had myself been subjected to ANY alleged molestation of myself by anyone, ANY alleged personal-injury crimes victimizing myself, or ANY alleged anal-rape crimes victimizing myself during my sleep on either of those two total early-morning periods.

Investigator Carter, this is a follow-up letter to simply ask you to please confirm for me in writing that you received the five-page FAX I sent you on May 2, 2014, that contains a photocopy of a three-page, April 30, 2014-dated signed legal letter that City of Austin Assistant City Attorney Elaine Nicholson wrote and mailed by First Class Mail to Texas Attorney General Gregory Abbott of the Office of the Attorney General of Texas state agency in Austin.

I am referring to the three-page signed legal letter from Ms. Nicholson on official City of Austin Law Department stationery in which she asks Texas Attorney General Abbott to grant the City of Austin exemption from the Texas Open Records Act state law that requires the City to provide me with any and all documents responsive to my April 16, 2014, Texas Open Records request (below) --- a public-information request exclusively seeking documents referring to myself --- that I had written and submitted by E-mail to the Public Information Manager of the City of Austin Law Department at her cited official E-mail address of deborah.jennings@austintexas.gov.

For your convenience, I am including with this public-information request (below) a factual statement from myself about the March of 2011 exchange of brief E-mail notes between City Manager Marc Ott and Police Chief Art Acevedo that specifically referred to or directly related to myself, John Kevin McMillan of Austin.

Included in the scope of this public-information request is Mr. Ott's brief E-mail note to Police Chief Acevedo that City Manager wrote and sent to Cheif Acevedo on or about March 10, 2011, in a context referring to an e-mail complaint from myself, John Kevin McMillan of Austin.

My legal name is John Kevin McMillan. I have resided in Austin proper on a continuous and uninterrupted basis ever since mid-March 1997.

I am a lifelong single gentleman, and I am also a longtime celibate-by-choice single adult white non-Hispanic gentleman. I am a certified direct descendant of the Rev. William Brewster, who served as head chaplain on the Mayflower and the first full-term Puritan Governor of what is now the U.S. state of Massachusetts.

I am also the founder and only current approved member of a new and non-Christian "Honor Society" religion, the Progressive Prohibitionist Religion, which has very stringent membership-eligibility requirements.

I myself have resided in the same rental apartment unit---Apartment 325 in Building 3 of Wind River Crossing Apartments, 11411 Research Boulevard in northwest Austin---throughout Mr. Ott's entire tenure thus far as City Manager of Austin.

I moved into my current rental apartment unit as an official tenant here in January 2002. I have resided in this top-floor, vaulted-ceiling, one-bedroom (four total-room) rental apartment unit on a continuous and uninterrupted basis ever since then.

This public-information request from myself was prompted in part by the apparent decision by City Manager Marc Ott to not send me any reply note or reply letter of any type in response to the civilly-worded and polite one total public-policy-minded question I posed to Mr. Ott in an E-mail letter that I wrote and sent to Mr. Ott at his official City of Austin e-mail address on Sept. 9, 2014.

In that September 9, 2014, E-mail letter of mine addressed to City Manager Ott, I politely asked him whether Mr. Ott in his capacity as City Manager of Austin supports full privacy rights for myself, John Kevin McMillan, inside my bolt-locked bedroom of my rental apartment unit during any and all periods in which I am myself sleeping alone (and I ALWAYS sleep alone on a bed that I myself own) inside my bolt-locked bedroom.

Also, I would appreciate your please clarifying for me in writing the significance of the cryptic E-mail note that Austin Police Chief Art Acevedo wrote and sent to Austin City Manager Marc Ott on March 10, 2011, at 11:30:59 a.m. that day that related to my legal complaint to the City of Austin at that time about ongoing year-round background noise pollution, including throughout all of my leisuretime hours and all of my working hours at any workplace where I have ever worked in Austin at any time since 1997, most recently, that has been, and continues to be, significantly medically injurious to myself in Austin, Texas. I am not refererring to background Muzak (sp?) sound systems inside my workplaces, but instead to anonymous background noise pollution for which the source is not identifiable that has featured thousands of verbalized death threats against myself and profane or obscene verbalized communications inflicted on myself on many thousands of occasions as well.

In regard to that March 10, 2011, E-mail note from APD Chief Acevedo to Austin City Manager Marc Ott, the E-mail note contains only one item---the number "4", followed by a period.

Ms. Godfrey, would you please send me a reply letter explaining to me what that number "4" signifies or means or implies?

Incidentally, I would like to take this opportunity to clarify the point that your letter to me below (see below) does at one point refer to a letter to the Attorney General of Texas state agency that the City Government of Austin has in fact submitted, a letter in which the City of Austin is requesting legal authorization from the Attorney General to withhold from myself, John Kevin McMillan, legal documents that were included in the scope of my cited January 10, 2012, Open Records request to the City of Austin.

In regard to the cited continuous noise pollution victimizing myself, I should mention at this time that I first complained about unwanted noise pollution in my leisuretime during a time period (May of 1987) of my life in which I resided alone in Quincy, Massachusetts. I am a lifelong single adult gentleman, and I have never been married to anyone.


I have also filed numerous formal criminal-law complaints with the Austin Police Department, including on April 28, 2011, and on December 21, 2011, in which I have formally alleged to that municipal law-enforcement agency in Austin, Texas, that I myself have been victimized by illegal continuous sexual anal rapes of myself and alleged continuous sexual molestation of myself and alleged physical abuse of myself on a daily basis during my nocturnal sleep and alleged break-ins into my bolt-locked, locked, and fully-secured, vaulted-ceiling and top-floor apartment unit by illegal intruders unbeknownst to myself, on a daily and year-round basis, with the only cited apparent exceptions of the mornings of September 3, 2011, and September 10, 2011, when I woke up on my Swedish bed on each of those mornings with a feeling of great relief that no one had sexually raped me or sexually molested me on either of those mornings as I slept alone on my Swedish bed inside my one-bedroom apartment unit. On each of those two total days in 2011 (Sept. 3 and Sept. 10), I felt very hopeful when I woke up on my bed and did not feel that I'd been sexually molested during my sleep, that this indicated to me that the Austin Police Department had finally arrested a suspect in connection with the alleged continuous alleged sex crimes allegedly victimizing myself during my nocturnal slumber, with myself apparently snoring at the time, that I had repeatedly complained about to APD. Most recently, I still have not been provided with or informed about results of medical testing by the Texas Department of Public Safety on the numerous DNA medical swabs of several portions of my body that were diligently taken by a female forensic nurse in the early morning hours of December 22, 2011, inside the Emergency Room of St. David's Medical Center near The University of Texas at Austin. I have since been informed in writing this week by a female patient services representative for St. David's that those DNA medical swabs of my anus, my buttocks, and other parts of my body would have been promptly shared with the Texas Department of Public Safety state agency in Austin for testing and analysis of those DNA medical swabs.

I should also mention, incidentally, that I myself reside in a nice apartment unit at a large apartment complex that is owned by a company (Westdale Properties, or some similar name) that is headquartered along Commerce Street in Dallas, Texas. In the last few weeks, I received a reply E-mail letter from a nice assistant manager of my apartment complex, informing me in writing that it is "against policy' for the apartment management team here to pursue any special additional measures to protect my personal security inside my one-bedroom apartment unit, since the management company here has already complied with state law by providing my apartment unit with a bolt lock and a lock to my front door, she pointed out in writing. Please let me know if any of you would like to receive a copy of that particular E-mail reply letter I've recently received from an assistant manager at my apartment complex.

This public-information request was also prompted in part by a copy of an official 2016 e-mail referring to myself that I received through a public-information request I submitted to the City of Cedar Park (TX).

The e-mail letter was written by a public official who previously had served as Assistant Chief of Police in Austin, Texas, during Art Acevedo's prior tenure as Chief of Police for Austin. That public official was Sean Mannix.

The e-mail was written and sent by Cedar Park Police Chief Sean Mannix to Leander (TX) Police Chief Greg Minton, and, apparently, to each and every one of the police officers under Chief Mannix's supervision in the Cedar Park Police Department.

The following is the exact text of that 2016 e-mail communication from Cedar Park Police Chief Mannix, with a copy of this legal document having been sent to me by Cedar Park City Secretary Quinn, in response to an August 13, 2016 e-mail public-information request from myself:

All I had asked the City Government of Austin to do in the cited December 5, 2016, Open Records request I wrote and sent to the City's public-information office, was to provide me with actual COPIES OF LEGAL DOCUMENTS citing exactly when and to which specific DNA lab the Austin Police Department's Sex Crimes Unit in the year 2016 reportedly sent the Dec. 22, 2011, rape-evidence kit for APD Sex Crimes Case 11-3550615 for processing.

I AM VERY AWARE THAT SOME CITY OF AUSTIN OFFICIALS MAY ASSUME THAT THE ATTORNEY GENERAL OF TEXAS WON'T HELP ME TO GET RESULTS ON THIS.

John, here’s the deal. If you want to post your columns, you can do so on the NSNC’s FB page, Columnists’ Clubhouse, where many columnists post their works.

But please remove it from director@columnists.com and from suzmar@comcast.net. I’ll see you on that page instead, OK?

---Patricia H. Smith, who last year reportedly retired as Executive Director of the Texas Library Association in the Austin area of Texas. Ms. Smith sent me two rejection letters in 2018, one of them in April 2018 and the second dated June 16, 2018.
Each of those rejection letters to me were sent from an e-mail address I had used in writing to her: pats@txla.org . Ms. Smith has reminded me in writing that since she is no longer executive director of the Texas Library Association, that e-mail address for her is no longer applicable, she indicated to me in writing this year.
 Because of an oversight on my part, it was not until I received that second e-mail rejection note from Ms. Smith in June 2018 that I did succeed at taking immediate action to permanently remove her name from my e-mail contacts list through my internet services provider. Even though I have had some technical difficulties in achieving that objective through my internet service, I feel sure now that I can remember to never again send any item to anyone by the name of Patricia H. Smith who is identified to me as being a former Executive Director of the Texas Library Association.
