Dear Mr. Armendariz,

Thank you for your e-mail reply letter (below), which apparently indicates that the actual owner of the current apartment complex where I am residing, Village Oaks Apartments at 10926 Jollyville Road in Austin District 10, is the AT&T corporation in New Jersey.

Are you referring to the very same AT&T for-profit corporation with which I am a longtime customer paying each month for landline-telephone service, Internet service, and cable-television service?

Sincerely and Best Wishes,

John Kevin McMillan, a rent-paying approved resident at Village Oaks Apartments, 10926 Jollyville Road, in northwest Austin ever since late September 2015. Ever since Sept. 5, 2017, I have been an official rent-paying tenant at Apt. 1609 of Building 16 at Village Oaks.

Mr. McMillan, as far as I can tell, your apartment complex does not receive any federal housing assistance (I.e. tax credit, etc.) so it would not fall under any federally regulated agency (that I can glean).

As such, it is merely a private-sector apartment complex, a privately held corporation owned by:

A T & T CORPORATION
TAX DEPT
PO BOX 7207
BEDMINSTER , NJ 07921-7207
See: http://propaccess.traviscad.org/clientdb/Property.aspx?prop_id=842669&year=2017

So, when you use the term “regulate” it depends upon what you are referring to. For example, the Texas Secretary of State (SOS) regulates corporation registrations. If the apartment complex allowed it’s corporate registration to lapse, you could report them to the SOS. For a very small fee, you can look up their corporate filing here: https://www.sos.state.tx.us/corp/sosda/index.shtml.

But if you are worried about health and safety, you would call Austin Code Enforcement (dial 311) as they are the agency that regulates residential (and corporate) establishments for health and safety issues (I.e. water leaks, pest infestations, electrical problems, structural problems, etc.).

But if you believe that the staff at the apartment complex are acting in a fraudulent manner, you would probably do well to report them to the Texas Attorney General here: https://texasattorneygeneral.gov/cpd/file-a-consumer-complaint.

As you can see, there is no one good answer for all issues that may relate to the apartment complex. In short, there is no single agency dedicated to regulating the apartment rental industry.

If you have any further questions regarding your residential tenancy, please direct them to the counseling line at: 512-474-1961. By our policy, I cannot continue to counsel you over email.

Hope this helps.

Dear Mr. Armendariz,

Thank you for your prompt reply note to me.

If you will permit me to rephrase my question to you, I would like to ask you the following:
Do you know which government agency or agencies have regulatory authority or legal jurisdiction of some type over the large corporate-owned apartment complex in northwest Austin where I am currently residing as a rent-paying official tenant in a rental unit situated inside one of the numerous multi-unit residential buildings of that complex?

I hope to hear from you soon.

Sincerely and Best Wishes,

John Kevin McMillan.

Dear Austin Tenants' Council Representatives in Austin, Texas,

A very helpful female telephone reference librarian for the Austin Public Library, Jennifer, has referred me this evening to your Austin Tenants' Council.

Jennifer stated to me that your non-profit group might be the best organization for me to contact in order to myself find out which government agency or agencies have regulatory authority or legal jurisdiction of some type over the commercial real estate property in northwest Austin where I am residing as one of the rent-paying official apartment-unit tenants.

I reside in Austin District 10. I am not currently able to contact my duly elected Austin City Council member, Dr. Alison Alter, about this issue.

Council Member Alter in March 2017 reportedly prohibited me from ever again contacting her, according to another City of Austin official who made an on-duty official visit to my apartment unit at about 8:20 a.m. Thursday, March 9, 2017, in order to offer that verbal warning to me in person. I will gladly provide your organization with the name of the City of Austin representative who offered me that verbal warning, should your group ever seek that information from me at any time.

Nor am I currently able to contact the Austin City Manager's Office for factual information about the above-cited jurisdictional or regulatory issue.

A City Government of Austin official (whose name I will gladly provide you upon request) stated to me in person during an official on-duty visit he made to my apartment unit at about 9:20 a.m. Thursday, November 30, 2017, that Austin Interim City Manager Elaine Hart and City Manager's Office staff member Amy Teel (and apparently also including each of Ms. Hart's current Assistant City Managers and all other City Manager's Office staff members) are now prohibiting me from ever again contacting any of them about any subject or in any context, according to that City Government of Austin official.

I am gainfully employed and dependably civil and honest and law-abiding, and I do not have any criminal-conviction record. I might add that I myself am not under custody of any type by any law-enforcement agency anywhere in the world. Nor are there any pending charges against me.

I hope to hear from you soon in response to this one total request for information about jurisdiction that I am making to your group in this follow-up letter from myself.

Sincerely and Best Wishes,

John Kevin McMillan.
