My online Open Records Complaint I filed today with the Attorney General of Texas against the Travis County District Attorney's Office Public Information Coordinator in Austin, Texas

I am so glad that I received respective official online and e-mail confirmations at 2:58 a.m. Mountain Time today (Friday, February 17) that the Attorney General of Texas has received my Open Records complaint against the Open Records Coordinator for the Travis County District Attorney's Office in Austin, Texas.

My online complaint stated that the DA's Office in Austin had failed to send me any written reply to my January 20, 2023, Travis County DA's Open Records request focused exclusively on myself during the time period from January 1, 2021, through January 16, 2023.

My complaint alleged that the "no reply" toward me by the DA's Office Open Records Coordinator (the exact name of that designated official being unclear to me when I filed my online complaint today through the Texas Attorney General, so I cited the name of the Executive Assistant to the District Attorney in my online legal complaint today) had occurred despite a courtesy follow-up note I had written and e-mailed to that DA's Office's Open Records Coordinator on February 10, 2023.

The e-mail reply I received today from the Attorney General of Texas in regard to this Open Records Complaint of mine against the Open Records Coordinator for the Travis County DA's Office in Austin:

I still have not received any reply letter from you that confirmed your receipt of my January 16, 2023, Open Records request to your DA's Office in the state capital city of Texas.

If I do not hear back from you by the close of your business day on Monday, February 13, I will have no choice but to myself submit a written Open Records complaint to the Attorney General of Texas.

Also, please let me know as soon as possible if you yourself are planning to seek official permission from the Attorney General of Texas to withhold from me one or more of the legal documents on file with your DA's Office that are responsive to my January 16 public information request.

Thank you in advance for your prompt reply letter to me on this.

Incidentally, please note the bold-faced typographical correction I have inserted into the following paragraph in that January 16 Open Records Request:

"--Did the Travis County District Attorney's Office under Mr. Garza's leadership obtain any credible evidence that I myself was victimized by one or more alleged home-invasion-related sexual assault crimes or other alleged felony sex crimes or felony personal injury crimes during my continuous and uninterrupted period of residence in Travis County, Texas, that occurred from mid-March 1997 until December 31, 2021, the date when I relocated to Utah by airplane?"

---What prompted Henry Kellison, the polite Executive Assistant to Travis County District Attorney Jose Garza, to state to me on my cell phone in early April of 2021 that I myself am the complainant --- NOT the defendant, he emphasized to me on the phone in 2021 --- in a felony "home invasion crimes" case?

----What prompted Mr. Kellison of your DA's Office in Austin to specifically state to me on the telephone on April 6, 2021, that he wanted me to "hire a criminal-defense attorney" to represent me in planned communications with the DA's Office in Austin in the above-cited context in which I myself would be the cited criminal-law complainant?

--Did the Travis County District Attorney's Office under Mr. Garza's leadership obtain any credible evidence that I myself was victimized by one or more alleged home-invasion-related sexual assault crimes or other alleged felony sex crimes or felony personal injury crimes during my continuous and uninterrupted period of residence in Travis County, Texas, that occurred from mid-March 1997 until December 31, 2021, the date when I relocated to Utah by airplane?

---Does Travis County DA Garza believe that continuous stress-inducing medically injurious noise pollution that I did not generate or want, and to which I was subjected in Travis County, Texas, for many years, including at my respective workplaces in Austin, involved alleged criminal-intent toward me by numerous persons?

---Does DA Jose Garza believe I myself was stalked by anyone in Travis County, Texas, who attempted to prevent me from developing a mutual-consent social life and a mutual-consent romantic life in Travis County?

---Is Travis County District Attorney Jose Garza aware that a first-rate attorney in Houston, Texas, Arnold G. Polanco, on June 6, 2008, advised me on the telephone from his Ross Banks Law Firm office (office phone number 713-626-1200) that it is illegal in Texas for a government agency to subject me to continuous verbal communications in any context after continuous electronic surveillance of myself had already been authorized by a government agency?

---Does Travis County DA Garza know what prompted W. Rick Copeland, then the agent in charge of the FBI office in Austin, Texas, to state to me on the telephone in the late 1990s, when I called him from inside a University Federal Credit Union location in north central
Austin, that unless I myself was involved in "illicit drug trafficking" --- and I most definitely was NOT --- it would be illegal for the government in Texas to subject me to continuous electronic surveillance of myself?

Thank you for your most recent reply letter stating that my proposed possible narrowing of the scope of my public-information request to you would still require me to pay you $498.60 in advance in exchange for e-mail letters on file in your Office of the General Counsel that refer to me by name.

If you have any suggestions for me on how I could narrow the scope of my request while also significantly reducing the amount of money I would need to pay you for your final written response to my request that provides me with any an all responsive e-mail letters that refer to me, I would be very grateful.

I would also appreciate it if you would please confirm for me in writing that your TDCJ Office of General Counsel is aware that:
---I myself am NOT a convicted felon;
---In my entire life thus far, I have never on any occasion ever once been charged with any felony crime;
---I myself do not have any criminal conviction record;
---The most recent and only year in which I was employed full-time by your state agency was the year 1999, when I resided in Austin;
and that
---I myself have never been present inside any courtroom anywhere in Texas in which I myself was asked to testify on behalf of the prosecution or in which I myself was officially cited as having been a victim of one or more alleged felony crimes.

Thank you for your reply letter (below) today and accompanying attachment you sent me today that contained a three-page invoice for me from TDCJ Assistant

General Counsel William Overton.

That three-page signed invoice states that your public law office is now asking me to pay your Office of General Counsel in advance a total of "$498.60" in exchange for:

"a copy of any and all e-mail letters and other written communications or legal records that were written, generated, compiled, received, sent, FAXed or mailed by any staff member or official of your TDCJ Office of General Counsel in Huntsville during the time period from January 1, 2015, through the present and that in each and every such a case referred to me (John Kevin McMillan) at least once in any manner or any context" and

"a copy of each and every document I (John Kevin McMillan) wrote that was received by your Office of General Counsel in Huntsville, including any and all public-information requests that I wrote and submitted to your state agency headquarters during the time period ever since January 1, 2015, and any and all written communications during that time period between your public law office and the Attorney General of Texas state agency that referred to me or to a public information request of mine."



I am hereby respectfully narrowing the scope of my February 7, 2023, follow-up public-information request to solely and exclusively include:

CITY OF AUSTIN LAW DEPARTMENT SENDS ITS 13TH LEGAL LETTER IN THE MOST RECENT 8-YEAR PERIOD TO TEXAS ATTORNEY GENERAL PAXTON THAT SEEKS PERMISSION TO DENY ME ACCESS TO LEGAL DOCUMENTS ON FILE WITH THE CITY THAT EACH DIRECTLY REFER TO ME


I find it fascinating to note that the City Government of Austin (TX) Law Department this month has submitted yet another legal letter to the Attorney General of Texas --- at least the 13th such legal letter (see below for details) to the Attorney General from the most recent eight-year period that directly refers to me by name --- in which the City of Austin is once again seeking permission to withhold from me cited legal documents on file with the City that directly refer to me.

Here is a summary of the multi-year history of the City Attorney's Office in Austin, Texas, responding to public-information requests from me by seeking official permission from the Attorney General of Texas to withhold from me legal documents on file with the City Attorney's Office that each directly refer by name to myself, John Kevin McMillan of Austin, Texas:

JUNE 8, 2020:
Austin Assistant City Attorney Neal Falgoust on June 8, 2020, signs and mails to Texas Attorney General Ken Paxton a written request for official permission to withhold from myself, public-information requestor John Kevin McMillan of Austin, legal documents on file with the Austin-Travis County Emergency Medical Services Department that directly refer to me by name.
The cited ID number on my public-information request that was received by the City of Austin on May 22, 2020, is: C069056.
"The City believes the information at issue is excepted from required public disclosure under section 552.101 of the Government Code.
"This letter is a request for a determination under section 552.301 of the Government Code that the information at issue is so excepted. A copy of each request and a representative sample of the information at issue are enclosed. ...
"Section 552.101 of the Government Code excepts from public disclosure 'information considered to be confidential by law, either constitutional, statutory, or by judicial decision.'...", Assistant City Attorney Falgoust stated in his signed legal letter to the Attorney General of Texas.

DECEMBER 3, 2019:
Austin Assistant City Attorney Zachary Brown on December 3, 2019, signs and mails to Texas Attorney General Ken Paxton a signed two-page request for official permission to withhold from myself, public-information requestor John Kevin McMillan of Austin, legal documents on file with the City Attorney's Office for which Mr. Brown maintains in writing that their confidentiality is protected by attorney-client privilege.

In his December 3, 2019, legal letter to Attorney General Paxton, Assistant City Attorney Brown states: "The information at issue consists of e-mail communications between attorneys in the City's Law Department and City employees in their capacity as client representatives. These communications were made in order to facilitate the rendition of legal services to the City. These communications were intended to be confidential and have remained confidential. Accordingly, the City (maintains that it) may withhold the information under section 552.107(1) of the Government Code."

The City Attorney's Office's request for a decision from the Attorney General on this was in response to a public-information request of mine to the City Attorney's Office that was received by the City of Austin law department on November 15, 2019 (PIR Number X004560).

MAY 20, 2016:
On that date, Assistant City Attorney Elaine Nicholson of the City Attorney's Office in Austin, Texas, signs and sends an official legal letter to Texas Attorney General's Office that seeks official permission from that state agency to withhold from myself, public-information requestor John Kevin McMillan of Austin, cited legal documents on file with the City Attorney's Office at that time that directly refer to myself.

The cited reason for Ms. Nicholson's request: that the cited documents are protected from disclosure because they meet the criteria for "attorney-client privilege."

The cited legal documents contain communications directly referring to myself, Austin resident John Kevin McMillan, that reportedly involve attorneys in the City Attorney's Office and City of Austin employees in their capacities as clients seeking legal advice from those attorneys.

The City's request for an Open Records ruling from the Attorney General on this was prompted by a May 9, 2016-dated e-mail public-information request from myself---a request that was received by the City on May 10, 2016.

MARCH 1, 2016:
City of Austin Law Department Assistant City Attorney Elaine Nicholson, in a signed three-page March 1, 2016-dated official legal letter to Texas Attorney General Ken Paxton, seeks written permission to withhold from myself, public-information requestor John Kevin McMillan of Austin, Texas,"confidential communications between and amongst the Law Department and Austin Police Department (that each specifically refer to John Kevin McMillan of Austin)."

My legal name is John Kevin McMillan. My date of birth is April 27, 1957. I was born in Lincoln, Nebraska. I am the founder and only member of the still-one-member-only and non-proselytizing Progressive Prohibitionist Religion, a religion with very strict membership-eligibility requirements. That one total religion of mine is not open to any prospective additional member for at least one year after I myself conclude that I have full and year-round access to fully reliable news and information in my own living and housing conditions.

My most recent address when I lived in Austin was 8805 North Plaza Drive, Apt. 2418, Austin, Texas 78753.
