Dear Travis County Housing Authority Executive Director Howard,

Thank you for taking the time to talk with me on the telephone from your county government office for about 15 minutes today, beginning at 11:45 a.m.

I appreciate your kind statement to me on the phone today that you will pursue some factual research on my behalf to attempt to identify any governmental program that can help me to keep any and all alleged home-invasion-crimes perpetrators, any and all alleged  trespassers, any and all unwanted-nasal-inhalant-spray "medical services" providers, any and all alleged personal-injury-crimes perpetrators, and any and all alleged rapists AWAY from any portion of the interior of my current bolt-locked apartment unit.

I value benefiting from full privacy rights for me during any and all of my sleeping hours as I lie alone on my own bed inside my bolt-locked apartment unit. I am the only official rent-paying tenant, and only approved occupant, residing in my current efficiency apartment at Pebble Creek Apartments, 8805 North Plaza Drive, in north Austin.

My current rental unit is located in Travis County Precinct 1, and City of Austin District 4. My current duly-elected County Commissioner is Jeff Travillion; my current duly-elected City Council Member is Greg Casar.

As I mentioned to you on the phone, Mr. Howard, my current solo-occupancy (myself, only) efficiency apartment unit at Pebble Creek Apartments is very comfortable and pleasant during my waking or conscious hours. It is only during my bedtime hours, as I lie alone asleep, unconscious, and probably also snoring, on my own bed inside my bedroom, when the cited problems have been occurring for me.

Please do not hesitate to call me or write to me if you need any additional factual information from me.

Sincerely and Best Wishes,

John Kevin McMillan, a former full-time employee in Austin of the Texas Department of Public Safety state agency.

To: Open Records Coordinator,
Travis County District Attorney's Office,
Open Records Division,
P.O. Box 1748,
Austin, TX 78767

October 24, 2019

Dear Open Records Coordinator for the Travis County DA's Office,

This is a Texas Open Records request in which I seek to obtain from you a copy of any and all e-mail communications that were written or received or forwarded by any investigator or other staff member or official of the Travis County DA's Office Sex Crimes Unit at any time since 8 a.m. January 3, 2017, that, in each and every such case, refer at least once in any manner to myself, John Kevin McMillan of Austin, Texas, or to APD Sex Crimes Case Number 16-1340923 in which I am the longtime-celibate-by-choice, permanently-alcohol-free, single-by-choice, adult Anglo male complainant.

My legal name is John Kevin McMillan. My date of birth is April 27, 1957. I am a native of Lincoln, Nebraska.

I have most recently resided here in Austin, Texas, on a continuous and uninterrupted basis ever since mid-March 1997.

My three respective mailing addresses as an official rent-paying apartment tenant or management-approved rent-paying occupant on a multi-month basis in the period ever since January 3, 2017, have been:
---Village Oaks Apartments, 10926 Jollyville Road, Apt. 902, Austin, TX 78759;
---Village Oaks Apartments, 10926 Jollyville Road, Apt. 1609, Austin, TX 78759;
and, ever since June 21, 2019, Pebble Creek Apartments, 8805 North Plaza Drive, Apt. 2418 (a second-floor, eastward-facing unit in Building 17), Austin, Texas, 78753.

I have maintained the same personal e-mail address of "mcmillanj@att.net" throughout the entire period ever since January 3, 2017.

On October 17, 2019, I also obtained a new personal e-mail address for myself of "goody2shoes2019@gmail.com", which now gives me the opportunity to also receive and send e-mails through my first-ever cell phone that I purchased through AT&T in August 2019.

My landline home phone number of (512) 342-2295 remained the same throughout my entire multi-year period as an official rent-paying tenant or rent-paying approved occupant at each of my two respective rental units at Village Oaks Apartments and, more recently, has also continued for me as a rent-paying official tenant living alone at Pebble Creek Apartments in Austin District 4.

My first-ever and new cell phone, which I have been using ever since August 15, 2019, has a phone number through AT&T, my cell-phone service provider, of (512) 993-7305.

I myself do not have any criminal-conviction record.

Among the insights I hope to glean from this public-information request are:

---Has there been any investigator or official of the Travis County DA's Office Sex Crimes Unit who believes or suspects that I myself have been and continue to be a victim of alleged continuous, daily-and-year-round sex crimes and other personal-injury-crimes allegedly being perpetrated on me during my sleeping hours on a nightly basis as I lie or lay alone, asleep and unconscious, on my own bed inside my bolt-locked rental apartment unit in Austin?

--Has Investigator Dave Mahoney of the Travis County District  Attorney's Office Child Abuse Unit ever written or sent or received any e-mail letter to the Travis County DA's Office Sex Crimes Unit that refers at least once to myself, John Kevin McMillan of Austin?

---Has there been any investigator or official of the Travis County DA's Office Sex Crimes Unit who suspects or believes that I myself have been subjected against my wishes to unauthorized and injurious "medical-services" that have included unwanted nasal inhalants and unwanted oral inhalants and unwanted liquids injected into my nostrils or mouth, all during my sleeping hours, as I lie alone, asleep and unconscious and probably also snoring, on my own bed inside my bolt-locked apartment in Austin?

---Has there been any dialogue within the Travis County DA's Office Sex Crimes Unit in regard to whether the alleged nasal inhalants to which I have been subjected against my wishes during my sleeping hours inside my bolt-locked apartment unit have allegedly played a role in myself being held unconscious while being subjected to alleged sex crimes and alleged personal-injury crimes  during my bedtime hours inside my bolt-locked apartment unit?

--Has Travis County District Attorney Margaret Moore sent any e-mail note to the Travis County District Attorney's Office Sex Crimes Unit in which she has stated in writing whether she is willing to prosecute in a court of law in Austin, Texas, at least one of the individuals who have allegedly illegally entered and allegedly trespassed inside my bolt-locked apartment unit and have allegedly subjected me to alleged sex crimes and other personal injury crimes during my sleeping hours inside my bolt-locked rental-apartment unit in Austin, Texas?

--Has Travis County District Attorney Margaret Moore ever written and sent any e-mail note to the Travis County DA's Office Sex Crimes Unit in which she expressed considerable concern that alleged home-invasion crimes and alleged personal-injury crimes and alleged hate crimes allegedly victimizing me during my sleep inside my bolt-locked apartment unit, as I lay ALONE on my own bed, have allegedly played a role in my having received five separate respective doctor-ordered surgeries for life-threatening medical problems inside local hospitals in the period ever since February 2016?

---Has Travis County District Attorney Margaret Moore stated in any e-mail to the Travis County DA's Office Sex Crimes Unit that she believes or suspects that I myself have been victimized by one or more forms of elder abuse --- I myself being a 62-year-old gentleman at present --- that are also in flagrant alleged violation of the law?

--Has Travis County District Attorney Margaret Moore stated in any email she sent to anyone employed in the Travis County DA's Office Sex Crimes Unit that she believes or suspects that my own status as a biological male, as a law-abiding opponent or critic of sex-change operations, as a citedly "prejudiced" person, as a citedly "homophobic" or "anti-gay" or "racist" person, or as the founder and sole current member of a new and non-Christian "Honor Society" religion with very stringent membership-eligibility requirements that favor law-abiding heterosexual men and law-abiding heterosexual women as prospective future new members, may have allegedly played a role in APD's apparent unwillingness to arrest any suspect in the continuous sex-crimes case from 2016 in which I myself am the cited single adult Anglo male victim?

---Has there been any dialogue among investigators and officials of the Travis County DA's Office Sex Crimes Unit in regard to what the time-deadline-related requirements and other legal requirements are, if any, for prosecuting a rape case in Austin that has been determined to be a continuous-and-still-continuing sexual-assault case?

---Has there been any dialogue between the Travis County District Attorney's Office Sex Crimes Unit and the Federal Bureau of Investigation in regard to what prompted the Federal Bureau of Investigation of the United States Government to provide me with an "intake" interview on the telephone with a female FBI staff member on Monday, September 23,  2019, in regard to APD Case 16-1340923, with that telephone interview having concluded politely at 10:30 a.m. September 23?

---Has there been any dialogue among staff members of the Travis County DA's Office Sex Crimes Unit in regard to whether at least one additional DNA-trace forensic rape-evidence medical exam on myself should or could be ordered by some official of Travis County Government in the very near future?

---Has there been any dialogue within the Travis County DA's Office Sex Crimes Unit in regard to whether there is a need for full 180-day or 190-day retroactive DNA-trace processing on each of the two total existing DNA-trace rape-evidence kits that were obtained from me by APD on April 28, 2011, and December 22, 2011, respectively, for APD Cases 11-1180447 and 11-3550615?

---Has there been any dialogue within the Travis County Sex Crimes Unit in regard to whether it would be legal and justifiable for either Travis County Government or the Federal Bureau of Investigation or a State Government of Texas agency to provide temporary 24-hour-a-day, seven-days-per-week electronic surveillance of the entire interior of my current rental-apartment unit --- an efficiency rental unit in which I myself am the ONLY current official tenant and the ONLY current official occupant?

---Has there been any dialogue within the Travis County DA's Office Sex Crimes Unit in regard to what the possible point or points of entry by a law-breaking trespasser into my current double-bolt-locked and fully-secured rental apartment unit might be or is or are at present, and whether there is some way for county government investigators to use technology available to the District Attorney's Office or the Sheriff's Office here in Austin to clearly identify the alleged points of entry being used by alleged trespassers allegedly breaking into my own current always-bolt-locked rental unit?

---Is there any evidence that any person employed in the Travis County DA's Office Sex Crimes Unit has indicated or stated that he or she does not believe my own repeated factual statements to APD and to the DA's office over a multi-year period about my being a longtime celibate, permanently-drinking-alcohol-free, permanently marijuana-free and permanently-illicit-drug-free, dependably civil and law-abiding and honest single adult gentleman who ALWAYS sleeps alone on my own bed inside my bolt-locked apartment unit in Austin?

---Is there any evidence that any person currently employed by the Travis County DA's Office Sex Crimes Unit has indicated or stated that he or she senses or has concluded that my own credibility as a criminal-law complainant and self-identified crime victim here in Austin has somehow been undermined or harmed, or, to the contrary, that my credibility as a criminal-law complainant has actually been strengthened significantly?

Thank you in advance for your very diligent and helpful reply letter providing me with any and all responsive legal documents.

Sincerely and Best Wishes,

John Kevin McMillan, a former full-time employee in Austin of the Texas Department of Public Safety state agency.

To: Open Records Coordinator,

Open Records Division,
P.O. Box 1748,

---Village Oaks Apartments, 10926 Jollyville Road, Apt. 902, Austin, TX 78759;
---Village Oaks Apartments, 10926 Jollyville Road, Apt. 1609, Austin, TX 78759;
and, ever since June 21, 2019, Pebble Creek Apartments, 8805 North Plaza Drive, Apt.

Dear Local, State, and U.S. Government officials,

A respectful FYI to each of you on the following (below) reply e-mail letter I received today from Mr. Michael G. Gerber, President and Chief Executive Officer for the Housing Authority of the City Government of Austin here in this state capital city for Texas.

Please note that Mr. Gerber in his reply letter directly referred me to the Austin Police Department in regard to allegedly unsafe sleeping conditions allegedly occurring on a daily basis as I lie alone on my own bed, asleep and unconscious and probably also snoring, in the bedroom of my double-bolt-locked current rental unit in Austin, Texas:

"If you (John Kevin McMillan, a gainfully-employed, single adult Anglo male resident of Austin District 4) are concerned about your safety while sleeping, or about people coming into your apartment, we encourage you to be in touch with the Austin Police Department...," Mr. Gerber stated.

I would welcome any reply note to me on any aspect of this that any of you are willing to offer me.

Sincerely and Best Wishes,
John Kevin McMillan.

Mr. McMillan – Our agency has no jurisdiction over your property.  If you are concerned about your safety while sleeping, or about people coming into your apartment, we encourage you to be in touch with the Austin Police Department or Austin-Travis County Integral Health, both of which may have resources to assist.  This will be the final communication from our agency.   Thank you.

Subject: Re: [Warning External Sender] 10-20-19 urgent question for each of your public housing authorities

October 22, 2019

Dear City Government of Austin Housing Authority Admissions Manager Paige Super and City Government of Austin Housing Authority President and CEO Michael Gerber,

Thank you for prompt reply note to me on this. One follow-up question for either of you two local government officials: Does either of you know of any government agency or individual or group of individuals or religious group or media company or civic group or other entity who or that currently has any jurisdiction or legal authority of any type over my own current housing conditions during my sleeping or bedtime hours per se?

I should mention, by the way, that my current efficiency apartment unit itself at Pebble Creek Apartments is very comfortable and pleasant for me each day before and after my bedtime or sleeping or napping hours inside my private bedroom.

I might add that it feels great to finally be living in a nice rental-apartment on a lease-agreement of my own after several years of my having had to share an apartment unit at another complex with a roommate because I could not financially afford to rent an apartment of my own during that prior time period. As the only official occupant and only official tenant in my current rental unit in north Austin, I find it very reassuring and truly wonderful to be completely sure whenever I go to bed that both of the bolt-locks I secured to the front door and all other points of entry into my unit that I have ever been informed about will each remain completely secured and locked throughout the entirety of my own sleeping hours.

I would like to clarify for you why I decided to politely contact (see my original October 20, 2019, e-mail letter on this, below) both your agency and the official respective representatives for two other respective public housing authorities with jurisdiction here in Austin: Patrick B. Howard, Housing Authority of Travis County, 502 East Highland Mall Boulevard, Austin, TX 78752. Office phone: (512) 854-8245; and Andre Adams, Texas Department of Housing and Community Affairs state agency, 221 East 11th Street, Austin, TX 78701. Office phone: (512) 475-3884.

I might add that I have not yet received a reply letter on this from either Mr. Howard or Mr. Adams. I am very hopeful, though, that each of those officials will soon be contacting me with a courtesy reply note.

My hope in contacting each of your public-housing authorities had been that some government agency with legal authority or jurisdiction here in Austin, Texas, would help me to keep any and all persons----including alleged intruders or trespassers or alleged "medical services providers" or alleged "educational" services providers or alleged "deprogramming services providers" or alleged "home-invasion-crimes" services or alleged "personal-injury-infliction-services" providers or alleged "punitive services providers" or alleged "vigilante services punishing John Kevin McMillan for being citedly too critical of or aesthetically and morally repulsed by many Austinites" perpetrators or alleged "citizen punishment of John Kevin McMillan in retaliation against him for opposing sex-change operations" perpetrators or alleged "attempted-relocation-services prompters" or alleged "sleep-ruination-infliction specialists" or alleged "religious conversion services specialists" or alleged "anti-religious services providers" or alleged "punishment of a heretic" services providers or alleged "punishment of a citedly prejudiced Texan" services perpetrators or alleged "punishment of a snitch" services perpetrators or alleged "Too Straight for Austin" retaliation services providers or alleged "defiant-of-privacy rights" perpetrators or alleged hostile-media-company invaders or alleged "anti-Anglo racial-antipathy services providers" or alleged "revenge infliction on a Puritanical Austinite gentleman by alcohol-and-tobacco-and-marijuana community services providers" or alleged "marijuana-community-hatred of an anti-illicit-drug-minded and illicit-drug-free-at-all-times gentleman" services providers or alleged "defiant of John Kevin McMillan's right to be live a celibate lifestyle" militants or alleged "anti-Yankee services providers" or alleged "harassment specialists" providers or alleged hate crime perpetrators or "attempted hounding of John Kevin McMillan out of Austin, Texas" services providers or alleged "abuse-of-a-senior-citizen services perpetrators" or alleged "thought-control-project" perpetrators or alleged "attempted euthanasia-in-slow-motion-services" perpetrators or alleged "political opposition infliction on a conservative left-wing gentleman" services providers -----AWAY from my very nice apartment unit in north Austin during my sleeping hours.

I always lie alone, asleep and unconscious and probably also snoring, on a bed that I myself own in the bedroom of my second-floor, eastward-facing apartment unit in north Austin. I might add politely that anywhere and everywhere in the Austin area and throughout all of Central Texas, I myself have been completely celibate, with ZERO sexual contact between myself and any other person, throughout any and all of my own conscious or waking hours ever since late December of 1979; and I am a single-by-choice, gainfully employed (exclusively in the local restaurant industry) white adult gentleman.

Many Austinites are aware that I myself am the founder and only current approved member of a new and non-Christian Honor Society religion, the Progressive Prohibitionist Religion---a non-proselytizing religion with very strict membership-eligibility requirements. Those eligibility requirements are so stringent that I would estimate that 99 percent or more of all adult Austin residents whose own conduct might conceivably meet the criteria for my own religion are, in fact, heterosexual in sexual identity per se.

My fully independent "Progressive Prohibitionist Religion" strongly opposes the infliction of anonymous communications or noise pollution or fraudulent communications on anyone, including during their bedtime hours, in a context that violates the privacy rights of the person being subjected to those communications.

I have personally delivered televised local Community Access television speeches here in Austin on behalf of my one-member religion in the late 1990s and in 2000. I myself lead a facially-cleanshaven (no beard, no mustache, no goatee) and anti-facial-hair-minded lifestyle. I also lead a permanently marijuana-free and anti-marijuana-minded, permanently-illicit-drug-free and anti-cocaine-minded, lifelong-tobacco-free, and permanently drinking-alcohol-free lifestyle; and I am NOT a "recovering alcoholic" or "former alcoholic" or "former drug addict" or "recovering drug addict". I also lead a consistently clean-talking lifestyle in which I do not verbalize profanity in my everyday conversations with others.

Thank you again for your courtesy reply note to me. I hope to hear from you soon in response to my follow-up question.

Sincerely and Best Wishes,
John Kevin McMillan.

Good morning-
I am sorry to hear about your situation. As Mr. Gerber was saying,  the Austin Tenant's Council and Rio Grande Legal Aid are excellent resources available free of charge, so I would recommend contacting them for representation.
Our agency does not offer immediate or emergency housing; however, we do have several waiting lists that are currently open and you can apply by going to www.hacaapply.org.  I have also attached a list of community resources for you, and the Tenant's Council resource listing for additional housing options in the area.
I hope this helps.  Best of luck to you.

Mr. McMillan – Thank you for your note.  Unfortunately, the Housing Authority of the City of Austin does not have any relationship or involvement with your apartment complex.  I am sorry we are not able to assist.  You may wish to consult with Rio Grande Legal Aid or with the Austin Tenants Council.  Both of these organizations do excellent work to protect tenants experiencing difficult situations.

I have also copied Laura Bodai and Paige Super with our Admissions Team.  Laura or Paige will be in touch with you directly with information regarding our programs.  Unfortunately, we have extensive waitlists, so we encourage you to contact other affordable housing providers in our community as well.

October 20, 2019.

Dear Mr. Gerber, Mr. Howard, and Mr. Adams,

I obtained each of your names at a website (below) to which I was referred in the last several days by the National Center on Elder Abuse at the University of Southern California in the Los Angeles area.

I am very grateful to that very kind and noble organization for their potentially life-saving referral they offered me in regard to my search for safe-sleeping-conditions housing accommodations for myself in Austin, Texas:

I would appreciate learning from each of you whether your own public housing authority here in Austin has any legal jurisdiction over any aspect of my current housing conditions in  north Austin? If so, in which ways can you help to ensure completely safe and unharassed sleeping conditions for me inside my current double-bolt-locked efficiency apartment unit at Pebble Creek Apartments?

If not, could any of your public housing authorities please help me to fully comply with my current rental-housing lease agreement while also obtaining in the foreseeable future an affordable solo-occupancy rental-housing unit for myself in Austin, Texas, where I could sleep or nap alone on my own bed without ANYONE but myself ever at any time being physically present anywhere inside my bolt-locked rental-housing unit during my bedtime hours or napping hours?

I am a celibate-by-choice and longtime celibate, psychologically healthy, platonicly polite, single-by-choice, permanently drinking-alcohol-free (ever since the late summer of 1990), lifelong-tobacco-free, lifelong-illicit-drug-free in regard to any and all illicit drugs other than marijuana, permanently-marijuana-free ever since the late fall of 1984 and anti-marijuana-minded, facially-cleanshaven, lifelong-tattoo-less, consistently-clean-talking (no profanity or obscene speech by me in my everyday conversations with others), dependably civil and law-abiding and honest, gainfully-employed, white Anglo-Saxon gentleman of English, Scottish, and German ancestry. I myself do not have any criminal-conviction record, and I strongly support law enforcement.

I have been employed in the restaurant industry in Austin on a continuous and uninterrupted basis ever since my birthday, April 27, in 2002. This 21st Century, I have been a dues-paying individual member of the Texas Restaurant Association for one year. However, I am not currently an official member of that admirable and people-friendly statewide organization promoting excellence in Texan restaurants.

I feel very strongly that my job performance as a restaurant-industry employee will be greatly enhanced if I can get a full seven or eight hours of uninterrupted sleep every night without being being awakened several times a night with mysterious pain in my anus or an unpleasant vibrating sensation in my anus, pain in my legs, an unpleasant nasal-inhalant sensation in my nostrils, wobbliness in my legs, and an urgent need to urinate.

I have provided to the Austin Police Department four separate flashdrives of factual evidence showing that one or more alleged illegal trespassers have secretly and surreptitiously entered my own bedroom during my sleeping hours. I provided APD with that crime evidence in connection with APD Sex Crimes Case 16-1340923.

The kindly general manager at my current apartment complex, Juan Acosta, and his polite assistant managers have assured me during recent visits I've made to their management team office that no one but me is authorized by their management team to be physically present anywhere inside my double-bolt-locked apartment unit at Pebble Creek Apartments at any time during my bedtime hours. My bedtime hours generally occur between the hours of midnight and 9 a.m.

I have NOT authorized any person or entity to subject me to any nasal-inhalant services during my sleeping hours inside my current bolt-locked apartment unit. I myself DO NOT own or ever use nasal inhalants. I might add that I have NOT authorized any person or entity to subject me to any liquids being poured or injected into my mouth or bloodstream at any time during my sleeping hours inside my current bolt-locked apartment unit.

Thank you in advance to each of you public-housing officials for your very helpful reply note to me on this.

Sincerely and Best Wishes,

John Kevin McMillan.
