Dear John Kevin McMillan,

CITY OF MINNEAPOLIS ON JANUARY 27, 2018, RECEIVES FOLLOW-UP QUESTION ABOUT MINNEAPOLIS MAYOR BETSY HODGES' CHIEF OF STAFF, JOHN STILES, FROM CURRENT PUBLIC-INFORMATION REQUESTOR AND FORMER MINNEAPOLIS RESIDENT JOHN KEVIN McMILLAN OF AUSTIN, TEXAS

January 27, 2018

Dear Ms. Olson,

Thank you for inviting a follow-up question from me about your response (below) to my January 17, 2018-dated online public-information request (last item, below) to your city that was focused on John Stiles in his official capacity as Chief of Staff for Minneapolis Mayor Betsy Hodges.

That informational request from me had sought
"any and all of Mr. John Stiles's written communications, regardless of whom he sent them to or mailed them to or forwarded them to, that referred at least once to myself, former Minneapolis resident John Kevin McMillan of Austin, Texas, or my own living conditions in Austin, Texas, or my non-Christian 'Progressive Prohibitionist Religion'."

I was very surprised to be informed by you (below) that Mr. Stiles throughout the cited most recent approximately two-year period did not have any written response or written reaction of any type to any of the dozens of e-mail reports I sent to that Minneapolis Mayor's Office rep that referred to myself being a self-identified victim of daily and year-round and continuing alleged anal-rape-crimes and alleged personal-injury crimes allegedly occurring inside my locked apartment unit in the District 10 section of Austin, Texas.

As you may be aware, I earned a Master's Degree in Journalism and Mass Communications from the University of Minnesota's main campus in Minneapolis. I am also a former full-time newspaper reporter for the "New Ulm (MN) Journal" and a former freelance feature writer for the culturally-influential "City Pages" publication in Minneapolis. I am also a former faculty-appointed training director at the "Minnesota Daily" student newspaper on the University of Minnesota campus in Minneapolis.

Are you completely sure that Minneapolis City Hall official John Stiles did not write ANY response or reaction of any type that he shared with any other City of Minneapolis official, such as Minneapolis City Coordinator Spencer Cronk, or any constituent of Mr. Stiles, or any other government official, which referred in any way to the numerous reports I sent Mr. Stiles about myself being a victim of alleged continuous personal-injury crimes over a multi-year period in Austin, Texas, for which no arrest of any crime suspect by the Austin Police Department has ever occurred at any time?

Thank you in advance for your helpful reply note to me on this.

Sincerely and Best Wishes,
John Kevin McMillan.

"This is a public-information request in which I am seeking to obtain from the City Government of Austin a copy or photocopy or computer printout of any and all phone messages or E-mail correspondence or handwritten notes or letters or memoranda or reports or recommendations or other legal documents directly referring at least once to myself, John Kevin McMillan of Austin, in any manner or way, or directly referring at least once to my one-member (myself only) and non-Christian and anti-alcohol, anti-marijuana, anti-tobacco 'Honor Society' Progressive Prohibitionist Religion in any manner or way, and that, in each such case, were received or generated or produced or written or sent or E-mailed or mailed or forwarded at any time since 9 a.m. February 16, 2016, by any temp-agency employee or any other employee, such as any attorney or paralegal or administrator or other staff member, who was himself or herself employed or stationed in the City of Austin Law Department at City Hall in downtown Austin.

"EXCLUDED from the scope of this public-information request are any and all letters or E-mail letters that were exclusively written by myself, John Kevin McMillan of northwest Austin.

"My date of birth is: April 27, 1957, and my social-security number is: ..... I have resided in Austin proper on a continuous and uninterrupted basis ever since mid-March 1997. I am a lifelong single gentleman. I am also a lifelong non-Christian gentleman who myself has no criminal-conviction record. I am also gainfully employed and law-abiding and vigilant.

"This public-information request was prompted in part by a written public disclosure the City of Austin officially made earlier this year in response to a public-information request from myself.

"According to written information that was E-mailed to me by an official of the City of Austin Law Department, employees or officials of seven different departments of the City Government of Austin----those departments being the City Manager's Office, the Office of the Police Monitor, the Austin Police Department, the City of Austin Human Resources Department, the City Clerk's Office, the City of Austin Public Information Office, and the City of Austin Law Department in the form of intra-departmental consultations---over the course of the last approximately four-year period have each consulted one or more staff members or officials of the City of Austin Law Department (City Attorney's Office) specifically about myself, John Kevin McMillan of northwest Austin, on what were apparently dozens of total combined occasions.

"Additional factual information about those legal consultations about myself by numerous City of Austin employees in recent years is provided below, as a post-script message to this public-information request to the City of Austin.

"This public-information request is also prompted by the fact that the Austin Police Department (APD) has never informed me at any time in my entire life thus far that APD has ever on any occasion arrested any person or group of persons and formally charged that individual or that group of individuals with having allegedly wronged me in a context that allegedly violated the state penal code of Texas or, if applicable, federal law.

"Thank you in advance for your prompt and very thorough reply letter providing me with any and all documents responsive to this public-information request from myself.

"Sincerely and Best Wishes,

"This public-information request is also prompt"ed by the fact that the Austin Police Department (APD) has never informed me at any time in my entire life thus far that APD has ever on any occasion arrested any person or group of persons and formally charged that individual or that group of individuals with having allegedly wronged me in a context that allegedly violated the state penal code of Texas or, if applicable, federal law.

"Thank you in advance for your prompt and very thorough reply letter providing me with any and all documents responsive to this public-information request from myself.

"Sincerely and Best Wishes,

Dear TWC Open Records Coordinator,

This is a Texas Open Records request in which I seek to obtain from your state agency in Austin a copy of any and all written communications, including e-mail communications or letters or memoranda or advisory opinions, between or among Texas Workforce Commission state agency employees or officials at any time since 8 a.m. August 14, 2014, in which one or more TWC officials or TWC work supervisors or TWC attorneys in Austin have stated in writing that the Office of the Ombudsman of the TWC, or any other cited office or division or official or attorney of the TWC, is given permission by your state agency to, or is officially authorized by the TWC to, either impose an automatic block on one or more of the expected future incoming e-mails from myself, John Kevin McMillan of northwest Austin, or to automatically discard as "spam" one or more of the expected future e-mails from myself to any particular cited office or division or official of the TWC.

Included in the scope of this public-information request is the following (below) quoted text of a 2014 intra-agency written reply note that Texas Workforce Commission state agency General Counsel Paul N. Jones wrote and sent to TWC Civil Rights Division Director Lowell A. Keig.

The cited legal document was released to me in response to a March 2015 public-information request that I submitted to the TWC. According to online records for Mr. Keig, he is also cited as having served as the chair of the Health Law Section of the Austin Bar Association.

This public-information request is prompted in part by a December 13, 2017, e-mail Open Records response (below) I received from your state agency in Austin which stated that your agency's Office of the Ombudsman did not have any applicable documents generated by that TWC office which referred at least once to myself, John Kevin McMillan of northwest Austin.

The following contains some of my e-mail correspondence with your state agency on that:

"On Wednesday, December 13, 2017 10:51 PM, John McMillan wrote:

"This is to confirm your very succinct December 13, 2017-dated e-mail reply letter (below), stating that you have no record of any documents generated by your TWC Ombudsman at any time since August 1, 2001, that refer in any manner to myself, John Kevin McMillan of northwest Austin.

"I am resident of Austin District 10.

"I am very surprised and disappointed by your 'no documents' reply to me on this, particularly since I have written and sent e-mail letters of complaint to the TWC Ombudsman in Austin on dozens of occasions in the last several years.

Dear Houston Police Department Open Records Coordinator,

This is a Texas Open Records request in which I seek to obtain from your municipal law-enforcement agency in Houston, Texas, a copy of any and all written communications, including e-mail communications or memoranda or reports or public-statements or press releases or any letters to other police chiefs in other Texan or American cities, that were each written by or on behalf of Houston Police Chief Art Acevedo or any staff member of his at any time since November 30, 2016, and that, in each and every such case, refers or refer at least once in any manner to myself, John Kevin McMillan of Austin, Texas.

EXCLUDED from the scope of this public-information request are any and all written communications that were exclusively and solely written by myself, John Kevin McMillan of Austin, Texas.

Art Acevedo, as you of course know, is a former Chief of Police for the City Government of Austin in this state capital city for Texas. Acevedo held that very influential position of leadership for Austin from July 19, 2007, until November 29, 2016.

Acevedo also previously served as a high-ranking officer of the California Highway Patrol.

My legal name is John Kevin McMillan. My date of birth is April 27, 1957. I am a native of Lincoln, Nebraska.

I have resided in two respective apartments units during the period applicable to this public-information request: Village Oaks Apartments, 10926 Jollyville Road, Building 9, Apartment 902, Austin, TX 78759; and, ever since early September 2017, Village Oaks Apartments, 10926 Jollyville Road, Building 16, Apartment 1609, Austin, TX 78759.

My home phone number throughout the entire applicable time period has been and continues to be: (512) 342-2295.

My personal E-mail address throughout the entire applicable time period has been and continues to be: mcmillanj@att.net .

I am the founder and only approved current member of a new and non-Christian religion, the Progressive Prohibitionist Religion, with very stringent membership-eligibility requirements. Numerous Americans, including at least one biological relative of mine, my older brother Dr. Michael Kim McMillan---who himself reportedly resides with his Chinese-born wife in southern California---have each indicated to me that they themselves either dislike or intensely dislike my Progressive Prohibitionist Religion, or that they do not regard it as being a true religion in their opinion.

This public-information request is prompted in part by lingering questions I myself have had in regard to what prompted then-Austin Police Chief Art Acevedo in April 2009 to reportedly ask a female assistant of his in the Chief's office in Austin, Stephanie Hernandez, to request of me on the telephone on April 28, 2009 (after she had left an initial phone message with me on my home landline phone line asking me to call her, which I did), that I myself should refrain from ever again directly contacting Austin Police Chief Acevedo.

Two years before that very surprising phone conversation I had with a female assistant to Austin Police Chief Art Acevedo, I received the following one total and last-ever reply letter from then-Austin Police Chief Acevedo:

From: Acevedo, Art [APD]
Subject: RE: 7-27-07 reply sought re: four criminal-law issues in Austin

To: "John McMillan"
Date: Sunday, July 29, 2007, 9:54 AM

Dear Mr. McMillan,
Thank you for your note. I expect our members to enforce violations of law as required. Reports to Council will be made consistent with past practice and statute.

____

This public-information request was also prompted in part by a copy of an official 2016 e-mail referring to myself that I received through a public-information request I submitted to the City of Cedar Park (TX).

The e-mail letter was written by a public official who previously had served as Assistant Chief of Police in Austin, Texas, during Art Acevedo's prior tenure as Chief of Police for Austin. That public official was Sean Mannix.

The e-mail was written and sent by Cedar Park Police Chief Sean Mannix to Leander (TX) Police Chief Greg Minton, and, apparently, to each and every one of the police officers under Chief Mannix's supervision in the Cedar Park Police Department.

The following is the exact text of that 2016 e-mail communication from Cedar Park Police Chief Mannix, with a copy of this legal document having been sent to me by Cedar Park City Secretary Quinn, in response to an August 13, 2016 e-mail public-information request from myself:

"From: Sean Mannix

Regards,
ART ACEVEDO
Chief of Police
Austin Police Department

"Sent: Tuesday, May 31, 2016 5:43 PM

"To: (Cedar Park) PD General Inbox; 'Leander Police Chief Minton'

"Subject: RE: 5-22-16 urgent note to Ms. Black at SafePlace Austin

"FYI,

"This poor guy is 10-96 and believes that somebody enters his locked apartment on a nightly basis and sexually assaults him in his sleep. This has been going on for over six years and he continuously emails police officials, politicians, news organizations, prosecutors, etc.

"APD's CIT folks are very familiar with him. Any reply to Mr. McMillan will add you to his list of folks to correspond with.

A LEGAL FACT ABOUT THE DEMOGRAPHICS OF AUSTIN, TEXAS, IN THE TIME PERIOD 2011 THROUGH THE PRESENT:

DURING THE ENTIRE PERIOD EVER SINCE APRIL 28, 2011, ONLY THREE TOTAL CIVILIANS, TWO OF THEM RESPECTIVE MALE ADULT OFFICIAL ROOMMATES OF MINE AT THAT TIME AND ONE OF THEM A MALE ADULT RESTAURANT-INDUSTRY WAITER COWORKER OF MINE, HAVE EVER AT ANY TIME DIRECTLY STATED TO ME THAT THEY HAVE THEMSELVES DIRECTLY SPOKEN WITH AN INVESTIGATING OFFICER OF THE AUSTIN POLICE DEPARTMENT IN AUSTIN, TEXAS, ABOUT ANY OF MY NUMEROUS CRIMINAL-LAW COMPLAINTS TO APD ABOUT MYSELF BEING A SELF-IDENTIFIED VICTIM OF ALLEGED PERSONAL-INJURY-CRIMES AND ALLEGED ANAL-RAPE CRIMES ALLEGEDLY BEING INFLICTED ON ME ON A CONTINUOUS DAILY AND YEAR-ROUND BASIS DURING MY OWN SLEEPING HOURS AS I LAY ALONE, ASLEEP AND UNCONSCIOUS, ON MY OWN BED INSIDE MY LOCKED RENTAL APARTMENT UNIT IN NORTHWEST AUSTIN.

IS AUSTIN, TEXAS, A CITY FULL OF COWARDLY AND DISHONEST AND IMMORAL PERSONS, WITH MANY OF THEM EXHIBITING ALLEGED POSSIBLE OR LIKELY CRIMINAL INTENT OR HARMFUL INTENT TOWARD MYSELF?

THIS IS A VERY FAIR AND HIGHLY PERTINENT QUESTION THAT SOME FIRST-RATE AND HONEST CRIME INVESTIGATOR FOR A FEDERAL AGENCY MAY BE ASKING IN THE FORESEEABLE FUTURE.
