Here is information related to sexual harassment for your review. The Fair Housing Act (42 U.S.C. 3601-3619) protects individuals against discrimination because of sex. Courts recognize two types of sexual harassment: (1) quid pro quo sexual harassment (i.e., when a housing provider, or his or her employee, agent or contractor conditions access to or retention of housing or housing –related services or transactions on a victim’s submission to sexual conduct); and (2) hostile environment sexual harassment (i.e., when a housing provider or his or her employee, agent or contractor, or in certain circumstances another tenant, engages in sexual behavior of such severity or pervasiveness that it alters the terms or conditions of tenancy and results in an environment that is intimidating, hostile, offensive ,or otherwise significantly less desirable.

Your reply E-mail letter was apparently in response to E-mail correspondence from me I recently shared with you relating to medically injurious and unwanted noise pollution to which I have been subjected in Austin , Texas , on a continuous and year-round basis.

So far, the Attorney General of Texas has not expressed any concern to me in writing about the significant permanent and irreversible medical damage to my hearing capacity resulting from that continuous background noise pollution over a multi-decade period in Austin, Texas, including at each and every one of my workplaces in Austin and Cedar Park during that period, that I myself DID NOT and DO NOT generate or request or authorize or want in my own life. I lead a very quiet life in Austin , and I NEVER attend rock-music or punk-rock music concerts, for instance. In fact, I only rarely listen to music of any type during my leisuretime.

No state agency or State of Texas-owned institution, and no other government-owned or government-affiliated institution or organization of any type, has ever acknowledged to me at any time that it had any role of any type in sponsoring or permitting or authorizing or causing or inflicting or perpetrating the injurious noise pollution in Austin that has been very harmful to myself and my medical health over a multi-decade period.

However, I remain very hopeful that the Consumer Protection Division or Victim Services Division of the Office of the Attorney General of Texas state agency in Austin, Texas, will in the near future send me a reply letter providing me with helpful factual information and expressing an interest in this legal-liability matter facing the State Government of Texas, the City Government of Austin, Travis County Government, Williamson County Government, the City Government of Cedar Park, and the U.S. Government as well.

I continue to have a great need for a private attorney to file a lawsuit on my behalf relating to my being victimized ever since April 28, 2011, for instance, on a daily and year-round basis (with the only apparent exceptions having been the early-morning and morning hours of September 3, 2011, and Sept. 10, 2011) by one or more illegal intruders inside my bolt-locked apartment unit. However, so far the Austin Police Department has done nothing to stop the alleged violations of my own privacy rights occurring every day inside my bolt-locked apartment unit in which I am the only approved tenant and only approved occupant, even though I have filed several complaints with APD.

Mr. Barish, I realize that you don't handle sex-crime cases in which your client is the cited victim of injurious conduct of that type, from what you indicated in your phone message to me last year.

I am writing you today to politely ask you if you know of ANY private-attorney member of the Temple Beth Israel congregation, or any other attorney whom you would recommend, who might be willing to file a personal-injury complaint or sex-crime victim complaint on my behalf on a contingency-fee basis or pro-bono basis that relates to these alleged sex crimes victimizing myself during my sleep?

I am a very strong complainant, since I live alone (ever since late May 2011), I ALWAYS sleep alone on my bed, and I NEVER have any invited overnight guest or any invited guest inside my apartment unit between midnight and 8 a.m., for instance. Also, I lead a compeltely illicit-drug-free (no marijuana, either), permanently alcohol-free, fully-ambulatory, gainfully-employed lifestyle as a single adult lifelong-non-Christian gentleman. Also, I am psychologically healthy and consistently civil and clean-talking and law-abiding (I have no criminal-conviction record, in fact), and I do not seek to harm anyone or myself.

Does Senator Kirk Watson support full privacy rights for me and my legal and human right to sleep alone, without anyone else inside my private bedroom at that time, and to also myself sleep UN-molested as well as UN-harmed and UN-injured and UN-raped, inside my bolt-locked private bedroom of my rental apartment unit throughout the entirety of any and all time periods when I am sleeping or napping?

I might add that the ONLY exception to that legal right for myself I am seeking and agree to authorize would be if the Texas Department of Public Safety, a reliable and trusted former employer of mine, or the Travis County Sheriff's Office or the Dallas County District Attorney's Office or the Dallas County Sheriff's Office or some other reputable government agency or government official, such as the FBI or the U.S. Department of Homeland Security or U,S. President Obama, or the very distinguished State of Texas Senator Kirk Watson himself, or possibly the Austin Police Department or the Travis County DA's Office, were to be willing to provide me with top-secret and externally controlled electronic surveillance of my entire bedroom per se and my entire bathroom per se on a temporary multi-day or multi-week basis.

I am a low-income single adult white gentleman, and I cannot financially afford ADT surveillance of my private bedroom or bathroom at present.

I ALWAYS sleep alone, and I have ALWAYS been completely celibate throughout the entirety of all of my conscious or waking hours, with no sexual contact or intimate physical contact of any type with any person or any creature, for that matter, at any time ever since and including the date when I moved into Apartment 325 in January 2002 at this Westdale-managed apartment complex in northwest Austin.

Any and all DNA-swab evidence ever since January 2002, for instance, that was obtained from my own anus or buttocks or genitals or mouth or other part of my body, and that can be traced to a human or animal DNA source OTHER than myself, is therefore very clear and convicing criminal-law evidence and legal proof in a court of law in Austin that I was, in fact, raped by that alleged criminal person or creature.

I feel hopeful that either Westdale headquarters officials in Dallas or my professionally polite general manager, Ms. Coker, would agree to government-provided top-secret electronic surveillance of my bedroom and bathroom on a temporary multi-day or multi-week basis during this time period.

I have never consumed any illicit drug other than marijuana on any occasion in my entire life; and I am very opposed to any and all forms of marijuana consumption or any of the so-called "medical-marijuana" consumption. I am also very opposed to any illicit drug activities of any type, anywhere in Austin, Texas, and anywhere else, for that matter.

I resided in Apartment 325 in Building 3 at Wind River Crossing Apartments from January 2002 through my move-out date of July 29, 2015. I had previously resided as an official tenant in Apartment 1638 of Building 16 at Wind River Crossing from August 2001 until January 2002, with my roommate during that multi-month period of 2001 having been a Mr. Christian Meza.

I have been and remain to this very day completely celibate by choice, throughout any and all of my own conscious or waking hours, regardless of where I was or am stationed or situated or where I visited or stayed or rented an apartment or room, throughout any and all of my own waking or conscious hours ever since and including the day when I moved into Apartment 325 in Building 3 at Wind River Crossing Apartments in January 2002.

I myself am gainfully employed and do not have any criminal-conviction record.

I insist on my legal right to myself file criminal-law charges as soon as possible against any and all alleged trespassers or alleged personal-injury-crimes-perpetrators or alleged rapists or alleged criminal persons of any background who at any time are or were somehow situated inside my bolt-locked bedroom or my bolt-locked rental room during periods when I am or was sleeping alone and lying unconscious on my bed, or who are or were themselves allegedly sponsoring or serving as financiers or employers of any alleged "intruders" or "trespassers" or "rapists" or "sleep-disruption harassment team members" or "personal injury crimes perpetrators" inside my bolt-locked bedroom or my bolt-locked rental room during my bedtime hours.

Among the insights I hope to glean from this public-information request are possible answers to the following questions:

---What prompted Austin Police Department Officer James Turner to ask me on his own initiative during an on-duty visit he made to the front balcony of my apartment unit at Wind River Crossing this summer: "Are you (John Kevin McMillan) planning to move out of (Travis) County?"

---What prompted Austin Police Department Officer James Turner to state to me on his own volition in 2012, during an in-person meeting he had with me at Wind River Crossing Apartments in which I had informed him that I have been anally-raped and personally injured during my sleep by alleged illegal intruders inside my bolt-locked apartment unit on a frequent and year-round basis during my sleeping hours: "They can't harm you (John Kevin McMillan) that much."

---What prompted the very same APD Officer James Turner to volunteer to me the following very surprising in-person oral statement in 2011 or 2012, this with no apparent context to his "disclosure," during a meeting I had with him at Wind River Crossing Apartments: "These types of things can turn around overnight, and can lead to a very fast out-of-court settlement (sic)"?

---What prompted my most recent apartment management-team-approved roommate at Wind River Crossing, "John Douglas Martin" his stated "legal name," to repeatedly state to me inside our apartment unit in July 2015, "You (John Kevin McMillan) will find that no matter where you move to in Austin, you will still be getting raped every night"?

---Is there any evidence that one or more persons have attempted to "harass" me into moving away from the Austin metro area, as Travis County Civil Probate Division Director David Ferris had possibly indicated to me in latter 2001 when he stated to me on the phone during a local phone call I made to his county government office in downtown Austin from my rental apartment unit at that time in Building 16 at Wind River Crossing Apartments, "There appears to be an attempt by numerous persons in the Austin area to drive you (John Kevin McMillan) out of the Austin area"?

---Is there any official or "unofficial" policy by the City Government of Austin to allegedly "discourage" me or "punish" me or "medically injure" me or "physically abuse" me or allegedly "stalk" me for having myself chosen to reside in Austin proper during any cited time period?

--Has the City Attorney's Office in Austin obtained any evidence from any source other than myself which indicates that on AT LEAST ONE OCCASION in the four and one-third-year period since 12:01 a.m. April 17, 2011, I myself have, in fact, been physically abused and medically injured and sexually assaulted and robbed of REM sleep I would have otherwise benefited from, during a time period when I was asleep and lying alone on my own bed inside my bolt-locked private residence in Austin?

---Has the City Attorney's Office had any communications with APD Detective Brian Narciso of the APD Sex Crimes Unit in regard to APD Sex Crimes Case Number 15-1540423, a crime case for which he is the assigned investigator and for which I myself had filed a crime report with APD on June 3, 2015, and for which I myself had sought APD authorization for a forensic anal-rape exam on myself inside a hospital emergency room in north Austin to which I was transported at my request by EMS ambulance on the morning of June 3, 2015.

---Has any official of the City of Austin Law Department stated this year that he or she believes that the refusal of the City of Austin to insist on full and prompt laboratory processing by APD of the doctor-ordered anal-rape-evidence kit obtained from my own body on Dec. 22, 2011, for APD Sex Crimes Case Number 11-3550615---a rape-evidence kit reportedly still being maintained by APD at present at an APD substation in Austin---might comprise a legal liability for the City of Austin?

Mr. McMillan, I do not know what state agency would be in charge of this. If I had to guess, I would say the Texas Commission on Environmental Quality.

Generally speaking, I know that noise complaints are filed with the appropriate local or county law enforcement office. In the City of Austin, the complaint would go the Austin Police Department. In Travis County (in unincorporated areas outside of cities), it would go to the Travis County Sheriff's Department. What they do in response to a complaint is test the noise volume, then decide how to proceed.

This is all I know. Hope this helps.

I am very hopeful that those kindly relatives of mine and Cousin Jim Dane in the Iowa City area of Iowa might be willing to help me identify the source of that injurious noise pollution I did not cause or generate or authorize that puts me at risk of my going deaf in Austin, according to my ear, nose, and throat specialst, Dr. David Tobey, who indicated to me recently during an examination of myself inside his Austin Ear, Nose, and Throat medical clinic along Angus Road in northwest Austin that Dr. Tobey would not rule out that possible eventual scenario of deafness in my own future in Austin, Texas. That attorney, Ms. Deborah Fulton, later stated to me in writing, through a follow-up note she sent me today, that she had inadvertently E-mailed that note sent to myself. Ms. McCleary, do you need me to myself directly contact the Austin Police Department by calling either 911 or 311 early this Wednesday morning, January 9, in order to myself directly file official criminal-charges at that time against one or more alleged suspected intruders who allegedly will have illegally entered my bolt-locked one-bedroom apartment unit this Wednesday morning and who allegedly will have subjected me to alleged personal-injury crimes and alleged rape crimes during my sleep this Wednesday morning as I sleep alone on my bed inside my bolt-locked apartment unit at the Westdale-owned and Westdale-managed Wind River Crossing Apartments in NW Austin?

I am posing this question to you based on my sensing that the continuous daily and frequent and year-round felony-crimes victimizing myself during my sleep inside my bolt-locked apartment unit (Apartment 325 at Wind River Crossing) apparently have not been terminated yet, and are therefore expected by me to continue to victimiize me again this Wedneday morning, January 9, 2013, during my sleep inside my bolt-locked apartment unit at Wind River Crossing in NW Austin.

In the entire multi-year period ever since and including the early morning hours of April 17, 2011, in particular, there have been only two total mornings I can recall (the early morning hours of Saturday, September 3, 2011, and the early morning hours of Saturday, September 10, 2011) when I woke up on my bed that morning and I immediately sensed that I myself had NOT been molested or physically abused or medically injured or subjected to anal-rape during my sleep that morning.

Each of those two total mornings in September of 2011 were mornings for which I had been scheduled in advance to work as a member of the waitstaff at ... (my corporate-owned) cafeteria (workplace) near Lakeline Mall in the Austin area beginning at 11 a.m. on each of those two respective Saturday mornings in September of 2011.

I reported for work on time for both of those two respective workshifts (Sept. 3, 2011, and Sept. 10, 2011), and I did politely comment to my work supervisor at (my corporate-owned cafeteria workplace)..., Mr. Jerry Moore, a self-identified former Harris County Sheriff's Office investigator in the Houston area, on one or both of those two respective Saturday mornings in September 2011 that I was very hopeful that the illegal intruder allegedly victimizing me during my sleep on a daily and year-round basis had finally been arrested by a law-enforcement agency in Austin, Texas.

Thank you in advance, Ms. McCleary, for your helpful reply note offering me guidance on whether you would recommend that I call either 311 or 911 at the next applicable occasion and file a formal criminal-law complaint with the Austin Police Department on the telephone the very next occasion (such as late this Tuesday night or early this Wednesday morning) when I am abruptly awakened on my bed inside my bolt-locked apartment unit and I immediately sense at that time that I was again victimized by personal injury crimes during my sleep or by rape of any type during my sleep.

I am making this request for guidance from you partly because, as I indicated to you on the telephone this Tuesday, the Austin Police Department throughout 2012 and 2013 thus far has repeatedly refused to investigate any crime reports of that type from myself.

APD in Austin, Texas, has also insisted that all of the infrared photos I've obtained for myself from inside my bolt-locked apartment unit beginning in Feb. 2012 (I purchased my first-ever infrared camera in Feb. 2012, and before that time I had never once ever on any occasion owned or operated any infrared camera at any time in my entire life) were all of myself, John Kevin McMillan, and of no one else, APD officers repeatedly stated to me throughout 2012. APD still, to this day, has repeatedly refused to accept from me any of the several video cards I own that each contain infrared-photograph images of one or more alleged illegal intruders inside my bolt-locked apartment unit at Wind River Crossing during my bedtime hours in 2012.

Also, APD has on two separate occasions in 2012 (Feb. 16-20 of 2012 at Austin Lakes Hospital, and October 14-16 of 2012 at Shoal Creek Hospital) responded to crime reports from me about one or more alleged illegal intruders inside my bolt-locked apartment unit by subjecting me against my wishes to a "48-hour" peace officers' involuntary commitment inside a psychiatric hospital in Austin.

No psychiatric medication was ever forced upon me at either psychiatric hospital, and I did not consume any psychiatric medication during either of those two involuntary hospitalizations that also cost me lots of forgone wages and tips I would have otherwise earned at my restaurant jobs. The City of Austin has not financially compensated me in any way for those foregone wages and tips.

I was credited with being a polite and rational and civil and law-abiding and honorable patient throughout each of those two involuntary hospitalizations in 2012 to which I was subjected against my wishes by APD. I was released from Austin Lakes Hospital and from Shoal Creek Hospital, respectively, without any court hearing for me of any type on each of those two separate occasions in February 2012 (Austin Lakes Hospital near the central St. David's Hospital location, and also situated near UT-Austin) and in October 2012 (Shoal Creek Hospital in west Austin), respectively.

One tall African-Amrican male staff member at Shoal Creek Hospital, a man identifying himself as "Terence," responded in a repeatedly and surprisingly hostile manner toward me when I at least twice politely asked him in person in the early morning hours of Tuesday, October 16, 2012, for the opportunity to myself be examined by a nurse at that time.

I stated to Terence, the cited staff member for Shoal Creek Hospital, that I had been abruptly awakened on my assigned bed inside my assigned room at Shoal Creek Hospital, and that I had experienced significant anal pain immediately after I was very abruptly awakened there in the middle of my sleep that morning, I stated to that African-American male staff member. I had been sleeping alone on my assigned bed at the time when I was abruptly awakened with throbbing pain in my anus.

Terence repeatedly replied to my request for a nurse by stating to me that he would NOT agree to let me meet with any nurse. "Go back to bed (exact quote)!" Terence emphatically stated to me in a very terse and hostile manner that morning of Ocotber 16, 2012, at Shoal Creek Hospital. As it turned out, no examination of my anus or of my cited anal pain was ever granted me by any staff member of Shoal Creek Hospital prior to my release from that hospital at about noon on Tuesday, October 16, 2012.

The psychiatrist who met with me for the first time ever on Tuesday, October 16, 2012, Dr. Garcia, did state to me that he strongly disagreed with the decision by the Austin Police Department to subject me to involuntary hospitalization inside Shoal Creek Hospital at that time. Dr. Garcia commented to me on my lucidity, the consistency of my statements to him, my alertness, my civility, my politeness, my rational and factually-minded style, and my definitely NOT being a psychotic human being, Dr. Garcia helpfully emphasized. I appreciated his expression of confidence in me.

During my prior period of involuntary hospitalization by APD at Austin Lakes Hospital in February 2012, I did politely complain to the staff there that at about 1:30 a.m. Monday, Feb. 20, 2012, I was very abruptly awakened on my assigned Austin Lakes psychiatric hospital bed with severe pain in my anus, and that I then immediately noticed that the door leading into my assigned bedroom had been left wide open by someone unbeknownst to myself. I had myself on Sunday night, Feb. 19, left that door only slightly open, according to the rules and regulations on that that had been clearly explained to me by staff members at Austin Lakes Hospital.

I was informed on Feb. 20, 2012, by Holly, a female supervisor at Austin Lakes Hospital, that one male nurse, "Chin" or "Chen" ---- a male person of apparent Far East Asian ancestry, I observed----had in fact entered my assigned bedroom between 1 a.m. and 1:30 a.m. that Monday, February 20, 2012, the female shift-supervisor informed me. Holly also stated to me that she did not find out from her own supervisor, based on a review of their videotape on that, exactly how many minutes the male nurse Chin or Chen had remained inside my assigned bedroom before he left that room of mine and continued his assigned duties for Austin Lakes Hospital.

Ms. McCleary, I would welcome any and all DNA medical testing on me and on my current bedsheets that you are willing to help authorize for me as soon as possible, including anytime tonight.

I feel very confident about my being a very strong criminal-law complainant for your Travis County District Attorney's Office as you proceed toward filing criminal-law felony charges against one or more alleged rapists who allegedly victimized myself and allegedly subjected me to personal-injury crimes during my sleep as I slept alone on my bed in Austin.

I would also like to take this opportunity to thank Norma Hilbig (also known as Norma Almaraz) of your Travis County DA's Office for having discussed this case with me on the telephone several months ago and shortly before her retirement.

Ms. Hilbig in that phone conversation we had emphasized to me that I had a need for an urgent ladder to help me check for any possible hidden points of illegal entry into my bolt-locked apartment unit from above. She pointed out in that phone conversation we had that since I live in a top-floor, vaulted-ceiling apartment unit, my apartment is especially vulnerable to illegal intruders entering illegally from above my unit, Ms. Hilbig pointed out in our phone conversation shortly before her retirement as a paralegal for the Strategic Prosecution Division of the Travis County DA's Office in Austin.

When I then requested that the apartment management team at Wind River Crossing provide me with a ladder so I could check my entire apartment unit for possible illegal points of entry from above, the apartment managhement team here chose not to honor that request from me. Nor has the Austin Police Department so far been willing to bring any ladder into my apartment unit in order to check for any and all possible illegal points of entry from above into the bedroom of my apartment unit.

A respectful FYI to each of you on the following alleged felony continuous daily and frequent and year-round personal-injury crimes and alleged felony continuous and daily and frequent and year-round anal-rape crimes and nasal-inhalant-rape crimes and oral-inhalant-rape crimes case in which I am definitely the victim during my sleep (I snore) on a daily and year-round basis at an apartment complex reportedly owned and managed by a "Westdale," a for-profit corporation headquartered in Dallas, Texas.

I am very grateful to the Federal Bureau of Investigation for the very kind interest in this crime case that the FBI under the apparently helpful leadership of U.S. President Barack Obama has expressed to me in recent days.

I welcome any and all DNA testing on myself, any DNA testing on my bedsheets (which have several noteworthy stains on them, some of which I maintain did NOT come from myself), that the Federal Bureau of Investigation is willing to order during this period in which the local law-enforcement agency in Austin, Texas, under the cited "leadership" of Chief Art Acevedo, an ex-Californian, has repeatedly declined to investigate or file charges against any alleged illegal intruder in my bolt-locked, top-floor, vaulted-ceiling apartment unit where I live alone and I am the ONLY approved current tenant on my current 11-month apartemnt lease or contract with Wind River Crossing.

One high-ranking law-enforcement officer for a State of Texas agency (Officer Ruben Puente of the University of Texas System Police Department in Austin, with this full identification of that law-enforcement officer being added by me to this E-mail letter of mine Sept. 13, 2015---jkm), who asked for anonymity, did on his own initiative make a phone call to me in late December 2012 in which he discussed this alleged continuous crime case with me.

That law enforcement officer of the State of Texas on his own initiative during that phone call he made to me referred to the "situation you're (John Kevin McMillan) are having to endure" (exact quote).

At no time during that phone conversation did that high-ranking law-enforcement official of the State of Texas ever once state to me that he questioned the accuracy or validity of my frequent and numerous crime reports to APD about this alleged continuous felony-crime case in which I am definitely the victim during my sleep on a daily and year-round basis inside my bolt-locked apartment unit at Wind River Crossing Apartments in NW Austin.
